Executive Summary

Please summarize in max 3500 characters the main achievements and challenges in implementing the Convention and the outlook for the future. Please note this is not an introduction to the report or an annotated table of contents.

This report gives the overview of the implementation of 2005 Convention by the Ukrainian State on the international, national and regional level in years 2014-2017. The landmark events of the late 2013-early 2014 – the Revolution of Dignity – have caused the re-institutionalization of the Ukrainian society, influenced greatly the speed-up of the democratic changes, strengthening of the civil society and national identity. The cultural policy paradigm has shifted, bringing new solutions and approaches.

Despite of the severe political, economic and social difficulties caused by the military aggression against Ukraine and the illegal occupation of the Autonomous Republic of Crimea by the Russian Federation, the cultural sphere id developing and flourishing. Ukraine tends to overcome the economic crisis, while cultural sector is being transformed to meet the modern demands, to secure the diversity of the cultural expressions and to create the integrated cultural space in the country.

In late 2014, Ukraine ratified the Ukraine–European Union Association Agreement which entered into force on September 1, 2017. The Agreement includes the separate chapter 24 “Culture” with 4 articles, which give the list of obligations of the sides in the field of culture, including, inter alia, the proper implementation of the UNESCO Convention on the Protection and Promotion of the Diversity of Cultural Expressions of 2005.

In 2016 Ukraine joined the European Union “Creative Europe” programme for support to the culture and audiovisual sectors.The Ukrainian cultural, audiovisual and creative sector got the opportunity to operate across Europe, to reach new audiences and to develop the skills needed in the digital age, also contributing to safeguarding cultural and linguistic diversity.

In 2017 the Ukrainian Cultural Foundation (UCF) was set up with the aim to provide the equal access to funding for the governmental and non-governmental institutions, to overcome the gap between them and to free the Ministry of Culture from the extrinsic function of spreading the money between the cultural actors. The UCF is aimed at facilitating the creation of modern Ukrainian competitive cultural and artistic projects. Expert selection, funding and monitoring of the cultural projects, supported by the UCF are the key tasks of the Foundation.

In 2017 the Cultural Leadership Academy - the educational programme aimed at cultural managers training and continuing education was introduced.

In 2017 the Concept “Decentralization: sector Culture” was also presented setting up the strict indicators of the decentralization reform in Ukraine in the cultural sector. This enabled to develop a roadmap for the further decentralization in the cultural sphere and to involve the regions, cities and towns as well as the communities into the process.

The outstanding feature of Ukraine is the deep respect for the ethnic, confessional and cultural peculiarities of its citizens. The State of Ukraine keeps the tradition of peaceful coexistence of all the nations’ representatives, constantly taking care of their rights protection.

Describe the multi-stakeholder consultation process established for the preparation of this report

The Ukrainian Center for Cultural Studies, authorized by the Ministry of Culture of Ukraine for the scientific support of the implementation of 2005 Convention, has held a series of communicative events with the key stakeholders on the national, regional and local levels, including the consultations with the civil society, in order to summarize the information and statistic data on the implementation of the Convention.

Overview of Cultural Policy Context

Parties shall describe the key objectives and priorities of their current cultural policy and the impact the Convention has had in their formulation or reformulation. They will also report on the opportunities and challenges to promote the diversity of cultural expressions in a digital environment.:

The key objective and priority of the current cultural policy of Ukraine is to acknowledge the exceptional role of culture in the economic and social transformations in the country, and its power in resisting the external and internal threats and challenges.

Culture is considered as the foundation for the groundbreaking changes in the State. Art and culture in general play a significant role in the society consolidation and securing its values. The Ukrainian Government has the aim to re-position the culture in the state policy, to confirm its role in the sustainable development of the society and each individual.

With this in mind the institutional capacity of the cultural management has been strengthened. First of all the functional audit of the Ministry of Culture was held in order to make it more effective in the elaborating and implementation of the flexible and impactful cultural policy. In the framework of the public administration reform new Directorates have been created - the Directorate for the strategic planning and Eurointegration, Directorate for the language policy and the Directorate for the Creative Industries.

The scientific institutions under the Ministry of Culture of Ukraine have been also reformed. That allowed them to implement their tasks in a more efficient way by giving them wider scope of functions and activities.

The other landmark reform was implemented in the cultural institutions – the Law of Ukraine introduced the Contractual Employment in Cultural Sphere and Competitive Selection of Heads of State and Municipal Cultural Institutions – adopted on January 28, 2016 in order to refresh the top management of state and municipal cultural institutions in accordance to transparent competitive selection and implementation of contractual employment of artists, which gives the wider range of artists to realize their creative potential.

The civil society and experts are widely involved in the cultural policy shaping process. There are more then 10 consultative-advisory boards on the different cultural policy directions under the Ministry of Culture of Ukraine. This secures the transparency and the high professional level of the political decisions in the sphere of culture.

One of the main policy directions in the cultural sector is the artistic education. It is for the first time ever in the independent Ukraine when the provisions regarding the artistic education were included into the educational legislation. The provisions of the new law with respect to the artistic education are extremely important for the future development of art in Ukraine, as they define the artistic education as a comprehensive, multilevel system with interrelated elements, emphasizing its specific nature. Besides, the new law set up the term Doctor of Arts.

Culture is considered as a sphere where the public competences are elaborated, as a space for wider communication, as a soft power and a way to increase the Ukrainian presence on the international stage and as a driver for sustainable development

The Convention has already been implemented in numerous legislative acts, while including the obligations regarding the implementation of the Convention into Ukraine-EU Association Agreement has promoted including the provisions of the Convention into the European Integration Action Plans. Besides, the active development of the cultural and creative industries, cinematographic and audiovisual sector was preconditioned by the development of different policy instruments oriented on the implementation of the Convention

How?

The Convention is always an axis in the policy discussions in the cultural and creative sector. The Ministry of Culture of Ukraine in 2017 launched the Annual International Forum ‘Creative Ukraine’, a platform for political and expert discussion on the development of state policy in the field of cultural and creative industries (CCI). Promoting cooperation between government, civil society and businesses, the Forum aims to enhance public-private cooperation in the field of CCI at national and regional levels and to gather international experts on the creative economy, creative professions and culture policymakers from all over Europe.

The Convention is on the agenda of all the communicative events on the European Integration and people-to-people contacts, as well as on the national minorities issues, held in Ukraine .

The Law of Ukraine “On the state support for the cinematography in Ukraine” adopted in 2017 defines the framework of the state support of the cinematography in Ukraine in order to create advantageous conditions for the film-making industry and establish transparent procedures of project financing by the state. The law accumulates the best and most efficient mechanisms and instruments tested in different European countries. The specially created working group elaborates the by-laws necessary for the proper implementation of the Law..

The Law provides the transparent state support for the film industry with the aim of promotion of the Ukrainian cinema on TV.

The law foresees the direct State support for the film industry, cash rebate, development of cinema and film distribution network, that will allow to make the commercial films breakeven, anti-piracy measures. The Law changes the approaches for the state financing in the sphere of cinematography and creates the efficient mechanisms of attraction of private financial resources to the film industry, including with the fiscal support of the sphere.

The foundation of the Ukrainian Book Institute was caused by the intention of the Ministry of Culture of Ukraine to intensify the development of book industry as one of the main parts of the creative industries, and to establish an institution responsible for the implementation of the state policy in this sphere, promote reading, support publishing, stimulate the literary translations and to promote Ukrainian literature abroad

Ukrainian Book Institute was founded in 2016 as a state-run institution under the Ministry of Culture. The Institute has 6 main programmes:

It is expected that the measure will facilitate the establishment of national and international networks of partnership; enlargement of reading audience in the country ; digitalization of the Ukrainian literature; increase in number of books of Ukrainian authors translated into other languages etc. Besides, the Ukrainian Book Institure is responsible for the presentation of the Ukrainian bokkselling and publishing industry on the international book fairs, such as Frankfurt International Book Fair, Leipzig International Book fair, London Book Fair and many others, which will contribute to the presentation of the Ukrainian culture abroad as well as to the development and internationalization of the Ukrainian literature through establishing long-term partnerships

The main objective for the establishment of the Ukrainian Cultural Foundation was the intention to create favourable conditions for creative activities; provide support to research and studies related to culture and creative industries; promote intercultural dialogue and cultural diversity; develop of children’s and youth creativity; promote the innovations and digitalization of culture; support activities aimed at preservation and actualization of cultural heritage.

In 2017 the Law of Ukraine “On the Ukrainian cultural foundation” was adopted by Ukrainian Parliament to introduce new mechanisms for result oriented and competition-based state funding for initiatives in the field of culture and creative industries in Ukraine. Ukrainian Cultural Foundation as a state-run institution under the Ministry of Culture provides support in a form of grants to all types of organizations.

The Ukrainian Cultural Foundation provides the equal access to funding for the governmental and non-governmental institutions, allows to overcome the gap between them and to free the Ministry of Culture from the extrinsic function of spreading the money between the cultural actors.

Priorities of UCF activities are:

To create favourable conditions for creative activities, partnership development and formation of common values of the civil society in Ukraine

Council of the Ethno-National Organizations of Ukraine

Context of the measure:

b. Key objectives of the measure:

The Ministry of Culture of Ukraine as the main Governmental institution responsible for the national minorities and religious issues is in the constant interaction with the national minorities NGOs and involves them on the regular basis to the policy making process. The minorities’ rights protection and the securing of their cultural and social rights are one of the priority tasks of the Government of Ukraine as well as the Ministry of Culture of Ukraine, that is why the Ministry of Culture is focused on the search of the most efficient means of communication, cooperation and policy making process in the sphere of the ethno-national policy. In close interaction with the national minorities’ NGOs it was made a decision to create a consultative body under the Ministry, which unites the efforts of the most authoritative and representative NGOs of the national minorities. The strategic goal is to draft and adopt the policy decisions on the development of the ethnic, cultural, language and religious distinctness of the national minorities and to secure the protection of the cultural diversity, peace and tolerance in the society.

Creation of the Council of the ethno-national organizations of Ukraine is aimed at elaborating the well-reasoned suggestions on the mechanisms of the implementation of the State ethno-national policy, which should guarantee and secure the ethno-political unity and interethnic peace in the society, protection and promotion of the cultural uniqueness of the Ukrainian people, national minorities on the basis of the human and citizen rights.

The members of the Council are 5 heads of the umbrella national minorities associations , which represent the interests of different national minorities NGOs, and the heads of the special consultative bodies on the national minorities issues under the Ministry of Culture and the Ministry of Education and Science

State Company “Crimean House”

b. Key objectives of the measure:

After the illegal occupation of the Autonomous Republic of Crimea by the Russian Federation in 2014 there arose a need to strengthen the protection of the rights of the Crimean Tatars and other peoples living in the Crimea as well as those who was forced to leave their Motherland for the mainland Ukraine.

In 2014 there was made a decision to create a State Company “Crimean House” in Kyiv in order to secure the rights and freedoms of the citizens of Ukraine, including the national minorities and indigenous people on the temporary occupied territory of Ukraine, to facilitate satisfying their cultural, political, informational, educational, scientific and spiritual needs.

The Crimean House is a platform for cultural and human rights advocacy events and initiatives, educational programs, scientific research, a space for discussions of socially important processes and phenomena.

The Crimean House provides everyone, including the internally displaced people, national minorities and indigenous people, with the possibility to hold cultural events (concerts, exhibitions, performances etc.) as well as educational, scientific, communicative and training events (seminars, symposia, conferences, investigations etc.). The Crimean House supports the development of the national traditions and crafts and provides the legal support in the protection of rights of the national minorities, indigenous people and IDPs.

The Crimean House is expected to continue the support for the IDPs from the Crimea, providing them the possibility to realize their rights. In the long-term perspective it is highly anticipated that the projects initiated in the framework of the Crimean House become sustainable, that the scientific and the educational&training work continue and the Crimean House becomes an institution that represents the Crimean-Tatar community in an integrated manner.

Ukraine uses the instrument of signing the bilateral cultural agreements with the aim and intention to strengthen cultural ties and to develop friendly relations between the peoples of two countries, to develop the cooperation in the field of culture and art, in this way promoting the mutual cultural rapprochement, increasing creative potential and creating the background for the exchange of knowledge on cultures of the countries, to raise awareness, particularly among youth, of the history and culture of the people of different countries, to promote the equal dignity of all people’s national cultures and their mutual enrichment while respecting the national identity, to support the aspirations of the artistic&creative community to the preservation and development of creative contacts and protect their social and professional interests

The Government of Ukraine and Ministry of Culture of Ukraine are the side of numerous cultural cooperation agreements with the countries from all over the World. During 2014-2017 Ukraine signed the cultural cooperation agreement on the Governmental level with the United Arab Emirates, on the Ministerial level – with the Republic of Azerbaijan, Georgia, Republic of Estonia, Republic of Cyprus, People’s Republic of China, Republic of Lithuania, Republic of Moldova, Czech Republic, Republic of Belarus. Besides, the Programme on Cooperation between the Government of Ukraine and the Government of the Republic of Turkey in the Field of Culture entered into force in 2015. Agreement on Film Co-production and Cooperation between the Cabinet of Ministers of Ukraine and the Government of the State of Israel was also signed in 2015.

In the modern world the main objective of the international cooperation and cultural diplomacy is not only the export of the cultural product or the promotion of the positive image of the country, but rather the emphasizing of the involvement of the national culture into the live interaction with the others, search for the common values, strengthening of the voice of culture and the mobility of culture and arts

Since 2016 Ukraine represents abroad and develops its publishing and bookselling industry on a whole new level. The Ukrainian Institute is envisaged to become an important tool for Ukrainian cultural diplomacy through ensuring presence of Ukraine on the international cultural stage, in the international projects in the area of culture, education, science, and social life.

The Ukrainian Institute should move in a few directions. The first one is to reach out to non-Ukrainians who live abroad, to help the world get knowledge and comprehension of Ukraine. Several programs are envisioned to accomplish this, some of which are practiced by similar institutions like the British Council, Goethe Institute.Eventually, international travel grants and art residencies will be awarded, exchange programs and research projects will be funded. Close cooperation with the Ministry of Education and Science will enable the Ukrainian Institute to teach Ukrainian and offer certification in order to develop a model for language schools abroad.

United Nations report, Guiding Principles on Internal Displacement uses the definition of the IDPs as "persons or groups of persons who have been forced or obliged to flee or to leave their homes or places of habitual residence, in particular as a result of or in order to avoid the effects of armed conflict, situations of generalized violence, violations of human rights or natural or human-made disasters, and who have not crossed an internationally recognized State border." According to the statistic data, since the beginning in 2014 the military aggression against Ukraine in the Eastern part of the country and the illegal annexation of the Crimea, there are approx. 1.5 million IDPs in Ukraine. The key objective of the strategy is the integration of the IDPs and the long-term solutions for the implementation and protection of their rights, freedoms and legitimate interests of the IDPs, increase of their self-sustainability and independence under due consideration of the interests of hosting communities, establishment of the efficient cooperation between the IDPs and the hosting communities, public institutions, local self-government authorities on the basis of partnership that will lead to the elimination of discrimination and to the achievement of the social cohesion

Unlike any other national minority Roma people do not have their statehood. Roma national minority was the second nation to suffer from the genocide during the World War II. Almost in all the European countries Roma national minority was discriminated and marginalized that has led to the situation when Roma notional minority became one of the most vulnerable in Europe. Integration of Roma people into the Ukrainian society is now a socially important issue. In Ukraine Roma people are settled most compactly in Transcarpathian, Donetsk, Dnipropetrovsk, Odesa, Kharkiv and Luhansk regions. Roma people in Ukraine face the same problems as in the other European countries: low educational level, high unemployment, poor health, absence or lack of documents, low level of living conditions, facts of prejudices against Roma.

The ongoing educational reform in Ukraine influences greatly the future of the artistic education which is without exaggeration the national wealth. During all the years of the Ukrainian independence the artistic education was not the separate issue on the legislative level, being included into the general educational system of the State. In the conditions of the centralized governing it was impossible to recognize the absolutely different and unique features of the artistic education. Lack of the legislative action in this field could destroy the existing system of the artistic in the State.

The national educational reform demanded the new Law on Education, which was widely discussed, scrutinized and finally adopted by the Parliament in 2017.

It is for the first time ever in the independent Ukraine when the provisions regarding the artistic education were included into the educational legislation. Besides, the new law set up the term Doctor of Arts.

The Ministry of Culture of Ukraine has hold approx. 30 communicative events dedicated to the development of the artistic education, involving more than 1000 people, and has drafted the list of regulatory acts.

Ukraine has a great potential of the cultural and creative industries development. According to the “Creative economy outlook 2002-2015” by UNCTAD Ukraine was the second rated country with transition economy in the list of top10 creative goods exporters in 2015. According to the Global Creativity Index (Technology-Talent-Tolerance) by Martin Prosperity Institute in 2015 Ukraine took the 45th place. In 2014 the input of the cultural activities into the GDP was 4.04%.

Development of the creative industries is one of the priorities of the Ukrainian Government.

Creative Europe is the European Union's programme to support the cultural, creative and audiovisual sectors. From 2014-2020, €1.46 billion is available to support European projects with the potential to travel, reach new audiences and encourage skill sharing and development. Creative Europe consists of two sub-programmes: a Culture sub-programme promoting the creative and cultural sectors, and a MEDIA sub-programme supporting the development and distribution of audiovisual works.

Ukraine takes part in the programme since 2016 according to the agreement between the European Union and Ukraine on the participation of Ukraine in "Creative Europe": the Union programme for the cultural and creative sectors, and on cooperation between the European Union and Ukraine in the MEDIA Sub-programme of "Creative Europe".

Young Biennale of Contemporary Art

Is it reasonable to talk about the emergence of a new generation of contemporary Ukrainian art representatives? How have the social processes of recent years influenced the artistic experience of young Ukrainian artists? To what extent the art of young artists is included in the world artistic context? To answer these questions and widely present the work of young Ukrainian artists are the aims of the Festival of Young Ukrainian Artists (Young Biennale)

A large contemporary art project, especially aimed at supporting young artists is a step to demonstrate that contemporary culture has the same weight as historical one. In fact, the youth biennial indicates a reversal of cultural policy in Ukraine. This does not mean that everything is very positive and all the changes are exceptionally positive, but this clearly demonstrates the direction of thought – from purely inertial financing of Soviet models and institutions to attempts to stimulate the emergence of a new.

The Festival of Young Ukrainian Artists is founded by the Ministry of Culture of Ukraine. The Festival is to be realized in Biennial format every two years and to be housed by various Ukrainian cultural institutions.

The Mystetskyi Arsenal National Art and Culture Museum Complex and the National Art Museum of Ukraine were appointed to organize the festival in 2017. They were chosen as institutions that have a successful experience of holding events of such scale and are able to co-finance the Festival.

Ukrainian artists under age 35, with works performed in any kind of media (video, graphic techniques, painting, sound, land art, performative practices, projects for public space, text, sculpture, photography, various types of digital/new media art, as well as other genres, forms and means of artistic production), were invited to participate in the competition.

394 applications from Kyiv, Odessa, Lviv, Lutsk, Uzhgorod, Dnipro, Vinnytsia, Ternopil, Kharkiv, Rivne, Sumy and other cities were submitted to the Festival`s competition. In addition, applications from artists living or studying abroad, namely in Poland, the Netherlands, Austria, Lithuania, Canada, Israel and Italy were recieved. As a result 67 art projects were selected by the Festival on a competitive basis with works that are in tune with the Festival`s topic.

Biennale also has a strong educational component – specially designed training programmes for young artists and curators, for children and representatives of state and public institutions

The consultations with the civil society on policy decisions are enshrined in the Ukrainian legislation. The civil society takes an active part in policy making process by, inter alia, contributing to the law drafting process.

Besides, in 2016 the Civil Society Council was established under the Ministry of Culture. The main goal of this measure was to support the realization of the constitutional right of every citizen to take part in the governance, to facilitate the process of public consultations and taking the opinion of the civil society into account while elaborating the state policy, and to make the cooperation of the Ministry with the civil society more efficient.

Civil Society is very active in promoting the principles of the Convention. In 2014 the Congress of Cultural Activists http://www.culturalactivism.org was founded by the active NGOs in order to facilitate protection and promotion of the Ukrainian culture and creative industries, civil society development and emerging of new creative communities and groups. The Congress is aimed at the development of the cultural activism network through the implementation of the multidiscipline projects in close cooperation with the regions, in order to create the conditions for further positive changes in the cultural sphere.

Among the other numerous civil society initiatives, the OUTLOOK WORLD CULTURE FESTIVAL should be mentioned. The main idea of the Festival, founded in 2013, is to promote the cultures of the foreign countries in Ukraine, to contribute to the development of the multi-culturalism in Ukraine, to raise awareness on the culture of national minorities living in Ukraine and to establishment of the friendly and respectful relations between the different nations.

Besides, taking into account the high relevance for the development of the culture and creative economy in Ukraine a large variety of creative hubs aand creative spaces emerge all over Ukraine, providing for the development of different areas of creative industry and design: 3D, motion picture, sound, fashion, architecture, photo, industrial arts, painting, urban design, object and industrial design.

After the illegal occupation of the Crimea by the Russian Federation the severe human rights violation on the occupied territory became a great concern for the Ukrainian Government and international community, and for the people who were forced to leave their homes. The internally displaces persons’ organizations bring their concern on the protection and safeguarding of the cultural identity of the Crimean-Tatar national minority. The local and regional and national authorities undertook the efforts to give the maximum possible assistance to the process of the integration of the IDPs into the hosting communities, as well as to secure the development of their native cultures.

Achievements and Challenges

Describe main results achieved in implementing the Convention:

During the period 2014-2017, Ukraine made an enormous efforts to protect and promote the diversity of cultural expressions in the conditions of the ongoing military aggression against the country and the illegal occupation of the part of the territory. A lot of legislative, regulatory and financial measures have been undertaken in policy making process.

The contribution of culture to the society development becomes extremely visible. In Ukraine after the Revolution of Dignity we do realize the leading role of culture in uniting people, society consolidation and integrity, diversity promotion, tolerance and personal growth.

Culture and creativity are put in the heart of Governmental agenda as a soft power and an important factor of the sustainable development of the country. Human capital development, the possibility for every citizen of our country to exercise the cultural rights, an equal access to the cultural services and infrastructure, heritage, motivation for creativity – these are the main trends in the implementation of the Convention.

Challenges encountered or foreseen to implement the Convention :

Ukraine is now facing plenty of challenges – some of them are common for all of the countries, as digitalization, globalization, use of culture as the tool of propaganda, but besides there are challenges caused by the military aggression from the Russian Federation. This means that our country puts great energy to stand strong in this war, to protect our civilization choice, at the same time making enormous efforts to develop and move on to the better future.

Among the main challenges in the implementation of the Convention we should mention the need for more flexibility of the cultural sector of Ukraine, its capacity for quick changes and adaptation for the rapidly changing environment, which includes new business-models for creative sector, digitalization, HR-management etc.

Solutions found or envisaged to overcome those challenges:

Ukraine continues to improve the cultural services quality on the local level in the context of decentralization, to create conditions for cultural leadership and management, to apply best practices for creativity motivation and contemporary art development, to improve financial support system.

Ukraine is intent upon further implementation of the provisions of the Convention. The project “Ukrainian East” is designed and launched to combine the efforts of the State, local authorities and communities, and the civil society on the integration of the Ukrainian society and IDPs.

Ukraine plans to further develop the creative industries through the variety of measures, including the legislative regulations, communicative policy-making events, financial stimulation.

Ukraine will undertake measures for the successful implementation of the decentralization in the cultural sector. In the process of decentralization the local authorities and communities get wider resources and powers, whilst obtaining the responsibilities for the sustainable development of the community, including the cultural aspect. The decentralization has increased the role of culture in the life of every community. The cultural peculiarities are now perceived as a resource for the economic growth through the development of art, crafts, tourism.

The main task for the Government is to secure the existing network of the cultural institutions and to promote its sustainable development through modernization of cultural services.

Steps planned for the next 4 years:

The further implementation of the Convention will be considered in the plans and priorities of the Ministry of Culture of Ukraine. The Ministry will continue to realize the already launched projects and measures, and will take a special care on the cultural development of the country. It is expected to continue to support the creative industries, to improve the cultural management on the regional and local level, to secure the quality of the cultural services, to guarantee the cultural rights of IDPs, national minorities and disabled people, to modernize the cultural education, to promote international cooperation, to develop libraries, publishing and bookselling industry etc.

Civil society organizations, will be actively involved in these actions. The Government will strengthen the dialogue between the policy makers, civil society and other national, regional and local authorities and institutions.

Ukraine is determined to further implement the Ukraine-EU Association Agreement thus promoting cultural cooperation in order to enhance mutual understanding and foster cultural exchanges, as well as to boost the mobility of art and artists; encourage intercultural dialogue between the individuals and organisations representing organised civil society and cultural institutions.
