The USAID-funded Support for Orphans and Vulnerable Children affected by HIV/AIDS project (referred to as Kenya OVC Track I from here onwards) was a six-month follow-on award to the five-year Breaking Barriers Project, implemented in Kenya, Uganda, and Zambia, that ended in September 2010. In response to the critical need of affected children and families, the compelling evidence for their benefits, and the receptive environment on the part of governments and donors, several local and international organizations are piloting cash transfers programmes as a mechanism to mitigate the impact of human immunodeficiency virus (HIV) and acquired immune deficiency syndrome (AIDS) on affected communities in sub- Saharan Africa. Few programmes, however, are conceptualized or implemented within a broader framework of social protection, socioeconomic development or human rights. …

Many Millenium Development Goals (MDG) targets will not be met by 2015. The evidence presented in this report clearly shows that the widespread abuse of children's rights to care and protection is in part responsible for hindering progress against the MDGs. These rights include a recognition of the central importance of family-based care for child wellbeing, and children's right to be free from violence, exploitation, abuse and neglect. This report presents some policy recommendations to achieve the MDGs.
Legislation can be instrumental in impeding or promoting initiatives to address the HIV/AIDS epidemic. The widespread legal, social, economic and political ramifications of the epidemic make it necessary to review and reform a broad range of laws.
