Ratification by Guatemala of the Convention on the Protection of the Underwater Cultural Heritage (Paris, 2 November 2001)

On 3 November 2015, Guatemala deposited with the Director-General its instrument of ratification of the Convention on the Protection of the Underwater Cultural Heritage.

The instrument of ratification was accompanied by a letter containing the following declarations:

“La República de Guatemala declara que la forma en que transmitirá la información prevista en el apartado b) del párrafo 1 del Artículo 9 será la prevista en el subpárrafo ii) de dicho apartado.”

“A los efectos de lo dispuesto en el párrafo 4 del Artículo 25, la República de Guatemala declara que se reserva el derecho de considerar cualquiera de los procedimientos de solución de controversias contemplados en el Artículo 287 de la Convención de las Naciones Unidas sobre el Derecho del Mar, según pueda acordarse en cada caso particular.”

“Conforme el Artículo 28, la República de Guatemala declara que las Normas se aplicarán a sus aguas continentales que no sean de carácter marítimo.”

“La ratificación de esta Convención no constituirá renuncia total o parcial de la soberanía del Estado de Guatemala sobre ningún territorio (terrestre, insular o marítimo) por él reclamado; ni irá en detrimento de derecho alguno del Estado de Guatemala sobre dicho territorio; ni constituirá precedente para el fortalecimiento o debilitamiento de su reclamación sobre ningún territorio. La República de Guatemala reserva expresamente sus derechos con respecto a sus reclamos de soberanía sobre cualquier territorio (terrestre, insular o marítimo).” [Original: Spanish]


In accordance with the terms of its Article 27, the aforementioned Convention will enter into force with respect to Guatemala three months after the date of the deposit of this instrument, that is to say on 3 February 2016.
