The study reviews the laws, policies and related frameworks in 23 countries in East and Southern Africa (ESA) that create either impediments to, or an enabling environment for, adolescent sexual and reproductive health and rights. The assessment resulted in the development of a harmonized regional legal framework, which translates international and regional legal provisions into useful strategies. UN global plans on HIV/AIDS have committed to reducing the number of countries with punitive laws criminalizing key populations. This study explores whether punitive laws are associated with countries’ performance on targets set in the global plans. As a result, it states that a significantly larger proportion of countries that criminalize same-sex sexual behaviour reported implausibly low size estimates or no size estimates for MSM. …

It provides a welcome update of positive initiatives from various national human rights institutions, in addressing the discrimination, stigmatization and violations facing individuals and groups who simply wish “to be” what they actually are. South Africa’s recently adopted Children’s Act provides children the right to access reproductive health services as a way of addressing the HIV pandemic, but there remains confusion about how socially divisive rights provided for by the Act, such as condom access for youth, will be achieved. The Children’s Act, together with South African government policies, allows individual schools to decide whether to distribute condoms, but most school staff are unaware of South African policy and regulations governing condom provision in schools. …
This APCOM policy brief presents evidence on the vulnerability of young MSM, particularly with regard to HIV & AIDS. It highlights the gaps in strategic information in the region, particularly for young transgender people. It encourages countries to strengthen health promotion programmes for high-risk youth, while ensuring appropriate services for those who are HIV-positive. The brief calls on countries to engage young MSM and transgender people in national AIDS response, and to review and challenge laws criminalising sex between men.
