Resumen:

The live music venue has long been regarded as a space of critical importance in relation to musical experience. Like music artists themselves, venues often come to embody the zeitgeist of a particular genre or era. Liverpool’s Cavern, New York’s CBGB’s, and Brisbane’s Cloudland are but three examples of an ever-growing list of live music venues (closed down, demolished, renamed) achieving iconic status due to a connection with important and galvanizing moments in music history. Significant in this are the ways in which collective memories become textured by particular venues and how memory works to forge strong collective associations between former audiences. Drawing on theoretical frameworks utilized in space and place research and memory studies, this article will investigate the significance of unofficial, unlicensed music venues and the way in which the memory of these particular sites constitute a potent form of intangible cultural heritage in contemporary society.

Resumen:

Study of the legal system and the role of different actors, with particular attention to the regions, in the field of law of the architectural heritage, at international, EU and national and moments of comparison between the Italian system, the French and Spanish. The work is divided into three parts: the first is dedicated to the research of the historical roots of the discipline, its evolution over time, of possible new regional spaces in different levels considered. In the second one we examine three recent cases of conflict between Unesco and the national and local governments, in order to illustrate the powers and mutual intervention possibilities. They analyze three events that have had as a center of interest in certain assets registered list of cultural heritage and natural World. For the case studies were chosen three countries (Italy, France and Spain) whose regions have skills and fields of action quantitatively and qualitatively different. In particular, the regions studied are Sicily (Autonomous Region with legislative and administrative powers large), the Aquitaine Region (without legislative powers) and the Autonomous Community of Catalonia (with almost absolute powers). In the third part of the study moves to the analysis of the relevant public policies and some national and regional economic data and ends whereas the cultural heritage, enclosing itself is the universal breath aspects and elements that contribute to the full maturity of individual values, It involves the intervention of all the institutions, at every level. The Company seeks to achieve the increasingly pronounced multiculturalism postulates the presence of multiple centers of power, which move in an integrated manner, ensuring participatory levels of each level of government. Only in this way you will get the protection of the patrimony of the whole Company, formed by multiple cultural instances. Observe the different cultures in a company, ensure the values and symbols, become an instrument of peace and democracy in which the role of the regions is essential to ensure the growth and evolution of the Community and taking charge of elements that contribute to the realization of an open and harmonious society.

In 2004 banglanatak dot com initiated an experimental “Art for Livelihood” project, targeting 3200 folk artists (Patachitra - singing stories painted on scrolls, Baul Fakiri – Sufi music of Bengal, Jhumur – tribal lifestyle music and dance, Chau – tribal masked dance with martial art imbibed, Gambhira and Domni – folk theatre forms) in six economically backward districts of West Bengal. The project primarily aims at enhancing the livelihood basis of the artists while providing a new positive identity to their localities as creative hub, rather than that of impoverished rural villages. The emergence of such new rural creative hubs is in turn gradually leading to the development of new tourism destinations to bring additional income opportunities to the so-far economically marginalized areas. The paper presents innovative strategies for developing villages as heritage tourism destinations. Village of Pingla with 52 Patachitra painter families is attracting regular visitors. Yet, the village is deprived of any major historical sites of interest. Santhal communities in Tunta, not only present folk songs, dance and craft, but also take the visitors to neighbouring 6th century terracotta temples. Result is safeguarding of heritage by community themselves. Much of existing heritage tourism is largely centered on the promotion of historical monuments and sites or static imaginaries commoditizing local cultural traditions. Such tourism models have not necessarily brought expected benefit to the local population. Heritage tourism initiatives have often failed to invest in the capacity building of local human components, especially the poor segment of society. This has led to classical situation where local heritage resources are being exploited by outside business ventures leaving local communities as mere low-end tourism sector ‘labour’. The paper shares successful approaches for placing traditional artistic skill of local population as prime mover of income generation and development of sustainable community led tourism.

Este trabajo presenta un paralelo entre los abordajes actuales de la problemática del patrimonio cultural y los históricamente desarrollados en el campo del Folklore. A partir de un concepto desarrollado por las denominadas Nuevas Perspectivas del Folklore -la noción de actuación (performance)- se sugiere una posibilidad para superar la dicotomía tangible/intangible vigente en gran parte de la literatura sobre el patrimono cultural. Asimismo se postula una herramienta metodológica para el registro, documentación y análisis de expresiones culturales potencialmente patrimonializables.

This paper examines the process of incorporating the Bedouin of Petra and Wadi Rum in Jordan on UNESCO’s list of Masterpieces of the Oral and Intangible Heritage of Humanity in 2005. The author focuses on the Bedouin tribes around Petra, who were resettled in villages when UNESCO proclaimed the area part of the tangible heritage of humanity in 1985. Heritage is approached as a ‘process of assembling’ that emerges from the interactions of social entities operating on a smaller scale. By focusing on these entities’ various discourses about Bedouin heritage that are included in the reports and applications to UNESCO, it is argued that through the process of proclaiming intangible heritage, cultural categories are formulated so as to fit into contemporary imaginations, longings and settlement policies. Investigating the process of heritage inscription reveals the multiple, and at times contradictory, discourses that undergird the production of particular images of Bedouin culture through heritage institutions that interlock, rather than harmonise, them.

In this paper we question key terms which appear frequently in discussions of language teaching and learning: ‘language’ and ‘heritage’. The paper draws on empirical data from one of four linked case studies in a larger project funded by the UK Economic and Social Research Council (ESRC), ‘Investigating Multilingualism in Complementary Schools in Four Communities’ (RES-000-23-1180). In our analysis we argue that the relationships between ‘language’ and ‘heritage’, far from being straightforward, are complex in the way they play out in classroom interactions. The data raise a number of questions in our attempts to understand how the linguistic practices of students and teachers in Bengali schools are used to negotiate young people's multilingual and multicultural identities. First, participants articulate attitudes and values which raise questions about what constitutes ‘language’. Second, participants express views and attitudes, and perform interactional practices, which raise questions about what constitutes ‘heritage’. Our analysis finds that multilingual young people in complementary school classrooms use linguistic resources in sophisticated and creative ways to negotiate subject positions which appear to contest and subvert schools’ attempts to impose upon them ‘heritage’ identities

UNESCO launched the United Nations (UN) International Year of Languages on February 21, 2008, International Mother Language Day, with an information workshop entitled “Standard-setting Instruments Promoting Multilingualism.” UNESCO is the lead agency for carrying out activities related to the international year in view of its extensive work in the area of promoting multilingualism (in education and cyberspace, for example), safeguarding endangered languages, and supporting indigenous languages linked with traditional ecological knowledge and environmental sustainability. The international year is accompanied by the slogan “languages matter!” and this reflects the wider context within which it and its related activities have been conceived.

The linkage between human rights and cultural heritage law is of great importance, but it has not been sufficiently examined in the literature, particularly by human rights specialists. There are obviously several elements and characteristics of cultural heritage that have strong human rights dimensions (negative as well as positive), in particular its role in cultural identity formation and affirmation, its relationship to the tricky notion of cultural diversity, the problem of cultural traditions or practices that contravene human rights standards, and the potential of heritage to exclude and serve as the vehicle for expressing social and political tensions. It is essential to understand some fundamental characteristics of human rights as well as certain theoretical challenges that cultural heritage evokes, such as relativist positions and claims for collective rights. Cultural rights, although important, are not the sole human rights applicable to the protection of cultural heritage, and we need to judge the content and performance of existing international cultural heritage instruments against all the relevant human rights. Although recent cultural heritage law-making has responded increasingly to human rights requirements, its soft law character and the strong reservation of State sovereignty are limiting factors; hence, human rights can directly influence cultural heritage protection if well understood and applied.

This article aims to examine how far our experience of implementing UNESCO’s Intangible Heritage Convention, which was adopted in 2003 and entered into force in April 2006, over the last seven years has transformed our understanding of intangible cultural heritage and of its safeguarding. There have been, of course, both positive and negative impacts thus far as well as both unexpected and, thus far, unknown outcomes. The Convention broke new ground, introducing new terminology and new definitions of existing terms and requiring a reexamination of some approaches to international and national law making and policymaking. When considering the impact of the 2003 Convention internationally, we need to look, inter alia, at its impact on international policymaking (including cultural policy, the sustainable development agenda and indigenous rights), related developments in other areas of international law (including human rights and environmental law), and the way in which states treat shared heritage that crosses international frontiers. On the national level, we should consider how the Convention may have contributed to creating a new paradigm for identifying and safeguarding intangible cultural heritage (ICH), shifting the focus of significance, redefining the role of non-state actors vis-à-vis state authorities in this process and, even, moving the idea of national heritage away from a purely state-driven concept.

Heritage has a dual character whereby it can, at the same time, be celebrated for its outstanding universal value while having a special meaning and value for local and, in particular, bearer communities. Basing protection on the former notion of heritage as a universal, global value has been the dominant approach in international law-making since the second half of the twentieth century. More recently, the significance of heritage to local actors has become much better understood and recognised. The tensions associated with this duality have in recent times become evident with the adoption by UNESCO in 2003 of the International Convention for the Safeguarding of the Intangible Cultural Heritage. In this treaty, international cultural heritage law-making has shifted from a paradigm that gives value predominantly to the material heritage – monuments, sites, artefacts and other objects – to one that celebrates a living heritage that is primarily located in the skills, knowledge and know-how of contemporary human beings. This article examines the aforementioned shift from an emphasis on global to local heritage and the role museums can play in this with regard to safeguarding intangible aspects of heritage.

The gender dynamics of cultural heritage have, until recently, been seriously overlooked and have certainly not featured greatly in discussions about protecting cultural heritage under international law. The multiple ways in which gender and cultural heritage interact are extremely complicated and often raise highly sensitive issues, including a number of important human rights-related ones. These are especially those connected with traditional cultural practices that appear to discriminate against subordinate gender groups, most frequently women and girls. In this article, the potential of the gendered aspects of cultural heritage to be both damaging to the human rights of, and a source of strength for, different gender-defined groups is explored and the need to take a nuanced approach to this question is shown. Although material aspects of heritage also exhibit important gendered aspects, for example the customary rules governing access by different gender groups to sacred sites or the gender-based differentiation in the production and/or use of artefacts, I focus my discussion here on intangible cultural heritage (ICH) for two reasons: first, it is in relation to ICH (traditional practices, performances, knowledge etc. and the associated material elements) that specific gender-based roles are most obvious; and, second, the human rights-related issues are generally clearer in the case of ICH.

The duality of the nature of heritage - celebrated at the same time for its universal value and for its special meaning and its significance for local and bearer communities - represents a challenge for its safeguarding and its presentation by museums. Heritage as a universal, global value has been the predominant approach in international cultural policy-setting since the second half of the twentieth century, but its significance to local and bearer communities is now increasingly well understood. This duality has been particularly challenging with regard to implementing UNESCO’s International Convention for the Safeguarding of the Intangible Cultural Heritage (2003). With the adoption of this treaty, the policy - and law-making - paradigm has shifted from valuing monuments, sites, artefacts and other objects, to safeguarding a living heritage that is primarily located in the skills, knowledge and know-how of contemporary human beings. With regard to the role of museums in safeguarding intangible cultural heritage (ICH), a document of great significance is the Recommendation concerning the Protection and Promotion of Museums and Collections, their Diversity and their Role in Society adopted by the UNESCO General Conference in 2015. This is an innovative document that recognises not only the great importance of the preservation, study and transmission of cultural heritage, both tangible and intangible, for all societies, social cohesion and sustainable development, but also the central role that can be played by museums in helping to achieve this. Recently, the potential of cultural heritage has increasingly been acknowledged in international policy - and law-making - as a social, cultural and, at times, economic resource for communities, in particular the intangible heritage. Moreover, international law has now called for a greater democratisation of the heritage protection paradigm, in particular through community participation in its identification, safeguarding and management. This article examines the aforementioned shift from an emphasis on global to local heritage and the role museums can play in this with regard to safeguarding intangible aspects of heritage.

The aim of this article is to examine how the requirement in the United Nations Educational, Scientific and Cultural Organization’s 2003 Convention for the Safeguarding of Intangible Cultural Heritage (ICHC) to ensure the effective involvement of local communities, groups, and individuals (as well as experts, centers of expertise, and research institutions) in the implementation of the Convention can be put into better effect in its international operation. Although examples exist of international treaties that involve non-governmental and other civil society bodies in their implementation at the international level, mostly with regard to Indigenous peoples, the mechanisms for such involvement are still underdeveloped and not wholly satisfactory. Since it has proved difficult to put community participation at the intergovernmental level into practice within the framework of the ICHC, the author seeks to identify approaches that can be usefully employed in the treaty—in particular, by considering participatory models found in other international treaty frameworks in the heritage and environmental protection law fields.

This volume examines the implications and consequences of the idea of ‘intangible heritage’ to current international academic and policy debates about the meaning and nature of cultural heritage and the management processes developed to protect it. It provides an accessible account of the different ways in which intangible cultural heritage has been defined and managed in both national and international contexts, and aims to facilitate international debate about the meaning, nature and value of not only intangible cultural heritage, but heritage more generally. Intangible Heritage fills a significant gap in the heritage literature available and represents a significant cross section of ideas and practices associated with intangible cultural heritage. The authors brought together for this volume represent some of the key academics and practitioners working in the area, and discuss research and practices from a range of countries, including: Zimbabwe, Morocco, South Africa, Japan, Australia, United Kingdom, the Netherlands, USA, Brazil and Indonesia, and bring together a range of areas of expertise which include anthropology, law, heritage studies, archaeology, museum studies, folklore, architecture, Indigenous studies and history.

L'entraîneur de l'Equipe de France de Voltige avait besoin d'une étude cinématique des mouvements du cheval dans cette discipline pour mieux les comprendre. Par ailleurs, aucune étude n'avait été réalisée sur le cheval au galop sur le cercle. Ainsi, neuf chevaux de l'Equipe de France de Voltige ont été filmés dans leur condition habituelle de travail, à l'aide de deux caméscopes placés autour d'une piste. Des marqueurs ont été placés sur la peau de chaque cheval en regard de repères anatomiques déterminés. Grâce à un logiciel particulier, les enregistrements 2D obtenus sur cinq passages ont été dépouillés et les mouvements 3D ont été reconstruits. Ainsi, le mouvement global du cheval au galop sur le cercle a pu être observé, et pour chaque animal, sa vitesse, les mouvements pendulaires de ses membres, les mouvements de sa tête et de son encolure et ceux du tronc ont pu être analysés. La précision des mesures a été vérifiée et est satisfaisante. L'étude montre que certains chevaux engagent plus leur postérieur externe que d'autres, certains génèrent une amplitude plus grande dans leurs mouvements de balancier. Mais seuls les mouvements du côté droit de l'animal ont été analysés et ce sans le voltigeur. Toutefois, cette étude a participé à l'élaboration de critères de jugement du cheval de voltige en compétition.

The intangible heritage is not easy to present in a museum exhibition, and this is perhaps especially so in the case of what the 2003 UNESCO Intangible Heritage Convention terms 'knowledge and practices concerning nature and the universe'. The Brazilian Federal Museum of Astronomy and Related Sciences (MAST), Rio de Janeiro, initiated an exhibition and educational programme on this theme for International Museums Week in 2004, focusing particularly on four very different cosmologies (i.e. narratives that attempt to explain the origin of the Universe): the Biblical story in Genesis, the contemporary scientific 'Big Bang' theory, and the creation stories of two Brazilian indigenous populations: the Tukano people of the Amazon Region, and the Guarani of southern Brazil and some neighbouring countries. The event, called Myths of Origin - man and his comprehension of the Universe and of the planet on which he lives, consisted of a conceptual, sensory and educational experience whose principal objective was to challenge preconceptions while questioning also the visitors' perceptions which arise from an educational system where many of these ideas are taught as absolute truths. Following Paulo Freire's theory of learning and a non-restrictive understanding of the sciences, we chose to present the four different narratives on an equal basis and invited the visitor to explore these without preconceptions. The underlying objective was to establish a dialogue among these diverse discourses about the cosmos, which we hoped would encourage visitors to take a critical view of the sciences and the way they are interpreted in museums.

After the adoption of the 1972 Convention the meaning and definition of Cultural Heritage went through adjustment and reconsideration which brought to a widening of the idea of cultural heritage. Cultural landscapes and industrial archaeology are just some examples. From the end of the nineties long-claimed requests for the recognition of the importance of ethnological heritage got stronger thanks to the increasing worries for cultural homogenisation as a consequence of the globalisation process. This process of renewal culminated in the adoption of the Convention on Intangible Cultural Heritage in October 2003 and the proposal of a deep renewal in the understanding and approach to heritage as a whole. This new perspective conceives heritage as a wider cultural whole and not only extends the World Heritage ‘brand’ to intangible cultural expressions but widens and redefines the previous meaning and definition of Cultural Heritage. Intangible features are more and more underlined and considered as decisive in the evaluation process of World Heritage sites focusing now on processes (social, biological or cultural) embodied in the sites. The distinction between tangible and intangible, a reflection of an administrative category, demonstrates therefore its artificial nature. Heritage is thus conceived not only as a consecrated masterpiece of the past to be venerated and preserved but as a symbolic and living space to be appropriated by local communities, the mirror of a collective and active memory. The idea of turning living cultures into heritage is however not free from contradictions. The paper shows, in an analytical perspective, the influence of the notion of intangible heritage, its theoretical contradictions and the new challenge facing cultural policies makers.

In this paper I compare the theory and the practice of heritage highlighting the gap which separates ideas underpinning the intangible cultural heritage normative deﬁnition (via the text of the Unesco Convention for the Safeguarding of the Intangible Cultural Heritage) and in the broad discourse of the institution (the “esprit de la convention”) from concrete application of heritage policies to “traditional culture” made by local actors. I focus on how the idea of “property” is dealt with in both contexts and consider the role that the spatial location in a territory plays in this regard. The establishment of a system of “geographical indicators” for handcrafts, the heritagization and monumentalization of a special kind of clay whistle in southern Italy is taken as an example to demonstrate how local heritage policies address issues of property – territory and intangible heritage.

The United Nations Educational, Scientiﬁc and Cultural Organization (UNESCO) shares the widespread contemporary popular and academic concern about globalisation and responds by making the protection of ‘cultural diversity’ the pivot of its overall cultural policy. In particular, the ‘threat of globalisation’ is assumed to be especially dangerous for the most recent UNESCO heritage domain, Intangible Cultural Heritage (ICH). The Convention for the Safeguarding of the Intangible Cultural Heritage refers to the issue of globalisation in the preamble, recognising that:the processes of globalisation and social transformation, alongside the conditions they create for renewed dialogue among communities, also give rise, as does the phenomenon of intolerance, to grave threats of deterioration, disappearance and destruction of the intangible cultural heritage, in particular owing to a lack of resources for safeguarding such heritage.

Cet article explore la fabrique globale du patrimoine immatériel en suivant la circulation de cette notion des échelles nationales aux arènes internationales de gouvernance, et vice versa. L’article présente d’abord le transfert de la catégorie patrimoniale japonaise du mukei bunkazai au niveau international, répondant en miroir à l’institution, grâce à l’Exposition universelle de 1873, de la notion européenne de beaux-arts au Japon. Puis sont abordées les adaptations du standard international du patrimoine culturel immatériel aux régimes patrimoniaux italiens et français. En retraçant les controverses, frictions et ajustements que suscitent ces traductions, nous voyons comment, malgré les efforts de normalisation prévus par une convention internationale, celle-ci n’échappe pas à la diversité culturelle inhérente à sa fabrication et à ses déclinaisons nationales.

Dernière déclinaison de la notion de patrimoine, le patrimoine culturel immatériel (PCI) en est peut-être aussi la plus énigmatique et déroutante. Cette nouvelle catégorie, introduite par l’Organisation des Nations unies pour l’éducation, la science et la culture (Unesco), perturbe aujourd’hui le domaine du patrimoine, historiquement fondé sur un « régime d’objet » : les institutions patrimoniales peinent à concevoir la dimension immatérielle et à l’intégrer dans leur organisation, et la prise en compte des valeurs sociales du patrimoine, enjeu véritable des politiques de sauvegarde du PCI, ne relève pas des compétences techniques et scientifiques des professionnels du patrimoine.Si l’irruption du pci pose des problèmes concrets aux responsables de la mise en œuvre des politiques culturelles, les théoriciens du patrimoine en dénoncent les limites conceptuelles, voyant dans cette notion une « aberration intellectuelle », dernier avatar de ce que Henri-Pierre Jeudy (2001) appelle « l’obsession patrimoniale », cette hantise qui rongerait la société contemporaine jusqu’à anéantir le présent dans une « rétroaction perpétuelle ». Les ethnologues ont souvent dénoncé comme universalistes les interventions de l’Unesco et les ont soupçonnées de favoriser une fixation muséalisatrice des processus culturels (Amselle 2004), d’encourager l’invention de traditions et la mise en spectacle de la culture dite « traditionnelle » à travers une revitalisation de pratiques désuètes qui n’ont plus...

This paper investigates the bureaucratisation of the (utopian) ideal of community participation in Intangible Cultural Heritage (ICH) safeguarding and management. The analysis considers the whole ‘policy life’ of the UNESCO Convention for the Safeguarding of ICH. Our ethnographic examples from UNESCO, Brazil, China and Greece illustrate how bureaucratic operations often disenchant the participatory ideal, alienating it from its original intention. At the same time, driven by their commitment to ‘good’ governance and informed by sentiments of frustration and disappointment with actual policy results, vocational bureaucrats at different administrative levels experiment with and conceive of new tools in order to produce evidence of participation. We demonstrate how this bureaucratic creativity has concrete consequences, which may differ from the intended utopia, but nevertheless bring to life particular interpretations of the participatory principle among the recipients for whom heritage policies were originally designed. Thus, we present a more nuanced picture of bureaucratisation in which officials’ emotions and engagement sustain their agency against structural constraints as well as the futility and fragility of administrative procedures.

The island of Mauritius, situated in the southwest Indian Ocean region, is an integral part of southern Africa. This article discusses the situation of the Creoles living in two villages on the west coast of the island, focusing on the juncture between attempts to reconstruct Creole identity and the state's desire to encourage heritage tourism on the island. The article argues that efforts to emphasise the black, slave aspects of Creole identity and history risk the suppression of ethnic diversity and hybridity in Mauritian society. Currently, the dominant classes on the island are keen to articulate a homogeneous identity and history for Creoles as a means to obtaining a space of value and power in a society in which ethnicity is highly politicised. Some see this as a means to achieve national reconciliation and nation building. Heritage preservation, narrowly conceived, may actually undermine nation-building processes and essentialise Creole identity and history, however, unless the diversity of Creole experience is represented in a broad-based approach to heritage preservation and management.

The paper considers the significance of dress to identity and power among women living on the island of Zanzibar. Drawing on her own preliminary fieldwork in Zanzibar (June 2004) and on the work of Laura Fair (2001), the author discusses the ways in which dress (in general), and the wearing of kanga fabrics in particular, offers women a means of communication in an image conscious and historically stratified society. It is argued that kangas are still an integral part of ritual and social activities in Zanzibar and that they shed light on the complex history of the Swahili coast. Placing the ethnography in a broader and contemporary context, the author states that kangas contribute to the intangible heritage of Zanzibar in their encapsulation of the island's oral history, art, social commentary and concepts of beauty. The author concludes by outlining some of the challenges that heritage regimes face in the Indian Ocean region and potential strategies for preserving or managing its mixed cultural resources.

Over the past thirty years, the concept of cultural heritage has been continually broadened. The Venice Charter (1964) made reference to “monuments and sites” and dealt with architectural heritage. The question rapidly expanded to cover groups of buildings, vernacular architecture, and industrial and 20th century built heritage. Over and above the study of historic gardens, the concept of “cultural landscape” highlighted the interpenetration of culture and nature. Today an anthropological approach to heritage leads us to consider it as a social ensemble of many different, complex and interdependent manifestations. This is now reflecting the diversity of cultural manifestations. The quest for the “message” of cultural properties has become more important. It requires us to identify the ethical values, social customs, beliefs or myths of which intangible heritage is the sign and expression. The significance of architectural or urban constructions and the transformation of natural landscapes through human intervention are more and more connected to questions of identity.

The main emphasis of most museums over the centuries has been on the material or tangible cultural or natural heritage. However, from very early times some museums have also been closely involved in preserving and presenting the immaterial or intangible culture as well. On 20th April 2006 the new UNESCO Convention for the Safeguarding of the Intangible Cultural Heritage 2003 came into force, so it is timely to consider the implications of this major new development for museums. Will new organisations and services, a new profession even, be created to give effect to the new treaty that will challenge, threaten even, the traditional roles of museums and museum professionals in relation to the heritage? Or can museums, the museum profession, and not least museum professional training, respond positively to these serious potential challenges and take a major role in ensuring that the admirable aims of the Intangible Heritage Convention are achieved in relation to all, or most, of its five key areas: oral traditions, performing arts, social practices, knowledge and practices concerning nature and the universe, and traditional craftsmanship?

Conﬂicts and wars have long been recognised as threats to tangible cultural heritage. Well-known examples include the Buddhas of Bamiyan and the Mostar Bridge in Bosnia-Herzegovina, both of which show the importance of safeguarding such sites (see for example, Albert 2006: 32-33, Stanley-Price 2007b: 4-5). However, much less attention has been paid to intangible heritage in times of conﬂict, although the 2003 UNESCO Convention explicitly ascribes intangible cultural heritage an invaluable role ‘in bringing human beings closer together and ensuring exchange and understanding among them’, in other words, peace (UNESCO 2003; see also Albert 2006: 30, Albert and Gauer-Lietz 2006: 20, van Ginkel 2005: 25). The destruction of intangible cultural heritage (ICH) such as social and cultural structures, relationships and identities is usually not visible, thus much more diﬃcult to detect, but potentially more grave in its consequences and more diﬃcult to heal (compare Nordstrom 1997: 93). In this chapter, I argue that the destruction or disregard of ICH damages or ignores some of the very means needed to solve problems, prevent conﬂicts and for social reconstruction. In an era of ethnic and religious wars, one often seems to forget that religion and culture are not only (mis)used to mobilise people to ﬁght each other. On the contrary, they can also help prevent and resolve violent conﬂict and enable reconciliation. To explore the subject further, this chapter aims to bring together the discourses on cultural heritage and traditional justice mechanisms as internationally recognised ‘peace tools’. To date, they have hardly crossed paths, although there are essential overlaps. This contribution looks into the question of whether it makes sense to declare traditional justice mechanisms as ‘cultural heritage’. Arguing for a progressive merging of the two discourses and a careful integration of traditional justice mechanisms into the body of internationally recognised ICH, the chapter draws on two case studies – East Timor and Indonesia.1. It reﬂects on shortcomings of traditional justice mechanisms and discusses the linking up of traditional justice and cultural heritage via one of the central features of both discourses: ritual performances. 2. The chapter concludes with some challenges, problems and prospects of viewing traditional conﬂict resolution and justice mechanisms as part of Asia’s intangible cultural heritage and a critical part of dealing with conﬂicts and social unrest in parts of Asia.

Biological diversity is a concept that has been developed and enshrined in multilateral agreements in a very short space of time. It is generally agreed that it was in 1986 that the concept was introduced. Much older in concept is cultural diversity. These two diversities are now meeting each other in many ways, not least through Multilateral Environmental Agreements (MEAs). And both diversities are recognised, explicitly and implicitly, as part of the global heritage of humankind, with the attendant responsibilities that flow from that. In this paper we show the extent to which the two diversities are mutually self‐supporting, and yet how in many cases MEAs seem to have ignored their mutual strengths. However, the very needs that are promoting synergies between the MEAs and broader UN programmes are also now promoting new ways of viewing interaction between the diversities. Nowhere is this clearer than in cultural landscapes, which feature explicitly in some MEAs but have impacts in all. For the future some seven key areas of research and development will help to build the strengths and mutual interaction of the diversities, within the policy framework of the MEAs.

The Paris 2011 ICOMOS Scientific Symposium will explore how Heritage can contribute to and stimulate development in a modern world. Theme 3 -Tourism and Development focuses on the role of heritage in the development of sustainable tourism and on the potential for tourism to be a major factor in building public awareness and support for heritage conservation. The contribution that tourism can make to poverty alleviation, to conservation of the natural and cultural heritage and to overall sustainable development, can be substantial. Tourism and culture are seen as two powerful drivers for growth in many parts of the world. They play a vital role in fostering a greater understanding of the rich diversity of regional cultures. Cultural tourism is an inevitable component of cultural heritage. Tourism has the power to deliver significant earnings for environmental protection, as well as giving economic value to cultural heritage. It is a sector built on bringing people together in order to learn about and understand each other, fostering mutual respect and tolerance. As one of the world’s most powerful economic and social forces, well managed tourism can and does give heritage, both tangible and intangible, a major role in contemporary society, reinforcing cultural identity and diversity as key reference points for development. The tourism sector is well aware of the issues surrounding heritage conservation and its role in contemporary development. Natural and cultural heritage sites are now major components of the world’s tourism assets. The UN World Tourism Organization research demonstrates that interest in the environment, culture and heritage is a primary motivation for more than 50% of travel, and is consistently growing as a market sector. The paper will summarise the contribution of the ICOMOS International Cultural Tourism Committee and others over the last decade to the development of well managed tourism as a major contemporary force for heritage conservation and human development.

A major factor driving contemporary concerns about the fate of intangible cultural property is the rise of the Information Society, which has proven adept at stripping information from the cultural contexts that give it meaning. Efforts to preserve intangible heritage have tended to follow Information Society models by proposing that heritage be inventoried, then removed from the public domain and returned to the exclusive control of its putative creators. This essay reviews recent scholarly work and policy initiatives related to intangible cultural property, with an eye toward identifying their merits and flaws. It argues for a more ecological perspective, one that takes account of the unpredictable quality of information flows as well as the costs of attempting to manage them. Also explored are some of the difficult, unanswered questions about whether all intangible cultural heritage is equally worthy of protection.

La Convention du patrimoine mondial de l’Unesco, qui constitue aujourd’hui le système de conservation du patrimoine le plus influent au niveau international, accorde une place croissante aux aspects immatériels. À côté des sites associés à des idées, des événements (tragiques) et des personnages célèbres, la nouvelle catégorie des paysages culturels permet d’inclure des sites spirituels importants pour les peuples indigènes. En outre, la réévaluation des critères d’authenticité a entraîné la réhabilitation des projets de reconstruction. De la même manière, les biens en série, qui sont de plus en plus populaires, reposent eux aussi sur des « idées » et non sur la matérialité de chaque site. Cependant, cette réorientation n’est que partielle : l’impulsion continue de venir des États-nations, toujours aussi avides d’inscrire des sites sur la liste du patrimoine mondial.

Resumen:

La communauté de la conservation en matière de patrimoine mondial a décidé de prendre au sérieux la catégorie de patrimoine immatériel. Les conséquences induites sont importantes au niveau des partenariats avec les minorités autochtones et les personnes déplacées en général. L’auteur suggère que la définition du patrimoine immatériel, comme le stipule l’UNESCO dans la Convention de 2003, puisse considérer comme patrimoine les expériences de vie des minorités autochtones vivant dans des paysages colonisés. Il propose de cartographier ce patrimoine.

Resumen:

The purpose of the investigation project described here was to develop an intangible heritage inventorying methodology suitable for Portugal and in accordance with the provisions of the UNESCO 2003 Convention, the Operational Directives and the recommendations of experts. Within the project, the inventorying methodology and the instruments developed were tested on a sample of people involved with specific elements of ICH from the five Convention domains, and with an ICH element from the domain of traditional craftwork - the production of inlaid ceramics in Nisa, a small Portuguese village in North Alentejo.

Resumen:

Many forms of Japan's intangible heritage, including its three 'Masterpieces of the Oral and Intangible Heritage of Humanity', are headed by hereditary masters called iemoto. This paper examines the iemoto system as it relates to the exclusive rights of the iemoto. Through case studies taken mainly from the traditions of the tea ceremony, Nogaku, and Kabuki, the state of Japanese art traditions under the said system is also discussed. Although the iemoto system is shown to be authoritarian in various ways, it has also played a crucial role in the preservation of intangible heritage in Japan.

Resumen:

This study examines the situation of food within the discourse of intangible heritage. Food is discussed as a potential and independent category in UNESCO's formal definition of intangible heritage, as contended in applications submitted by countries that currently seek formal heritage designation for their national cuisines, and through issues such as identity and symbolic violence that are attendant to the concept of food as heritage. Although food may rightfully belong in the heritage discourse, its formal designation as heritage requires careful consideration in light of such issues.

Pour poursuivre sur la lancée de Cyril Isnard, ainsi que des illustrations proposées par Jean Pinard, je tenterais d’aborder de façon schématique et générale la question des risques existants dans la mobilisation du patrimoine à des fins de développement. Il s’agira principalement d’identifier les blocages résidants dans les préconisations et de proposer le lancement d’un chantier pluridisciplinaire sur l’évaluation possible de ces risques. Le constat qui est collectivement fait, et qui est donc largement revenu dans lesdiscussions de ces journées, est celui de la forte assimilation du patrimoine à une ressource pour le développement. Pour les formes de développement « classiques », cela ne fait plus de doute. Développement économique et culturel, développement local…, la ressource patrimoniale est un atout qu’i l est difficile d’oublier. Mais qu’en est-il pour le développement territorial ? Le patrimoine peut-il s’assimiler à la ressource dite « territoriale » (Gumuchian ; Pecqueur, 2009) ? Cette question mérite d’être posée au préalable car, dans notre hypothèse d’une vision positivée de la ressource territoriale, un double critère d’atténuation des risques peut être mis en avant dans sa participation à la dynamique territoriale (la ressource serait territoriale lorsqu’elle permet la territorialisation et lorsqu’elle permet le renouvellement des conditions de départ de sa mobil isation). Aussi, les deux réponses qui émergent aujourd’hui des travaux sur cette question montrent que : soit le patrimoine peut-être constitutif de la ressource territoriale (Landel ; Senil, 2008) ; soit il peut constituer en soi la ressource territoriale (Canova ; Landel, 2009). Toujours est-il que dans les deux cas, il aura certainement un grand rôle à jouer dans les modes de développement territorial de demain.
