Decree-Law 312 on special social security scheme for creators and technical artists

Context of the measure:

b. Key objectives of the measure: 
  1. Extend the implementation of the Decree to include designers, artisans, artists and creators (in other words, besides visual artists)
  2. Ensure the financial gain of artistic creators resulting from the marketing of their products and services.
  3. Establish tax obligations and ensure the social security of creators.
  4. Improve and adapt current regulations relative to the protection of the social security of persons in this sector.

Extend the coverage of the special social security scheme contained in Decree-Law No. 270 “On the Social Security of Creators of Visual, Applied, Musical, Literary and Audiovisual Arts and on the Special Protection of Salaried Workers in the Arts Sector”, of 8 January 2010.

It is a measure of the Council of State with a national scope. It is implemented in all institutions attached to the Ministry of Culture whose social purpose is to manage the special scheme of creators and artists. These institutions cover the entire process of creating, producing and marketing cultural goods, products and activities in the different sectors of creative industries: books, cinema, performing arts, visual arts, design, museums and research, houses of culture, video games, etc.

The special social security scheme for creators and artists protects the creators of visual, applied, musical, literary and audiovisual arts, including writers, playwrights, scriptwriters, as well as the support staff, not contemplated in the social security general scheme or any other special scheme. In other words, creators, artists and support staff who are represented by entities and institutions authorised before natural and legal persons that make use of their services. Its benefits also include technical workers and members of the support staff associated with them, that is, artists and support staff, who receive personal income in any type of currency, both in Cuba and abroad.           

The registration of the artist and support staff in the Taxpayers Registry of the National Internal Revenue Office (ONAT) for their contribution to social security is compulsory. It is tantamount to their entrance in this special social security scheme. It grants the right to a length-of-service pension to artists who, regardless of their work status, carry out certain artistic activities for which specific physical and intellectual conditions are required. If offers protection against old age, full disability, be it temporary or permanent, maternity, and, in the case of death, it protects the family.

All artists in the disciplines currently protected by law benefit from this special scheme.

The State receives greater income from the artists’ activity.

The situation of creators and artists improves when they market their products, since their activity is officially recognised by social security and they can benefit from the pension system.   

Income tax revenues increase.

More creators form part of the state social security system.

The special scheme is financed with the contribution of members (creators, artists and support staff), and of the entities marketing their works, or authorised entities and institutions representing them, as the case may be. If need be, the State provides the financial resources needed to ensure the income and expenditure balance of the special scheme. Each member contributes 8% of the monthly contribution established within a scale of 350 to 2,000 pesos. Marketing entities and those representing them contribute 12%.

Transformation of buildings in cultural centres with programming dedicated to different artistic genres

Extend the network of public service facilities for the enjoyment of music, the performing arts, visual arts and literature.

Ten institutions originally conceived for other purposes, were adapted and transformed. The corresponding legislative measures taken in each case so that these sites could become cultural facilities at the service of the public, completely renovated and provided with the technology and conditions required.  

The total capacity of all these facilities, which opened their doors between 2012 and 2013, is 20,000 persons per activity, including in this figure the services that some of them provide in other places in the country.

Based on this research, the needs for the development of creation, heritage and education have been determined for the current period.

The needs for training artists during the current period were specified.

The integration of entities belonging to the Public Library System was improved.

The participation of Cuban artists and writers in artistic presentations abroad and that of their counterparts in Cuba has grown. There has also been an increase in the studies offered by Cuba in the different modalities available in its arts schools through self-financed comprehensive training courses, as well as courses in different specialties of artistic expression.

Given the existing international political and economic circumstances, the factors that can affect our objectives are being evaluated in order to offset their effects. As a result, the import capacity of creators and artists has been expanded and marketing opportunities have been identified.

In addition to evaluations and onsite monitoring, at the end of each year the Department of the Ministry of Culture elaborates an annual report where the results achieved throughout the year are examined. At the end of 2015 the repair, adaptation and/or remodelling of 102 cultural institutions and centres throughout the country had been completed, allowing a notable increase in the possibility of persons from different social sectors and age groups to access quality cultural programming that meets their expectations and needs, thereby ensuring the enjoyment and spiritual enrichment of people from all over the country, including those living in remote locations in sparsely populated areas.

The project falls within the framework of the resolution of the Ministry of the Economy and Planning to support municipal local-development initiatives which generate income, substitute imports and create jobs.  The Municipal Local-Development Initiative (MLDI) promotes the active participation of governments in the development strategy through the management of economic projects that are self-financed, generate income by substituting imports, especially foodstuffs, and obtain profits that will benefit local communities in a sustainable manner. It consists in a CUC and CUP fund to finance municipal initiatives through credits. Once they are approved, there is a commitment to return the initial investment and give a previously negotiated percentage of the profits to the municipal government to be reinvested in social sustainable development actions.

La Casa de la Guayabera is a local development initiative in the province of Sancti Spíritus registered as an MLDI. It is located in a house where cultural and recreational activities are held with different age groups, nautical activities along the Yayabo River are organised, and theoretical events on culture and sustainable development are conducted. It has a museum with guayaberas donated by national and international figures, as well as a shop where artisans and self-employed workers can sell their products. There is also a cafeteria-restaurant managed by a self-employed worker and a bar managed by the ARTEX Paradiso agency.

The project is self-sustainable and generates employment constituting an example of a joint state and non-state venture.

The country has 19 MLDIs in the culture sector.

  • The family participates in recreational-educational spaces.
  • The family discusses community problems at the wall-cinema.
  • Better communication among persons in the community. Different neighbourhood groups have joined in the activities of the project.

The cultural perspective is added to municipal development strategies as a pivotal tool for sustainable development. The programme contributes to the methodological conception of cultural development programmes of the Ministry of Culture in each municipality where the programme interacts.

This programme is financed by the Swiss Agency for Development and Cooperation (SDC).

For this purpose, it implements capacity-building processes, spaces for exchange, experiments with sustainability guidelines focusing on the economic dimension. It enables the dialogue of a wide range of actors and articulates their practices. Decree-Law 312 on special social security scheme for creators and technical artists

It is a measure of the Council of State with a national scope. It is implemented in all institutions attached to the Ministry of Culture whose social purpose is to manage the special scheme of creators and artists. These institutions cover the entire process of creating, producing and marketing cultural goods, products and activities in the different sectors of creative industries: books, cinema, performing arts, visual arts, design, museums and research, houses of culture, video games, etc.

The special social security scheme for creators and artists protects the creators of visual, applied, musical, literary and audiovisual arts, including writers, playwrights, scriptwriters, as well as the support staff, not contemplated in the social security general scheme or any other special scheme. In other words, creators, artists and support staff who are represented by entities and institutions authorised before natural and legal persons that make use of their services. Its benefits also include technical workers and members of the support staff associated with them, that is, artists and support staff, who receive personal income in any type of currency, both in Cuba and abroad.           

The registration of the artist and support staff in the Taxpayers Registry of the National Internal Revenue Office (ONAT) for their contribution to social security is compulsory. It is tantamount to their entrance in this special social security scheme. It grants the right to a length-of-service pension to artists who, regardless of their work status, carry out certain artistic activities for which specific physical and intellectual conditions are required. If offers protection against old age, full disability, be it temporary or permanent, maternity, and, in the case of death, it protects the family.

At the end of 2015 the repair, adaptation and/or remodelling of 102 cultural institutions and centres throughout the country had been completed, allowing a notable increase in the possibility of persons from different social sectors and age groups to access quality cultural programming that meets their expectations and needs, thereby ensuring the enjoyment and spiritual enrichment of people from all over the country, including those living in remote locations in sparsely populated areas.

La Casa de la Guayabera sociocultural project, a local municipal development initiative in Sancti Spíritus

The project falls within the framework of the resolution of the Ministry of the Economy and Planning to support municipal local-development initiatives which generate income, substitute imports and create jobs.  The Municipal Local-Development Initiative (MLDI) promotes the active participation of governments in the development strategy through the management of economic projects that are self-financed, generate income by substituting imports, especially foodstuffs, and obtain profits that will benefit local communities in a sustainable manner. It consists in a CUC and CUP fund to finance municipal initiatives through credits. Once they are approved, there is a commitment to return the initial investment and give a previously negotiated percentage of the profits to the municipal government to be reinvested in social sustainable development actions.

La Casa de la Guayabera is a local development initiative in the province of Sancti Spíritus registered as an MLDI. It is located in a house where cultural and recreational activities are held with different age groups, nautical activities along the Yayabo River are organised, and theoretical events on culture and sustainable development are conducted. It has a museum with guayaberas donated by national and international figures, as well as a shop where artisans and self-employed workers can sell their products. There is also a cafeteria-restaurant managed by a self-employed worker and a bar managed by the ARTEX Paradiso agency.

The project is self-sustainable and generates employment constituting an example of a joint state and non-state venture.

The country has 19 MLDIs in the culture sector.

The cultural perspective is added to municipal development strategies as a pivotal tool for sustainable development. The programme contributes to the methodological conception of cultural development programmes of the Ministry of Culture in each municipality where the programme interacts.

This programme is financed by the Swiss Agency for Development and Cooperation (SDC).

The project expresses the will of Cuban institutions to boost participative proposals which favour the capacity-building of cultural actors for their proactive contribution to the transformations and changes that take place in Cuban society, enhancing the role of culture and its possibilities to promote sustainable management focusing on the economic dimension.

For this purpose, it implements capacity-building processes, spaces for exchange, experiments with sustainability guidelines focusing on the economic dimension. The project is aimed at generating new models of sustainable development based on four cultural initiatives with consolidated results which provide points of reference and methodological guidelines that can be replicated in the country’s current context. It enables the dialogue of a wide range of actors and articulates their practices. It systematises the process visualising potentialities and obstacles, and uses audiovisual means to stimulate proactive participation.

The work of the programme is represented by the Palomas Project, in addition to other institutions. Priority given to audiovisual materials and workshops for women and men who have survived different forms of violence. Attention to male offenders. Sexuality, sexual and reproductive rights. The dissemination of these themes takes place through traditional and alternative media, in order to prevent, form, disseminate, sensitise, promote and reproduce good practices, among other actions, in favour of good living and respect for Mother Earth.

A total of 67 art instructors from all the provinces in the country and the special municipality of the Isle of Youth have been benefited in their preparation as members of the cadres reserve of the Ministry of Culture.

12 out of the total number of youth who were prepared carry out executive functions in institutions of the culture sector and 23 of them have worked as art instructors in the Corazón Adentro Culture Mission in the Bolivarian Republic of Venezuela.

Increase in the number of amateur artists.
