Ce recueil regroupe 41 textes de communications présentés lors du colloque « Le patrimoine religieux du Québec : de l’objet cultuel à l’objet culturel « , tenu à Québec les 12, 13 et 14 novembre 2004. Quelque 450 personnes, praticiens, chercheurs ou passionnés du patrimoine religieux s’y réunissaient pour réfléchir sur les enjeux fondamentaux de ce patrimoine menacé, entre autres, par une diminution marquée de la pratique religieuse et par le vieillissement des propriétaires et gardiens traditionnels de ces biens matériels et immatériels. Cette vaste mobilisation démontre l’attachement profond des Québécois à leur patrimoine religieux, vecteur d’affirmation et de fierté collective, qu’ils désirent conserver, valoriser et transmettre. Dans ce contexte, la « patrimonialisation », c’est-à-dire la conversion de ces biens d’Église, à vocation cultuelle, en biens culturels destinés à la société civile, semble être le seul moyen de sauvegarder cet héritage. Or cette nécessaire relation entre le cultuel et le culturel est plus qu’un lieu de passage, c’est un « espace de contact », un champ relationnel qui met en oeuvre des négociations, des stratégies d’appropriation et des postures de résistance. Par les échanges et les mélanges qu’il engendre, cet espace devient « un entre-lieu » de la culture, un espace de création où se réalisent de nouveaux consensus, de nouvelles pratiques culturelles et de nouvelles identités. Ainsi, loin de témoigner de la mort du patrimoine religieux ou d’une mutation obligée, le colloque a exposé de nombreux « entre-lieux » du cultuel et du culturel, où tout devient possible.

“Life Beyond Tourism” is a project for a new style of tourism. Currently being tested in Florence, it can be experienced, measured, criticized and improved on. It's a flower whose petals are the “encounters”, “communication”, “knowledge”, “conservation” and “economy” (Figure 1). It's a new vision of tourism, not consumer-driven and not standardized but strategically designed: - to safeguard “spirit of place”; - to communicate “spirit of place”; - to encourage visitors of all cultural levels to truly familiarize with their destination; - to promote acquaintance and friendship among tourists from different countries; - to foster a sense of respect in a non-standardized context. In “Life Beyond Tourism”: - people working in the tourist business give their work added value by not only providing a service but also by being aware that they are working to promote peace; - tourists become potential heralds of peace; - sites reaffirm their identity as “laboratories” for familiarization with, and for the enhancement and communication of “spirit of place”.

Le patrimoine culturel immatériel représente aujourd’hui un enjeu majeur dans les manières de penser et de pratiquer le patrimoine en Amérique du Nord francophone et ailleurs dans le monde. Il tend à renouveler le mouvement du patrimoine ethnologique et à s’imposer comme référence incontournable aux praticiens et penseurs de tous les patrimoines. Il trouble les classifications établies et les cadres de pensée de la culture administrée. Il provoque des réaménagements dans les structures gouvernementales de gestion et de direction, et dans les programmes de formation universitaire qui doivent désormais en tenir compte. Il bouscule les règles canoniques de la conservation et participe largement à la définition des nouvelles politiques patrimoniales. Il renouvelle les débats sur le droit d’auteur, les droits humains, les pratiques muséologiques et le patrimoine matériel. Il invite à une réflexion de fond sur le sens du patrimoine lui-même.

Resumen:

This article aims to show that intangible cultural heritage is an important tool for rebuilding the town of Jacmel, and the whole of Haiti. The authors suggest reinstating the Jacmel Carnival as soon as possible, because it was one of the town’s economic and social drivers before the earthquake. Income from the Carnival and other events could gradually be reinvested in rebuilding tangible heritage. The authors also highlight the creation of an inventory of intangible heritage. This is seen not simply as an archive collection but as a dynamic tool for managing, promoting, transmitting and revitalizing the region’s heritage and society.

Cette étude présente les résultats d’un projet pilote destiné à mettre sur pied une méthodologie de sauvegarde et de mise en valeur du patrimoine immatériel religieux du Québec, aujourd’hui menacé par l’effondrement de la pratique religieuse, le vieillissement prononcé des communautés religieuses, la fermeture des paroisses et des églises, et la vente forcée d’objets sacrés. À partir de l’étude de huit communautés, nous proposons des méthodes virtuelles novatrices d’inventorisation qui, à l’aide des nouvelles technologies de l’information et de la communication, visent à la fois à conserver et à communiquer efficacement ce patrimoine. La cueillette et la saisie audiovisuelles des récits de lieux, d’objets, de pratiques et de vie permettent de capter les divers aspects de ce patrimoine, de le rendre plus visible et palpable, de bien contextualiser ses usages sociaux et d’intégrer ses dimensions matérielles et immatérielles. Grâce à la grille des pratiques culturelles de Jean Du Berger, nous avons élaboré un système de classement du patrimoine immatériel religieux qui est opératoire dans toutes les communautés religieuses étudiées (catholique, protestante, juive, orthodoxe et amérindienne). Cette première grille de classification pourrait être utilisée dans d’autres cultures et dans d’autres pays en raison de son caractère souple, polyvalent, efficace et universel. Le projet pilote nous a également permis de développer une approche participative pour mettre en valeur ce patrimoine directement sur le terrain en collaboration avec les communautés par des actions culturelles diverses : des sites Web, des expositions muséales, des productions multimédia de DVD, des modules pédagogiques et des publications d’articles et de livres. Une fois numérisé, le patrimoine immatériel religieux s’offre à des adaptations et à des applications diverses, à des appropriations et à des réappropriations par de nombreux acteurs sociaux. La base de données virtuelle devient elle-même un engin d’hybridation et de création sans limites.

Cultural heritage is of immense importance in the construction of identities and, therefore, the behaviour of society. It is argued here that traditional approaches, reflected in British government legislation and policy, ignore elements integral to community perceptions of cultural heritage. The current framework of heritage management also hinders practitioners from exploring, conserving, presenting and challenging these constructs This paper calls for the development of integrated and inclusive heritage‐management practice and a recognition of the contribution of recent research into constructs of cultural heritage It is argued that there is a need to investigate the opportunities for, and feasibility of, developing more integrated approaches that reflect the diverse and joined‐up nature of cultural heritage.

Current debates about urban sustainability tend to focus on technical issues, such as carbon emissions, energy consumption and waste management, or on the economic aspects of urban regeneration and growth. Increasingly, however, governments recognise the contribution that built cultural heritage makes to the social well-being of different groups living within increasingly cosmopolitan towns and cities. Heritage is seen as a major component of quality of life, but the two main methods of identifying and protecting built heritage – the listing of individual monuments and buildings and designation of conservation areas – are unable to deal with less tangible features of townscape, such as street patterns. Yet it is often precisely these features that give a city its unique character and provide the sense of belonging that lies at the core of cultural identity. The purpose of this paper, therefore, is to examine the role that built cultural heritage can play within sustainable urban development.The paper considers changing definitions of built heritage before outlining the broad contribution it can make to sustainable urban development. The paper then considers how the built environment contributes to the satisfaction of human needs by providing symbolic meanings that bind cultural groups and communities across generations. Results from the development and application of a novel survey method, designed to assess different people's perceptions of and attitudes to urban historical areas, are presented before describing a case study of recent urban development in Belfast that highlights the problems of intangible heritage. The paper concludes with a brief discussion of shortcomings of existing approaches to urban regeneration and suggests how these might be overcome through a greater understanding of how people interact with the urban environment and its heritage.

In the absence of an international agreement on the protection of intangible cultural heritage (hereinafter: ICH)1 from worldwide misappropriation, three approaches to protection have developed. A first approach consists of what can be described as semi-legal protection, namely in taking extrajudicial measures in order to settle the dispute out-of-court. This approach was followed in a series of recent cases, which include the appropriation of Māori language and imagery by multinational companies as well as the misappropriation of traditional songs by certain rock groups all over the world. A second approach to protecting ICH universally consists in the so-called instances of positive protection, namely in claiming before the competent administrative or judicial authorities the protection of derivates: patents over inventions based on traditional knowledge associated with genetic resources, as well as copyrights over works created by a particular author in developing the folklore further, and other intellectual property rights (hereinafter IPRs), which may provide some form of protection to ICH, such as trade secrets, collective trademarks, and geographical indications. A third approach to protecting ICH universally consists of so-called instances of defensive protection, namely petitioning the competent administrative and judicial authorities to refuse to grant or to revoke IPRs that are granted to persons not belonging to the original indigenous communities and that relate to the traditional knowledge of those communities.

Resumen:

Values, norms and rules related to gender are diverse among societies, communities and groups. All intangible cultural heritage expressions carry and transmit knowledge and norms related to the roles and relationships between and within gender groups in a given community. In such a way, intangible cultural heritage is a privileged context for shaping genderroles and identities and transmitting them. Intangible cultural heritage and the construction of one’s gender identity are therefore inseparable.

Resumen:

The Convention for the Safeguarding of the Intangible Cultural Heritage recognizes the ‘importance of the intangible cultural heritage as a mainspring of cultural diversity and a guarantee of sustainable development’. The 2030 Agenda for Sustainable Development constitutes a plan of action addressing the three dimensions – economic, social and environmental – of sustainable development through 17 Sustainable Development Goals as highly interdependent spheres of action that inform development pathways at all levels, and respecting the three fundamental principles of human rights, equality, and sustainability. Intangible cultural heritage can effectively contribute to sustainable development along each of its three dimensions, as well as to the requirement of peace and security as fundamental prerequisites for sustainable development. How can the place of intangible cultural heritage in sustainable development best be understood so that its contributions can be recognized and fully realized?

Resumen:

The purpose of this paper is to present and discuss four approaches which support actions in favor of endangered language preservation and maintenance. Preservation, on the one hand, refers to the process of documenting and storing information which can later on be accessed by the public; whereas maintenance, on the other, implies a support for the users of the language to prevent its disappearance by encouraging its use. Each of the approaches is assessed on its priority in one or the other form of language protection, drawing on their justifications and main goals. Finally, conclusions are brought forth regarding the potential uses of the different approaches.

The Basque Country has been the locus of great interest in the preservation of rural communities as well as Basque language revitalization. To date, however, these projects have evolved quite separately from one another, both in theoretical frameworks and in practice. Our paper takes the case of “Zerain.com,” the website name for a project created by residents in the rural town of Zerain (pop. 250). We examine the way the notion of cultural landscape has been defined and implemented in ways that emphasize sustainability and active participation. While preserving Basque, the everyday language of local residents, was never an explicit aim of this project, we argue that the framework of cultural landscape, and the commitments to sustainable development and fostering community cohesion, offer a promising model that can address some of the thorniest issues that currently face the language preservation movement: promoting natural contexts for language use and ensuring intergenerational transmission.

Although traditional medicine constitutes a component part of the identity of the cultural communities concerned, this form of intangible cultural heritage is vulnerable in a globalizing world where little place is left for the protection of belief systems. While much has been written on traditional knowledge and IP rights, less scholarly attention has focused on the cultural dimension of traditional medicine. Further, no solution has been reached on the best way to ensure its protection. This contribution attempts to establish a linkage between different sectors of international law, addressing the complex interplay between traditional medicine, intended as a special form of intangible cultural heritage, and international knowledge governance. While the TRIPS Agreement adopts only proprietary approaches to knowledge governance, it has been questioned whether, in the case of pharmaceuticals, other non-proprietary approaches would be preferable. Different approaches will be put forward and the Draft Treaty on Medical Research and Development will be considered. This would provide a better framework for safeguarding and diffusing traditional medicine. Practical significance Protecting and promoting traditional medicine may help curing diseases spread all over the world. Thus, beyond its cultural aspects, the practical importance of traditional medicine lies in its capacity to promote the right to health and human dignity.

Esta investigación presenta un estado del arte sobre las prácticas de creación artística en seis municipios del Urabá antioqueño. Preguntarse por la invisibilidad del artista creador en el contexto de esta zona obliga a revisar, de sosla yo, pormenores sociohistóricos de una subregión estratégica en la geografía colombiana cuyas dinámicas económicas, etnográficas y culturales actuales han emergido de la lucha constante en y por un territorio vasto y provisto de grandes riquezas naturales. Con aproximadamente el 50\% de población afro-descendiente, el 15\% de población indígena y el 35\% de población mestiza, la subregión ha forjado un interesante panorama pluricultural privilegiado en expresiones artísticas que se nutren de un sinnúmero de tradiciones y costumbres propias de los grupos humanos que allí convergen; expresiones y prácticas de las cuales muchos de sus creadores no están aún identificados, reconocidos o visibilizados, asunto de competencia de las políticas públicas culturales del Estado colombiano.

The policies of the United Nations Educational, Scientific and Cultural Organization (UNESCO) related to heritage preservation and promotion have been spreading worldwide for the past few decades. This ethnographically focused paper examines two UNESCO devices, the Crafts Prize and the Awards of Excellence for Handicrafts, as they apply to the contemporary Laotian textiles scene. It questions in particular the uses and values locally assigned to these international certifications of excellence and their mobilisation in the commoditisation of fabrics. On a larger scale, it considers what those devices reveal and entail regarding a 'traditional' handicraft that is, from now on, entangled between trade and the 'politics of culture'.

As culture and creativity become an increasing driving force in the international marketplace, it is essential to measure their impact not only on the economy but also on society at large. UNESCO has always been at the forefront of addressing the dual cultural and economic nature of cultural goods and services, working on both the theory and the practice. The Organization’s Institute of Statistics (UIS) is currently seeking to redefine international data collection standards for the culture and creative sector so that they take into account the needs and specificities of the developing world. Providing an overview of the main approaches to assessing the economic and social importance of culture, this paper highlights the numerous limitations in current statistical information. It also includes a series of proposals based on the pragmatic approach currently being developed at UIS.

The relationship between tangible heritage and tourism is a delicate issue due to the commercial excrescences of tourism which often endanger the preservation of historical sites or buildings. This is even more so with the relationship between intangible heritage and tourism, as traditions and social practices are extremely vulnerable because of their immaterial nature. Hence, the key question is: How can sustainable forms of tourism be developed in order to respect the integrity of the intangible heritage? As tourism is often seen as a threat to cultural diversity, UNESCO is hesitant to invoke the help of the tourism industry for the preservation of traditions. At the same time, tourism is considered indispensable because it brings in revenues that can be used for the safeguarding of cultures. Moreover, tourism could strengthen local people’s self-respect by attracting new markets of visitors interested in their traditions. This chapter argues that cultural tourism can contribute to the sustainable preservation of intangible heritage, but that warrants are necessary to realize this objective. That is why various policy guidelines are proposed to counter the risk of commodification. Provided that the assistance and the collaboration of communities who still practice living traditions are guaranteed, it is possible to develop successful projects from which both tourism and the intangible heritage can profit

The author stresses the high respect that the VietnamMuseum of Ethnology (VME) has for cultural diversity, asseen in its approaches to the following three areas: people,space, and time. The VME has given priority first andforemost to the representation of everyday life ? problems,stories, and concerns of peoples and of ethnic communities. The Museum's role as a research and educationalinstitution, as well as a body that appreciates and supportsthe intangible value of crafts are shown in two researchcase studies: learning to make pottery in the classroom forchildren, and giving voices to craft artisans in a photovoiceproject. The author also addresses current challenges ofthe VME, especially as it expands its research and displaypolicies to include the cultures and daily life of ethnicpeoples in other Southeast Asian Countries.

Resumen:

The view of several countries that intangible cultural heritage should have a position equal to monuments and sites can be seen as the major philosophy behind the eventual adoption of the Convention for the Safeguarding of Intangible Cultural Heritage in 2003 (hereinafter ICH Convention). However, a deeper analysis of the events and documents leading up to the ICH Convention reveals that the ICH Convention has a much broader philosophical basis. These broader philosophies focus on the content of the legal instrument, rather than on the choice of form of the legal instrument. This paper will argue that these content influencing philosophies behind the ICH Convention are community empowerment , to which sustainable development in all its aspects belongs, and the assurance of cultural diversity. For each of these philosophies, the paper will further describe how these philosophies have been reflected in the ICH Convention.

This chapter is structured as follows. Section 2 will introduce that the debate on GIs and ICH has mainly two opposing views on the role GIs can play for ICH. By unveiling the scope of the new Japanese GI Act, the section will show that part of the debate has become obsolete because, in reality, GIs could sometimes overlap with ICH. Section 3 will describe in detail the conceptualization of the new Japanese GI Act. This will pave the way for further analysis in Section 4 of the perils and promises that the extension of the GI Act has on ICH. In conclusion, Section 5 will hold that although the GI Act extends to ICH, holders of ICH should still be careful when they seek to register products that incorporate their ICH as part of the GI.

Intangible heritage has become a discourse both in the institutionalised heritage domain and in the academic world. This article dismantles the concept, deconstructs existing mythologies, and illuminates some of the core issues which have given rise to the current intricacies and dissonance. By using examples from Ndebele earthen architecture, such as the role of memory in the history of house form, spatial orientation in settlement, the role of gender in space and the intangibility of mural art, it is possible to gain insight into the web that weaves tangible and intangible heritage into a cohesive concept.

The aim of this work is to analyse the evolution of the concept of cultural heritage in West European states. In the last decades of the 20th century, the term “heritage” was characterised by expansion and semantic transfer, resulting in a generalisation of the use of this word, frequently used in the place of another, such as, monument and cultural property. However, all these terms are not able to cover the same semantic field. Starting by the reflection on the semantic evolution of the notion of cultural heritage in France, we approach to the international definition of heritage given by the directives, charters and international resolutions in order to define a global outline of the meaning of heritage that is not just limited to a particular national dimension. From a purely normative approach, one went to a less restrictive approach, one based on the capacity of the object to arouse certain values that led the society in question to consider it as heritage and therefore, to a further step in which heritage is no longer defined on the basis of its material aspect. This development has also made it possible to recognise intangible cultural heritage, which was ignored for a long time, as heritage to be protected and safeguarded.

While a precise forecast for the next decades is clearly impossible, some major challenges that need to be addressed in the next 10-20 years can be identified. Technologically there will be a shift from Information and Communication Technologies (ICT) to Universal Convergence Technologies (UCT). In the cultural realm, these challenges include problems of repositories, the changing scope of cultural heritage; new links between national, regional and local; between culture, knowledge and scholarship; approaches to intellectual property and to models of culture. Five dangers are outlined, namely, over-zealous commercialism; anti-technology among scholars, anti-universal narratives; forgetting the past and a systematic destruction of memory. The need for a permanent E-Culture Net is outlined which would a) address these challenges; b) develop critical methods; c) create new models of culture that transcend Euro-Centric visions and d) focus on a Distributed European Electronic Resource (DEER). The American vision of the Internet remains focusses largely on uni-lingual e-commerce. By contrast, the European vision, through its links with tourism, clearly has financial dimensions, and at the same time is developing a multi-lingual approach to cultural heritage that includes historical and cultural dimensions. This vision extends beyond culture to new definitions of knowledge. While the rhetoric of the day may focus on profit schedules for the next quarter, it is important to recall that major changes in new media have much longer cycles entailing decades and even centuries before their full effects are appreciated.

La notion de patrimoine peut prendre des formes trés diverses mais est toujours un construit social, résultat d'un processus de patrimonialisation. Ce processus est, d'un territoire à l'autre, trés varié. En particulier, les pouvoirs publics y jouent un rôle essentiel de coordination et d'arbitrage. A l'issue de ce processus, le patrimoine peut être un facteur important de développement local. Cet apport varie selon la géographie et l'histoire du territoire considéré. Mais, dans tous les cas, la valorisation économique du patrimoine suppose de mobiliser les ressources humaines qui lui sont liées et de diversifier ses modes de valorisation. Pour être durable, celle-ct suppose une bonne intégration des activités directement liées au patrimoine et des autres activités productives du territoire.

The work on Social Memory, focused on the biographic method and the paths of immaterial Heritage, are the fabric that we have chosen to substantiate the idea of museum. The social dimensions of memory, its construction and representation, are the thickness of the exhibition fabric. The specificity of museological work in contemporary times resembles a fine lace, a meticulous weaving of threads that flow from time, admirable lace, painstaking and complex, created with many needles, made up of hollow spots and stitches (of memories and things forgotten). Repetitions and symmetries are the pace that perpetuates it, the rhythmic grammar that gives it body. A fluid body, a single piece, circumstantial. It is always possible to create new patterns, new compositions, with the same threads. Accurately made, properly made, this lace of memories and things forgotten is always an extraordinary creation, a web of wonder that expands fantasy, generates value and feeds the endless reserve of the community’s knowledge, values and beliefs.

This note seeks to examine the relationship between existential intangible tourism and personal identity. Due to the impacts of globalization, tourism faces a new paradigm of increasing social complexity and the recent impotence of traditional boundaries. In such an environment, the past liaison between identity and local place vanishes. The discussion indicates that intangible heritage tourism can provide a source of identity separate from local places, becoming in effect an “existential tourism”. In this paper, Japanese flamenco tourism is used to shed light on the theme in general.

La noción de patrimonio cultural inmaterial ha sido recibida de manera entusiasta por los Estados miembros de la UNESCO, entre ellos México. Sin embargo, existen muy pocos análisis críticos sobre los diversos fenómenos sociales, económicos y políticos detrás de la patrimonialización de las prácticas culturales. La nueva conceptualización del patrimonio por parte de las instituciones culturales está heredando los vicios de la conceptualización tradicional, entre los que se encuentra la visión esencialista del patrimonio, la apropiación material y simbólica de éste por parte de los grupos hegemónicos, el énfasis en lo grandioso y espectacular, y la búsqueda por la conservación de la autenticidad, definida ésta desde ópticas externas a las de los sujetos que construyen dicho patrimonio. A pesar de los diversos lineamientos de la UNESCO, los procesos de declaratoriay difusión de las expresiones culturales con frecuencia conllevan el riesgo de folclorización y de la pérdida o deslocalización de los contenidos y significados culturales, aunque también abren nuevos espacios y posibilidades para los agentes sociales vinculados a dichas expresiones.

It is necessary to promote and enhance African languages as intangible cultural heritage. This heritage needs conservation and management in the form of language planning and policy making that would contribute towards the restoration of the indigenous speakers’ humanity, identity and culture. Our indigenous languages seek to focus on African philosophy, aesthetics, art, performing arts, politics, sociology, sport and other subjects. These languages would explore ways in which the forms of African cultural life and expression will help to shape, inform and influence cultures and intellectual traditions across the globe. It is necessary to transcend colonial alienation as “part and parcel of the anti-imperialist struggles of [Zimbabweans] and African peoples” whose indigenous languages “were associated with negative qualities of backwardness, underdevelopment, humiliation and punishment.” (Ngugi, 1981:28). This paper will testify the superiority of our indigenous languages to English. The researcher believes in the maxim “free your mind”: the mind must be liberated even from the confines of biased Afro-centric thought. These languages will convey the profound need for the Zimbabwean people to be re-located historically, economically, socially, linguistically, politically, and philosophically. For a number of years, Africans have been devoid of their cultural, economic, religious, political and social heritage. They have been living on the periphery of Europe. It is this “illusion of the fringes” that this paper seeks to eliminate and restore “the African person as an agent in human history…” (Asante, 2003:1)This will answer questions on how African cultural and intellectual traditions radically and indelibly shape the world. In demanding to know the total system of truth about the world, the first step is to know the reality of our own existence through our indigenous languages.

This note considers the impact of the ICTY jurisprudence and the 2003 UNESCO Declaration upon two discernible trends in the international law concerning cultural heritage. First, the dissolving of the divide between the protection afforded during period of armed conflict and peacetime. Second, the recognition of the importance of cultural heritage to subjects beyond the State in which it may be located: namely, humanity generally (including future generations), and non-state groups. These trends are complementary and reflect the increasing significance of the protection and promotion of cultural diversity in international law. Yet, they are also being met with significant trepidation by States, as exemplified by their reluctance to create new legal obligations with the 2003 UNESCO Declaration. Nonetheless, the events which triggered these developments highlight that the stakes are significant because the consequences of such acts are often irreversible.

The protection of intangible cultural heritage has often been regarded as the long neglected area of international cultural heritage law. Indeed, while international conventions for the protection of movable and immovable, tangible heritage have been operational for several decades, a specialist multilateral instrument covering intangible heritage was only finalised in 2003. Yet, the safeguarding of intangible cultural heritage has preoccupied international law for well over a century. I argued that the question of intangible cultural heritage in international law has influenced, and is influenced by, the protection of minorities and the articulation of cultural rights. Treaties covering these various areas contain similar rationales and objectives; disputes about the right holders and the nature of the rights; debate about obligations placed on States parties and the role of the international community; mechanisms of implementation; and the definition of 'culture'. I examine the resurgent interest in minorities, cultural rights and the protection of intangible cultural heritage in international and European law. Their interconnectedness is reflected in their concomitant rise and decline during specific moments in modern international law. These moments are defined by the importance placed on cultural diversity in attaining stability and prosperity by the international community and States. The primary areas of investigation are: (1) the phases of minority protection in international law from the early twentieth century to the present, and its interplay with cultural diversity, cultural rights and intangible cultural heritage; (2) the legacy of these phases upon the current conceptualisation and promotion of cultural rights in international, and European, law; and (3) the transformative impact of the 2003 UNESCO International Convention on the Safeguarding of Intangible Cultural Heritage on long-held rationales and mechanisms for the protection of cultural heritage in international law. I focus on Europe not because it alone has minorities within its borders. Rather, its haunting of European consciousness has consistently and significantly defined the development of international law in these areas. They are a central concern to current European integration and constitutional negotiations. 2 Cultural Diversity and Minority Protection Minority protection incorporates some of the earliest articulations of cultural rights and the protection of intangible cultural property in international law. Although cultural diversity was encouraged by such treaty provisions, it was often not their explicit purpose. Instead, peace and progress have been the consistent rationales attached to the inclusion, or otherwise, of such provisions.

This chapter concentrates on the participation of indigenous peoples in multilateral initiatives to protect cultural heritage, with specific reference to intangible heritage. While an international instrument for the protection of intangible heritage was adopted over a decade ago, the importance of intangible heritage for indigenous peoples is evident in their work in various UN fora. I examine indigenous peoples’ interventions before UNESCO and bodies established to implement the Convention on the Safeguarding of Intangible Cultural Heritage; within WIPO in respect of ongoing moves to adopt specialist instruments on traditional knowledge and cultural expressions; and finally, within UNEP and the implementation of Article 8(j) of the Convention on Biological Diversity. They reflect indigenous peoples’ determination to engage in the implementation of specialist instruments adopted by states and more significantly, their growing push to effectively participate in the drafting and negotiation of multilateral instruments. It is these latter efforts which are yielding more comprehensive and potentially lasting avenues for their effective engagement in the protection of their intangible heritage.

This chapter focuses on the participation of indigenous peoples in multilateral initiatives to protect cultural heritage, with specific reference to intangible heritage. United Nations Educational Scientific and Cultural Organization (UNESCO) is the United Nations specialist agency in the field of culture. World Intellectual Property Organization's (WIPO) Member States have emphasized the need to facilitate and strengthen the participation of observers in the Intergovernmental Committee's work. The Convention on Biological Diversity adopted under the auspices of United Nations Environmental Program predates the Intangible Heritage Convention and the current WIPO initiatives. UNESCO's normative work on intangible heritage started in 1973 with a Bolivian proposal for a protocol to protect folklore to be attached to the Universal Copyright Convention. The Intangible Heritage Convention, its Operational Directives and the reports of related committees have consistently reaffirmed the importance of ensuring that the implementation of the treaty conform with international human rights norms, especially of vulnerable groups.

In recent years,much attentions have been given to protecting tourism development of intangible cultural heritage.Large real-life scenery stage plays,exemplified by Impression ·LIU San-jie,becomes an important materialization form of transforming intangible cultural heritage into tourism product.This form of transformation shows a tremendous effect on tourism market.The practice of Yi Shui Li Chuan in Tenglong Cave in Hubei Province suggests that large real-life scenery stage plays offers indeed an important form and successful path of transforming intangible cultural heritages into tourism products.Certainly this form of transformation must enforce the authenticity of intangible cultural heritage and blend with the natural landscape to achieve sustainable development.

This paper revisits the notion of ‘community’ within the field of heritage, examining the varied ways in which tensions between different groups and their aspirations arise and are mediated. Our focus is a close examination of the conceptual disjunction that exists between a range of popular, political and academic attempts to define and negotiate memory, place, identity and cultural expression. To do so, the paper places emphasis on those expressions of community that have been taken up within dominant political and academic practice. Such expressions, we argue, are embedded with restrictive assumptions concerned with nostalgia, consensus and homogeneity, all of which help to facilitate the extent to which systemic issues tied up with social justice, recognition and subordinate status are ignored or go unidentified. This, inevitably, has serious and far‐reaching consequences for community groups seeking to assert alternative understandings of heritage. Indeed, the net result has seen the virtual disappearance of dissonance and more nuanced ways of understanding heritage. Adopting an argument underpinned by Nancy Fraser's notion of a ‘politics of recognition’, this paper proposes a more critical practice of community engagement.

At first glance the concepts of cultural heritage and the knowledge economy may appear to be divorced from each other. Indeed, the contrary is the case. According to UNESCO, cultural heritage “encompasses living expressions and the traditions that countless groups and communities worldwide have inherited from their ancestors and transmit to their descendants, in most cases orally.” The “in most cases orally” caveat signifies that whereas during colonization the peoples of the Caribbean and Africa were considered to be culture-less our societies and communities were in fact very rich and vibrant culturally. This created heritages that could successfully rival any from any other part of the world. However, the vast repertoire of heritage of the peoples of these areas does not often factor in general considerations of heritage. The perception that colonized communities were culture-less was nourished on the notion that because many of our cultural expressions and practices were not codified in printed books, music scores and other European means of communication and preservation – therefore there was no culture according to those measures. The knowledge economy is often narrowly defined by many as being that which is associated with/driven by ICT technologies. In reality, the knowledge economy is that which is based on the intellectual capital of a nation, community or individual. This more pragmatic concept of the knowledge economy would therefore, of necessity, include cultural creativity and expressions as two important factors of this mode of production, driver of growth, creator of wealth and provider of employment. According to Nurse “in economic terms, the cultural industries sector is one of the fastest growing sectors of the world economy”. Thus, in economic terms, culture and cultural heritage must be viewed as critical aspects of the knowledge economy, given that they depend on knowledge that is culturally-based as their mainstay and an intellectual capital whose means of production, distribution and preservation are often intangible. Music and song were two of the critical means of communicating culture and transmitting heritage from generation-to-generation within Africa and the Caribbean. And yet, the music and song of these spaces is often hard to find, is poorly documented and not well preserved/conserved in libraries throughout these regions. This presentation will examine the role and value of sound archives and sound archiving for both cultural heritage and the development and furtherance of the knowledge economy of African and Caribbean societies.

The key concept of authenticity, argues the author of this chapter, needs to be re-examined and adjusted in the era of globalization, particularly in relation to the category of living sacred heritage. Local cultural contexts are no longer isolated islands of thought and tradition; they are in fact ‘globalized contexts’ inhabited by communities and individuals conscious of their rights who may well resist the interventions of heritage professionals who are solely guided by the authorized heritage discourse. The heritage can no longer be seen as a static entity belonging in the past.

On Hunger focuses on the interface between food and public health and on the flawed regulations intended to protect us. Food not only represents nourishment for the body; it also possesses other valuable aspects that are protected by international legal instruments. Westra argues for the importance of effecting radical changes: to protect and improve the present system of food production and distribution. Starting from several reports produced by the FAO and the WHO, Westra argues for the need of a complete and radical re-evaluatio of current practices and systems in order to meet the obligation of the international community to prevent hunger. There is a particular emphasis on the problems facing the poor in the third world, but also the different but equally grave problems of those in developed countries, where the emphasis remans on corporate profit rather than on the protection of individuals, as present dangers affect all, starting from the children of all ages. Most of the existing literature on hunger and food does not address the harm that current practices inflict on people globally. Laura Westra’s On Hunger focuses on the interface between food and public health and on the flawed regulations intended to protect us. Food not only represents nourishment for the body; it also possesses other valuable aspects that are protected by international legal instruments. Westra argues for the importance of effecting radical changes: to protect and improve the present system of food production and distribution. This timely book explores every aspect of this challenge, from the impact of climate change, the role of the media and obligations to future generations. Westra also considers the legality of financial contributions on the part of agribusiness to political figures and campaigns, as well as their intrusion in the drafting of bills and regulatory regimes. Finally, the book highlights more positive developments,including the expansion of the remit of the International Criminal Court to include environmental crimes. On Hunger offers an original take on this increasingly important issue and will provide fascinating reading for scholars and students in law, philosophy and human rights.

This concept paper reports on a review of the literature relating to the safeguarding and mobilisation by local communities of Intangible Cultural Heritage (ICH) in the context of disasters triggered by natural hazards. What is the current state of knowledge regarding the impact of natural hazards on ICH? What role is played by ICH in mitigating the impacts of these disasters on local communities? ICH is a relatively new concept in the public domain and in the disaster risk management (DRM) field, and is seldom explicitly identified in these terms. The concept of local knowledge, which is more widely used and understood, serves as a synonym or proxy for ICH in much of the literature on disasters. To date, however, the two distinct fields and literatures of ICH and disasters are only rarely in direct conversation with each other. Local knowledge and, by extension, ICH play a crucial role in mitigation at every step of the disaster management cycle, from preparedness through response to recovery. This role is increasingly evident and appreciated in disaster management and risk reduction practice. However, there is only limited understanding of the longer-term structures that generate and sustain ICH and render it viable, and of the broader significance of non-technical ICH for disaster mitigation.

Kunqu (pronounced kwun-chü) is a form of Chinese musical theater. The first syllable of the name is derived from the name of its birthplace Kunshan, a small city in the Lower Yangzi region, situated between Shanghai and Suzhou. The second syllable, “qu,” denotes either aria lyrics, a vocal style, an aria repertory, or a type of musical theater, depending on contexts. As musical theater, kunqu rose to a dominant position on the national stage around the mid-sixteenth century when the Ming dynasty (1368–1644) was at the height of its glory. The Ming had remarkable achievements in culture and the arts, and Ming skills in printing and the manufacture of porcelain and silk reached high technical achievements. Flourishing commerce in the Ming period created a new level of prosperity and supported a sophisticated urban life in which kunquformed an important component. The practices of intangible cultural heritage are central to the cultural heritage of humanity, which comprises practices from a plethora of different cultures as well as monuments listed as world cultural heritage. These oeuvres and practices play an important role in the cultural identity of human beings: “The ‘intangible cultural heritage’ means the practices, representation, expressions, knowledge skills — as well as the instruments objects, artefacts and cultural spaces associated therewith — that communities, groups and, in some cases, individuals recognize as part of their cultural heritage” (UNESCO, 2003a, Article 2). These practices are manifested in the following domains: a) oral traditions and expressions, including language as a vehicle of the intangible cultural heritage; (b) performing arts; (c) social practices, rituals and festive events; (d) knowledge and practices concerning nature and the universe; (e) traditional craftsmanship.

The evolution of the intangible cultural heritage depends on inheritance and development.The definition of the intangible cultural heritage emphasis on the inheritance for generations and recreation and acceptation constantly in groups and community,which defined by United Nations Educational Science Culture Organization Treaty.The definition is different from the traditional folk custom(folk culture) in our research circle,which emphasis on the status of author and inheritor.Four styles to inherit as followed: group inheritance,family inheritance,society inheritance and God inheritance.Inheritors appear mainly in the realm of oral literature,performance art,handwork technique,folk knowledge and so on.The investigation,confirmation and management to the inheritor are the problems urgently to solve in China intangible cultural heritage general investigation in 21st century.
