El Derecho a la Información en América Latina: Comparación Jurídica

El primer capítulo de este libro, Normas y Tendencias Internacionales, analiza la justificación internacional para aseverar que el derecho a la información es un derecho humano fundamental. El análisis pasa revista a declaraciones oficiales internacionales y las decisiones de cortes internacionales y cuasi-judiciales, así como los adelantos nacionales respectivos. El segundo capítulo explora las implicaciones de las varias normas para la legislación sobre el derecho a la información, analizándolas dentro del marco de nueve principios en la materia. Estos capítulos están, en gran medida, incorporados de la segunda edición de la publicación que acompaña a este libro.
Después de estos capítulos, siguen el análisis de las leyes de los 11 países de América Latina que han adoptado leyes de derecho a la información, es decir, Chile, Colombia, Ecuador, Guatemala, Honduras, México, Nicaragua, Panamá, Perú, la República Dominicana y Uruguay. Cada sección nacional está organizada bajo el mismo conjunto de encabezados. Después de una breve introducción, siguen secciones sobre el derecho al acceso, las garantías procesales o procedimentales, la obligación de publicar, las excepciones, apelaciones, sanciones y protecciones,
y medidas promocionales.

Written by Daniel Pimienta, Daniel Prado and Alvaro Blanco, this publication is an update to the previous UNESCO study on this subject that was issued for the World Summit on the Information Society in 2005.
