Research references on the implementation of the 2003 Convention

Disseminate research for all stakeholders

The 2003 Convention Research Bibliography provides an interactive bibliography of research references related to the Convention for the Safeguarding of the Intangible Cultural Heritage and its implementation.

Based on work initiated in 2012, this project is hosted by UNESCO and led by an editorial group of independent researchers, with the support of volunteer researchers.

It intends to foster better communication among researchers working in the field of intangible cultural heritage and enhance dissemination of ICH-related research for all stakeholders involved in the implementation of the 2003 Convention (States Parties, communities, practitioners, civil society, UNESCO Secretariat and others).

    • Abstract:

      L'Atlas du patrimoine immatériel de l'Andalousie est un projet porté par l'Institut Andalou du Patrimoine Historique, le Centre d'Etudes sur l'Andalousie et par les institutions qui intégreront le projet au cours de son développement. Cet atlas aura pour but de registrer, documenter et diffuser le patrimoine immatériel de l'Andalousie. Il s'agira d'une base documentaire qui permettra aux collectifs impliqués ainsi qu'à la société en générale, de connaître ce patrimoine, de discerner les mesures à prendre afin de le sauvegarder et d'en assurer sa continuité, selon les critères établis par la Convention de l'Unesco (2003) et par la légistaltion andalouse en vigueur. Le projet a été décliné en quatre phases au cours desquelles les porteurs du projet rassembleront des sources écrites et orales et élaboreront des documents graphiques, sonores, photographiques et visuels concernant le patrimoine immatériel de l'Andalousie. Dans cet article, l'auteur expose les objectifs du projet ainsi que la méthodologie de travail qui a été retenue pour son élaboration.

    • Abstract:

      Tourism as an experience and an industry is infused by culture in its various dimensions, and influenced throughout by relationships of power; this is particularly apparent at the destination site. Anthropological investigations give rich insights into power and culture through ethnographic fieldwork, comparative analysis and theoretical explanation. Within this timely and groundbreaking book case studies come from Latin America, the Caribbean, Europe, Africa, Australia and South East Asia. It is divided into two sections dealing with tourism and the power struggle for resources; and tourism and culture: presentation, promotion and the manipulation of image. Chapters explore issues as diverse as terrorism, ethnicity and World Heritage Sites, and the role of the analysis of power in tourism studies. They illustrate how culture shapes tourism development, is commodified, and becomes a tool in political and economic strategies and struggles.

      The article analyses the Portuguese legislation about Cultural Heritage, namely the approach towards Intangible Cultural Heritage (ICH), a new category promoted by the UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage (2003). Furthermore, it presents general considerations regarding inventories in the Portuguese scene, considering the importance of identifying ICH as a preliminary step in order to develop safeguarding strategies.

      Dans une première partie, Castells décrit les caractéristiques du régime alimentaire méditérranéen ; elle expose les valeurs qu'il véhicule et présente ses bénéfices. Ensuite, l'auteur met l'accent sur les problématiques actuelles que pose le régime alimentaire méditérranéen, d'un point de vue nutritionnel et patrimonial. Dans une troisième partie, Castells décrit la candidature de cet élément à la Liste représentative du patrimoine culturel immatériel de l'Unesco, lidérée par le gouvernement espagnol. Finalement, l'auteur fait une réflexion sur les opportunités que cette inscription représenterait pour les Îles Baleares en termes de tourisme gastronomique.

      This article presents the three different interpretation strategies used for Yoruba objects in Western museums. It argues that, traditional religious Yoruba objects in museums and art galleries are primarily interpreted either as ethnographic items or as art objects. It is very rare an interpretation that respect their religious essence.

      The themes of measures of cultural heritage protection and the accountability of perpetrators of crimes against cultural heritage in armed conflict have been receiving growing attention in international fora and international scholarship. The applicable law for the protection of cultural heritage in times of conflict is the 1954 Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict and its two Protocols; however, the protection that this body of rules provides to intangible cultural heritage (as opposed to tangible cultural heritage) is questionable. This paper seeks to critically present the intersection of the 2003 Convention for the Safeguarding of the Intangible Cultural Heritage with other international legal regimes, especially the norms of the 1949 Geneva Conventions and their Additional Protocols and human rights law, with the aim of establishing that intangible cultural heritage enjoys legal protection in all phases of an armed conflict.

      In depicting the involvement of Japan with UNESCO activities and in its efforts to implement the 2003 Convention, the author firstly focuses on the National Commission for UNESCO’s role and working methods to offer, secondly, a framework about the origins of the legal framework of the ICH promoted by the country, since a pioneering draft law created in 1949 by the Committee for Education and Culture of the Upper House of the Japanese Diet to support the “highly valuable intangible cultural property that may become extinct without the protection of the state”. Afterwards, the chapter illustrates the protection of the ICH at the national level as the result of a legislative process starting in 1950s and 1970s, and identifying three types of intangible cultural heritage (i.e. Important intangible cultural property, Important intangible folk-cultural property and Selected preservation techniques) as per Japanese law, further explaining the criteria prepared for their designation and certification. Lastly, the author concentrates on the case study of the “Bunraku”, as an example of an ICH safeguarding, internationally recognised, and on the UNESCO ICH nomination process in Japan.

      The protection afforded to Indigenous cultural heritage at the international, national and state level is piecemeal, overly bureaucratised, unnecessarily vague, lacking in effective sanctions, and subject to the current Australian Federal government’s refusal to effectively acknowledge the unique place that Indigenous people, their traditional knowledge, and cultural heritage hold within Australian society. Australian State legislation in New South Wales, and Federal legislation is examined, and this paper ultimately suggests Indigenous cultural heritage requires sui generis legislative protection.

      L’UNESCO souhaite réaliser une évaluation des besoins avec la participation des communautés concernant la sauvegarde du patrimoine culturel immatériel (PCI) dans la province du Nord‐Kivu, en République démocratique du Congo (RDC), et ce dans un contexte de conflit de longue durée et de déplacements forcés de populations. L'objectif est de comprendre, d’une part, comment certains éléments du PCI sont affectés (transformation, adaptations, disparition, etc.) par les conflits et déplacements, mais également si et comment certains éléments peuvent favoriser la résilience des populations déplacées et des communautés d’accueil, ainsi que la cohésion sociale et la paix. Cette évaluation des besoins s’effectuera sur la base d’un état des lieux de la question à partir de sources secondaires, suivi d’une enquête auprès de plusieurs communautés au Nord‐Kivu. L’évaluation des besoins vise un double objectif à la fois national et global. Elle devrait permettre d’élaborer une action spécifique de sauvegarde du PCI pour le Nord‐Kivu, et ce dans le cadre de la Convention de l’UNESCO de 2003 pour la sauvegarde du patrimoine culturel immatériel (ci‐après Convention de 2003). D’autre part, l’activité s’inscrit dans un cadre plus général d’études de cas réalisées pour nourrir les réflexions du Comité intergouvernemental de sauvegarde du patrimoine culturel immatériel sur le PCI en situation d’urgence. L’activité est organisée par la Section du patrimoine culturel immatériel au siège de l’UNESCO en collaboration avec le Bureau de l’UNESCO à Kinshasa.

      L’activité proposée vise à réaliser une identification des besoins au niveau national et local avec la participation des communautés pour la sauvegarde du patrimoine culturel immatériel dans la région du Nord-Kivu, zone en conflit de longue date de la République démocratique du Congo. Dans le cadre de la Convention 2003, cette identification des besoins permettra d´élaborer un plan de sauvegarde sauvegarde du patrimoine culturel immatériel spécifique pour la région du Nord-Kivu. D’autre part, l’activité proposée s’inscrit dans un cadre plus général d’études et des réflexions du Comité intergouvernemental pour la sauvegarde du patrimoine culturel immatériel sur le patrimoine culturel immatériel en situation d’urgence (cf. décision 11.COM 15). L’activité se déroulera en quatre temps: (i) l’élaboration d’une étude préliminaire sur les déplacements forcés et du PCI au Nord-Kivu. (ii) l’organisation d’un atelier de formation-sensibilisation, qui aura pour objectif de formuler et valider la méthodologie d’enquête et le questionnaire prévus pour le travail de terrain, ainsi qu’assurer le consentement libre, préalable et éclairé des communautés impliquées. (iii) une enquête de terrain menée par l’équipe d’enquêteurs formée. (iv) l’élaboration d’un rapport d’identification des besoins basé sur les résultats de l’enquête de terrain et comprenant des recommandations pour des actions de sauvegarde du PCI. Cette activité est financée par le Fonds d’urgence de l’UNESCO pour le patrimoine et est mise en oeuvre par le Bureau de l’UNESCO à Kinshasa en collaboration avec la Section du patrimoine culturel immatériel basée au Siège de l’UNESCO.

    • Abstract:

      The report below presents the findings of a survey on the intangible cultural heritage (ICH) of displaced Syrians. It also provides recommendations that the international community and the national authorities might find useful in their efforts to safeguard living heritage and promote social cohesion. The survey was based on interviews with 60 displaced Syrians and some members of the host communities who shared their experiences about safeguarding their ICH. The responses illustrate the important role that ICH can play in coping with displacement and enhancing bonds between refugees and host communities. It also demonstrates the ways in which displaced people find ways to continue to transmit and recreate their ICH. The respondents spoke about three main ICH domains, as explained in more detail below. These included customs and traditions (‘adad wa taqalid’), traditional artistic expressions (fann/plur. funun), and craftsmanship (al-hiraf al-yadawiya). The interviews showed that ICH provides a sense of belonging, mitigates psychological, social and economic resilience, and, in many cases, helps mediate conflicts by fostering intercultural communication and mutual appreciation. However, more support is needed to ensure the continued transmission of ICH in the particular circumstances of displacement, which entails encountering a new context and host community.

      Although heritage and its preservation has been at the forefront of Omani policy for several decades, tourism to the country has been restricted, until recently, to small elite tour groups either taking advantage of the sun and sand or, in Dhofar, the cool and humid post monsoon landscapes. Pastoralist communities in the desert interior have been largely excluded from heritage tourism and tourist ventures with the exception of Disneyfied ‘Arabian nights’ camps on the edges of the most northerly desert sands of the Wahiba. Authenticity, and possession of intangible cultural heritage, for the most part have not been a part of tourism or, for that matter, herit- age policies. The growing popularity of desert tours, camel racing and sand dune ‘bashing’ programmes in the neighbouring United Arab Emirates, is, however, changing perceptions and practices in Oman. The desert land- scape and its intangible heritage are belatedly receiving some national and international attention. By focusing on notions of cosmopolitanism and tangible and intangible heritage, this paper will address the challenges that are emerging with regard to tourism, heritage and authenticity of the pas- toral groups in the Sultanate of Oman. It endeavours to frame the heritage debates and national policies of exclusion of pastoral groups within the context of international demands for increased and accessible tangible and intangible heritage tourism.

      The Australian Museum has one of the world’s largest and most significant Melanesian collections with particular strengths in cultural material from Vanuatu, Papua New Guinea and the Solomon Islands. One of the prime goals of the Australian Museum is to develop new ways of unlocking these collections. The aim is to provide increased access and engagement with the creator communities, in order to rejuvenate the traditional arts of creator communities, while at the same time documenting and preserving the intangible knowledge linked to the cultural material. As part of this initiative the Australian Museum has instigated a program whereby cultural leaders from Pacific Island Communities visit the collections to add their stories and take back relevant information and images. Two examples are described here. The first details visits by Chief Jerry Taki and Ms. Sophie Nemban from the island of Erromango in Vanuatu. The visits focused on the Erromangan men’s and women’s cultural material held at the museum. Several aspects of this long term project including the rejuvenation of traditional bark-cloth as well as the enrichment of intangible heritage information associated with the museum collections are described. The second example relates to the visit by Mr. Lawrence Foana’ota a cultural leader from the Solomon Islands and how this has led to a digital repatriation and community engagement project in the Solomon Islands.

      Nakamals play a significant role in the maintenance of kastom in Vanuatu, as well as having an important functional role in Disaster Risk Reduction in rural areas.Without better protection and recognition, the Intangible Cultural Heritage of the nakamal is at risk of being lost due to: • the proliferation of imported building materials and construction techniques; • a lack of heritage recognition; • the decimation of traditional building materials by Tropical Cyclone Pam; • the inability to grow new plantations due to the El Nino induced drought; • the resulting shortage of local building materials required to renovate or reconstruct them; • the resulting inability for building and renovation skills to be passed onto the next generation; • the very real potential that other cyclones might cross the region over the coming cyclone season, potentially causing further damage to the structures and impacting on the ability of the communities to repair them; and, • a lack of funding for communities to provide immediate protection to the existing damaged buildings. Without the Intangible Cultural Heritage of the nakamal, there is no tangible building, as the built form is dependent on the knowledge and skills retained within the communities. The loss of the Intangible Cultural Heritage of the nakamal will inevitably lead to its extinction, which would be a devastating loss for Vanuatu.Without the nakamal there is no place to house kastom; without kastom there is no place for the nakamal.This report highlights the urgent need of protection and recognition for the nakamal in Vanuatu.

      This article problematizes the process of heritage declaration using ethnographic research on the working class carnival produced each year in the historic city center of Puebla, México.       Analizamos las políticas culturales emprendidas recientemente en la provincia de Formosa, Argentina, respecto del patrimonio cultural inmaterial indígena y, en especial, de la música de los tobas o qom. Nuestra hipó- tesis es que el gobierno provincial ha tendido a instrumentalizar estratégicamente estas políticas culturales, para crear la imagen de una administración que ideológicamente adhiere a los discursos globalizados impuestos a las democracias (como el “multiculturalismo” y la “salvaguardia del patrimonio cultural”), y a su vez, para legitimar un imaginario provincial sobre el “ser formoseño” que, si bien se reconoce “pluricultural”, invisibiliza a los indígenas contemporáneos, enmascarando conflictos y desigualdades.

    • Abstract:

      A people’s intangible heritage is composed by the nonmaterial part of its culture: tales and narratives, games and songs, music and all the knowledge usually transmitted by oral or sound means, in traditional societies as well as in urban, westernized ones. This heritage is the basis where a human group funds its identity, its projects for the future, its memory, its history, its fears, its desires… When peoples lose this untouchable, fragile fragment of their culture –as it daily happens to aboriginal societies all around the world- they lose their reason for living, their past and their future… A library which wants to become “multicultural” should include this kind of materials –orality, music, folk games- as well as the people who still transmit them: narrators, musicians, artists… By recovering these parts of different cultures, the library will keep alive the human cultural diversity; it might use ancient traditional means for teaching and informing in order to transmit traditional and modern knowledge; it might consolidate vanishing identities and familiar / group bonds; and it might revitalize endangered idioms, since orality is mainly based in the perfect and creative use of mother languages… Oral tradition is based on memory, words, sound and improvisation. It is a living, ancient art, enjoyed by children and old people, literate and illiterate alike. Some of their expressions can be understood by everybody –no matter their race or nationality- and, in this way, they can work as channels for integration and mutual understanding within plural societies. The conference will present some basic ideas about the use of these valuable elements inside a “multicultural library”, using examples tested by the author in indigenous libraries in southern South America.

    • Abstract:

      Dans un environnement caractérisé par une extrême concurrence et les difficultés engendrées par les crises économiques et financières, redéfinir les fondements du développement des sociétés contemporaines s’impose avec urgence. La prise en compte de la dimension immatérielle, esthétique et éthique des produits et des procédés de fabrication, le travail d’excellence et de passion, le respect de l’environnement et de la diversité des pratiques locales, l’innovation permanente et la créativité peuvent-ils constituer les points de départ d’une nouvelle conception du développement qui se veut durable, notamment pour les pays européens ? Cet ouvrage explore, à partir d’une recherche inédite, le secteur des métiers d’art et son potentiel non seulement économique mais aussi culturel et social. Les perspectives de sauvegarde de ces métiers, souvent menacés, résident dans la conservation des outils, des lieux de fabrication et des objets créés, liant fonctions utilitaires et esthétiques. Toutefois, depuis l’adoption de la Convention UNESCO pour la sauvegarde du patrimoine culturel immatériel, le coeur de la sauvegarde se tourne vers leur dimension immatérielle : les savoir-faire. Au-delà de leur importance dans le secteur des métiers d’art, les savoir-faire sont reconnus, de plus en plus, comme facteurs essentiels à la créativité, à l’innovation et au développement durable.

      L'objectif de ce texte est d’étudier les savoir-faire liés aux métiers d’art en tant qu’éléments du patrimoine culturel immatériel et en tant que biens communs. En premier lieu seront présentées les notions de savoir-faire, de bien commun et de bien culturel commun. Cette introduction conceptuelle, élaborée à partir d’une analyse bibliographique et d’un travail de terrain, permettra de préciser la nature de ces éléments et leurs similitudes. Par conséquent, on se demandera : les savoir-faire liés aux métiers d’art sont-ils des biens communs ? Ensuite, si ces savoir-faire peuvent être considérés comme des biens communs, quelles seront les conséquences sur le plan de la gouvernance de ce patrimoine culturel immatériel ? Pour ce faire, on illustrera le cas de la pierre sèche en France et le rôle fondamental de la communauté dans la sauvegarde de ce patrimoine immatériel et matériel. Pour conclure, les principaux enjeux liés à une approche « bien commun » pour la sauvegarde du patrimoine culturel immatériel seront rappelés.

    • Abstract:

      Gardens result from the interlacing of nature and culture. This explains that their conservation might be concerned by three systems of norms for heritage conservation already promoted by UNESCO. These are the UNESCO Convention on the Protection of the Natural and Cultural World Heritage of 1972, the UNESCO Convention on Biological Diversity of 1992, and the UNESCO Convention for the Protection and Promotion of Cultural Diversity of 2005, which stresses the protection of cultural diversity through time and space, as well as the protection of intangible heritage, and which follows on the heels of the Convention for the Safeguarding of the Intangible Heritage (2003). Additionally, the Florence Charter, written in 1982 by ICOMOS, addressed gardens and garden preservation; because it was not issued by UNESCO, it lacked official clout. Until recently, the convention of 1972 was the unique reference for the whole architectural and garden heritage. However, since 2003, with the official acknowledgment of an interest in the intangible heritage of the human world, new questions are coming to the fore which should be discussed. Moreover, in these there are new questions regarding cultural assumptions of what constitutes heritage and how it should be preserved. This chapter will respond to these questions from cultural perspectives belonging to a few Asian cultures, as a reminder that Western cultural approaches may be unwillingly biased.

      Most Australian World Heritage sites inscribed for natural values under the Convention Concerning the Protection of the World Cultural and Natural Heritage also contain indigenous cultural heritage values. This article examines how effectively the Australian govemment can use the World Heritage Convention as a tool to protect intangible indigenous cultural heritage including cultural landscapes whether those values are recognised as being of Word Heritage value or not. It also examines the potential of the new Convention for the Safeguarding of the Intangible Cultural Heritage to protect indigenous cultural heritage values and discusses the pros and cons of Australia becoming a party to the new Intangible Heritage Convention. It will be argued that these two Conventions are intended to work together to provide a mechanism for effective identification, safeguarding, awareness, protection, and conservation of both tangible and intangible heritage.

      The proliferation of collective claims made in cultural and proprietary terms demands a critical understanding of the political economies of community construction in order to understand ownership as a process through which property-holders are constituted as social actors and as political agents. The legal and political conditions under which culturally self-defined communities emerge to make possessive legal claims include neoliberal governmentalities, environmental regimes, intellectual property and cultural policy initiatives, as well as indigenous rights discourses which converge in many parts of the world to encourage collective needs and aspirations to be expressed in terms of community property rights. Exploring ethnographic examples from Latin America, it becomes clear that the global conditions under which collective holders of culturalised property claims have assumed greater agency and voice are diverse and their objectives contradictory. The communities empowered via recognition of their traditional knowledge, their intangible cultural heritage, or their traditional cultural expressions are situated at the intersections of old regimes of power and attachment, emerging forms of governmentality, and new imaginaries of social justice.

      In post-apartheid South Africa, the traditional understandings of museums and heritage have been challenged in terms of how meaning making, heritage construction, and knowledge production were conducted in the colonial past. In a series of processes of transformation, new approaches to museum action and heritage management have begun to take shape and develop in South Africa. Central to all of this have been the processes of policy formulation and new legislation that have provided the impetus for change. The aim of this article is to briefly chart some of these processes and the subsequent legislation that have begun to affect the ways in which South African heritage and museums are being reconfigured in a postcolonial and post-apartheid era. This policy formulation and the new legislation have focused on extending what is considered to be heritage by including intangible cultural heritage. It has also looked at empowering local communities, with an emphasis on sustainable development.

      Le tourisme culturel est présenté par les acteurs politiques et institutionnels comme un tourisme qui serait à la fois bon pour l’économie des territoires, salvateur pour les sites culturels en mal de visiteurs, respectueux des populations et de leur environnement, constructif pour les touristes. L’objectif de cet article est double : comprendre comment la doctrine du tourisme culturel s’est constituée comme l’idéologie positive du tourisme et tenter d’en analyser les enjeux. Dans ce but, on propose une analyse des politiques et des discours de l’Unesco, du Conseil de l’Europe, des ministères de la Culture et du Tourisme français et de quelques collectivités locales françaises en région Centre. Quelques exemples permettront de développer l’idée selon laquelle le « tourisme culturel » est devenu un enjeu de pouvoir et un outil politique et identitaire, même – surtout ? – lorsqu’il n’est pas « rentable » d’un point de vue économique.

      Heritage has traditionally been associated with material objects, but recent conventions have emphasized the significance of intangible culture heritage. This article advocates a holistic approach towards the concept and considers key challenges for Europe's heritage at the beginning of the twenty-first century. Reflecting on the notion of 'European', it considers the question of how one defines European heritage and which European heritage is to be protected. It explores links between national and European conceptions of identity and heritage and queries issues of ownership, language and representation. A number of ethical issues are raised - such as the role of women in the transmission of heritage and the implications of information technology for copywriting traditional practices. The author also asks how one ensures that the process of globalisation facilitates rather than eliminates local cultural heritages? How does one enhance the local so that it becomes glocal and not obsolete?

      Following debate surrounding nominations of food practices for the United Nations Educational, Scientific and Cultural Organization’s lists of intangible cultural heritage (ICH), 10 years after the entry into force of the Convention for the Safeguarding of Intangible Cultural Heritage, we observe that the ICH lists count a growing number of food-related heritage elements. Yet food, or even gastronomy, as a cultural domain within ICH has yet to be officially recognized. However, given the trade policies arising from the new globalization, which subject peoples and the planet to imported, globalized, and standardized models and which generate an impoverishment of agricultures and food cultures, major geo-economic issues will play out around this recognition. Thus, along with identification labels of quality and origin that protect certain products and know-how from counterfeiting, other forms of protection could be put into place for the benefit of intangible food heritage inscribed on national lists and of the products, goods, services, industries, and cultural spaces in which they are embedded. From the perspective of safeguarding cultural diversity, which any inscription of ICH should lead to, these protections could operate not only through the cultural policies within safeguarding plans but also through the creation of a new binding legal instrument—“the heritage brand”—which could become an important facet of international trade law.

      A preservação do patrimônio imaterial é uma política de introdução recente no plano internacional e são notáveis a rapidez e a firmeza com que ela vem se desenvolvendo no Brasil. A consistência e velocidade de sua breve trajetória devem-se a vários fatores. Inicialmente, aos investimentos políticos e intelectuais realizados pelos dirigentes e técnicos do Iphan, principalmente desde 1997, quando da realização do seminário Patrimônio imaterial: estratégias e formas de proteção, em Fortaleza, Ceará. Essa atividade pode ser considerada o marco inicial desse processo, uma vez que deu origem aos trabalhos que culminaram com a aprovação e promulgação do Decreto n.° 8551, de 2000, que institui o registro de bens imateriais e dá outras providências. Além disso, aos resultados das pesquisas antropológicas, históricas e de folclore que vêm sendo realizadas sobre o país sistematicamente, sobretudo nas universidades, há mais de um século. Elas ancoram as ações iniciadas e em curso por oferecerem um amplo panorama sobre a realidade cultural brasileira e sugerir métodos e procedimentos para identificar e compreender os complexos processos envolvidos. O estabelecimento da metodologia de inventário de referências culturais, que sistematizou e deu consistência aos procedimentos de identificação que antecedem o registro e demais atividades de salvaguarda, foi desenvolvido a partir de métodos etnográficos, por consultoria especializada de natureza acadêmica.1 A colaboração com o meio intelectual tem sido de importância crucial também para a elaboração de outros procedimentos de trabalho e de projetos e a formulação de programas. As ações empreendidas pelo Governo brasileiro nessa área respondem a uma agenda interna emergente e, ao mesmo tempo, incluem uma problemática que vem se configurando no âmbito do que se poderia designar como uma esfera pública cultural global, atualmente em plena consolidação. A Unesco ocupa, sem dúvida, posição de destaque na estruturação dessa arena supra-nacional, ao lado de organismos multilaterais como a OMPI2 e a OIT3. Esses espaços institucionais somam-se às redes regionais, como a CPLP4 e o Mercosul, e às que congregam número significativo de instituições não-governamentais. A pauta que se consolida mundialmente inclui, entre outros, a crítica aos revezes da globalização, assim como a construção de agendas positivas de fortalecimento da paz e de combate à pobreza e à exclusão social. Pelo menos dois temas de política cultural perpassam essas esferas. Um é o do patrimônio

      It is remarkable how often we consider certain constructs in other peoples’ worldview to be «myths», while in our own case we regard equally arbitrary assumptions as inherent to the nature of things. As every anthropologist knows, one’s most cherished cultural assumptions tend to remain implicit; in other words, worldview is largely unconscious. This book explores the possibility of plumbing obscure aspects of one’s own culture in order to assess what some might call (regarding other cultures) the mythic underpinnings of worldview. Seven explorations in folklore and ethnography exhume a conceptual heritage that still influences perception, albeit in unconscious ways. This archeology of intangible heritage provides the sort of break in intellectual routine that allows us to look anew at familiar things.

      La région du Golfe arabo-persique (illustrée ici par les émirats Arabes Unis) constitue un observatoire d’étude récent en matière de politiques culturelles et de l’emprise grandissante de l’économie de marché sur le patrimoine immatériel. Cette région présente en effet une grande diversité de pratiques musicales traditionnelles communautaires (bédouin, baloutche, zandj… etc.), qui sont encore pratiquées dans la sphère sociale tout en constituant un capital symbolique incontournable dans le développement économique. Depuis 1971 – date de la création de la fédération des émirats Arabe Unis –, les traditions musicales connaissent à des degrés divers des transformations dans leur cadre de performance comme dans leur modalité d’exécution. Un phénomène qui résulte en partie d’un mécanisme de patrimonialisation visant à promouvoir une unité culturelle nationale, Aujourd’hui, suite à la ratification de la convention de l’UNESCO pour les PCI par les EAU et à l’émergence d’un marché culturel local aux spécificités urbaines, le secteur entrepreneurial capte et transforme à son tour ces musiques patrimonialisées au moyen de processus de production et de diffusion inhérents à la sphère économique L’objet de cette intervention est de présenter les grandes phases de la politique culturelle des EAU et sa mutation actuelle en mettant en évidence la logique qui sous-tend les transformations relevées dans les traditions musicales locales.

      The increasing sensibility regarding intangible cultural heritage provides momentum to better define a legal framework for the protection of these peculiar immaterial goods. This article questions whether the current intellectual property rights (IPRs) regime represents an adequate model of protection vis-à-vis intangible cultural heritage. A plethora of caveats must be taken into consideration, starting with the desirability of the commodification of intangible cultural heritage, i.e. its exploitation and commercialization through the IPRs regime, but also including the outlining of the legal instruments needed for guaranteeing adequate advantages for the countries and communities representing the sources of origin of the intangible goods. After framing the crucial issues detected in literature regarding intangible cultural heritage, the article investigates the ways in which the actual IPRs regime grants protection to intangible goods. Our evaluation supports the idea that, without a many-faceted remodeling, current intellectual property laws represent an unsatisfactory mechanism for protecting intangible cultural heritage. This inadequacy is rooted in the inefficacy of IPRs under the patent and copyright regimes in ensuring the protection of cultural heritage, while also falling short of fostering an appropriate comprehensive social policy.

      This paper interrogates the emphasis on devising regimes for protection of Indigenous knowledge, based on narrowly defined concepts of property, especially intellectual property in legislative and policy discussions and debates and programs of work on Indigenous knowledge. Commenting on the classificatory and typological tendencies of legislative protection regimes, the paper argues for a shift from this emphasis on protection, toward the creation of a space for engagement between Indigenous, and other knowledge traditions, wherein concepts of dialogue, negotiation and agreement-making can occur. The paper supports its argument by reviewing selected legal instruments such as the 2003 UNESCO Convention on the Safeguarding of the Intangible Heritage, and drawing on some of the author's experience working with Aboriginal people in the Kimberley.

    • Abstract:

      Historians study the living and the dead. If we can identify the rights of the living and their responsibilities to the dead, we may be able to formulate a solid ethical infrastructure for historians. A short and generally accepted answer to the question of what the rights of the living are can be found in the Universal Declaration of Human Rights. The central idea of human rights is that the living possess dignity and therefore deserve respect. In addition, the living believe that the dead also have dignity and thus deserve respect too. When human beings die, I argue, some human traces survive and mark the dead with symbolic value. The dead are less than human beings, but still reminiscent of them, and they are more than bodies or objects. This invites us to speak about the dead in a language of posthumous dignity and respect, and about the living, therefore, as having some definable core responsibilities to the dead. I argue further that these responsibilities are universal. In a Declaration of the Responsibilities of Present Generations toward Past Generations, then, I attempt to cover the whole area. I identify and comment on four body- and property-related responsibilities (body, funeral, burial, and will), three personality-related responsibilities (identity, image, and speech), one general responsibility (heritage), and two consequential rights (memory and history). I then discuss modalities of non-compliance, identifying more than forty types of failures to fulfill responsibilities toward past generations. I conclude that the cardinal principle of any code of ethics for historians should be to respect the dignity of the living and the dead whom they study.

      This chapter presents a preliminary description of two different pieces of research, the first in Curitiba in Brazil and the other in Las Palmas de Gran Canaria, Spain. The first was designed to test the efficiency of guided cultural routes as tools for teaching high school students to value their built heritage. The second is a much more ambitious project, which examines the role of intangible heritage and its potential use as a tool in schools, museums, and cultural institutions, aimed at making the local community revalue its identity. This should also stimulate greater participation in the formulation of cultural tourism policies directed at promoting sustainable, community-based development.

      This chapter examines how a masked performance is subjected to a variety of regimes of value that impose contradictory conditions on its performance, and explore show the recontextualisation of ritual as 'heritage' affects its performance. One of the aims of the UNESCO policy is to identify, classify, and authorise 'intangible heritage' and make a contribution toward its conservation. Nothing is said about the aspects of masquerading that are incompatible with the modern state. Inverting argument about the loss of aura in the age of mechanical reproduction, it shows that recontextualisation through new regimes of value opens up possibilities for re-enchanted performance. The attempts at regulation of the Kankurang performance are to be understood as attempts at conservation of the masked performance. The UNESCO application for Masterpiece status for the Kankurang and Manding initiatory rite clearly negotiates between conservation and commodification, sacralisation and visualisation.

      En 2005, la cérémonie du kankurang et les rites d’initiation mandingues sont proclamés chefs-d’œuvre du patrimoine oral et immatériel par l’Unesco. Il s’agit ici d’analyser la façon dont la patrimonialisation de la cérémonie a progressivement conduit à sa marchandisation. Cet article, qui rejette l’idée d’une culture « originale », s’inscrit dans les réflexions actuelles sur la marchandisation du patrimoine selon lesquelles culture et marchandise ne s’opposent pas mais sont au contraire mutuellement constitutives l’une de l’autre. Selon ce point de vue, on considère que l’objectification du patrimoine, loin de freiner le changement culturel, y participe pleinement. En se focalisant sur la façon dont la cérémonie est objectifiée par le regard des spectateurs, l’article montre que les participants à la cérémonie eux-mêmes ont adopté un autre régime visuel afin d’obtenir la reconnaissance de leur art. Cette étude de cas espère remettre en question des lectures trop pessimistes de la marchandisation qui présupposent que toute transformation culturelle ne peut aboutir qu’à la perte.

      Struggles over the meaning of the past are common in postcolonial states. State cultural heritage programs build monuments to reinforce in nation building efforts—often supported by international organizations and tourist dollars. These efforts often ignore the other, often more troubling memories preserved by local communities—markers of colonial oppression, cultural genocide, and ethnic identity. Yet, as the contributors to this volume note, questions of memory, heritage, identity and conservation are interwoven at the local, ethnic, national and global level and cannot be easily disentangled. In a fascinating series of cases from West Africa, anthropologists, archaeologists and art historians show how memory and heritage play out in a variety of postcolonial contexts. Settings range from televised ritual performances in Mali to monument conservation in Djenne and slavery memorials in Ghana.
