National Policy for Culture”

Context of the measure: 
CULTURAL POLICIES AND MEASURES
b. Objetivos clave de la medida: 

During the development of the National Policy for Culture (NPC), a special attention has been paid to UNESCO 2005 Convention and its principles of inclusiveness of cultural diversity and development of cultural industries during the development processes.

The main objectives of the NPC, which was approved by the Royal Government of Cambodia in 2014, are to promote cultural values and to strengthen the role of the cultural sectors in the country’s development objectives and the contribution of creative industries to its economy. This NPC is considered as a national vision along with strategic priorities, which serve as guidelines for short, medium, and long term development of measures and actions that lead to promote the role of culture within the framework of overall government policy. It was developed with emphasis on culture in the spirit of the 2005 Convention aiming to provide stronger legal bases and to open wider cultural horizon for enabling environment for development of higher quality cultural good and services in Cambodia by dialoguing with relevant partners to ensure a diversity of cultural services and their accessibility.

Given the strategic importance of the Cultural Policy for Cambodia in the achievement of its development goals and the national objectives, other relevant ministries were invited for their inputs and active participations in the process, namely the Ministry of Education, the Ministry of Tourism, the Ministry of Commerce, the Ministry of Industry, Mines and Energy, Ministry of Rural Development and the Ministry of Agriculture, Forestry and Fishery.

The NPC was developed in accordance with the UNESCO framework particularly the 2005 Convention to address the links between culture and development by integrating aspects such as education, environment, science, media and health, supporting the improvement of quality of life by involving an inclusive approach, the promotion of public private and public civil partnerships. This important document has served as key guidelines for development of measures and mechanism to promote arts and culture nationally and internationally while the periodic reporting is an opportunity for re-evaluating and re-thinking policy and measures – taking into consideration their feasibility and acceptability for the society. 

It also opens for wider dialogues between government’s institutions and civil societies through Arts Forum. The recent Arts Forum organization was directly a result from the implementation of the 2014 Cambodian National Policy for Culture as agreed during the Road Map discussions by all cultural partners involved. The first Arts Forum was taken place in September dedicated to “Creative Industries in Cambodia”, meaning those industries that have their origin in individual creativity, skill and talent with a potential for wealth and job creation through the generation and exploitation of intellectual property in different disciplines (visual arts, film, design and crafts, music, dance, theatre, literature,  publishing, television and broadcasting services:..). These are linked to a growing creative economy, highly transformative and creating new social and cultural links.

e. What are the results expected through the implementation of the measure?: 

The document and its implementation enable for more of Cambodia’s creative sectors such as cinema, music, fashion, design, etc. to increase, and also encourage the Government’s agencies and full participations of artists, art organizations and civil society to start dialoguing. This situation represents an opportunity to capitalize on the potential of the culture sector by sustaining it with the appropriate means, and to link culture to Cambodia’s development strategies. It is also an opportunity to provide a framework for development of action plans for the cultural sector, to recognise culture as a key sector for Cambodia due to its strategic importance for: economic and social development, strength the national identity of Cambodia in its diversity, maintain traditional knowledge and forms of work as forms of sustainable development as part of recognition of creative industries, and identification of means and objectives. It also contributes to the Government’s Rectangular Strategy and the national objectives by:

-          increasing the role of culture in public activities moving up culture in the Government’s agenda,

-          facilitating a global view of the cultural sector in Cambodia that will allow to develop unified strategies and action plans for the government at a central and provincial level,

-          engaging with other Ministries, providing a unified vision of culture for the nation by setting the bases for discussion and agreement with other Ministries about the key issues affecting the economic and social development of the country,

-          involving all in an inclusive and welcoming way, taking into special consideration the needs and diversity of indigenous peoples and the provision of opportunities for the younger generations,

-          providing planning for sustainable setting of priorities, and

-          recognising stakeholders, engaging agents in public-private partnerships, and creating alliances among the main actors.

MCFA also has finaincial challenges. However it has tried to allocate as much as its can through the involved departments of Ministries. The Governement is full aware of the need for financing through open public call, which was the main one, expressed by private actors and civil society of the Cambodian cultural Creative Sector in order to facilitate their initiatives: finance for creative efforts, for travels as well as insurance to artists. The MCFA in collaboration with Ministry of Finance has developped a mechanism to support the artists and art organization through assistance of free tax for imports and exports of art equipment.

Promotion of Film Industries

Context of the measure:

In the Royal Government’s National Strategic Development Plan 2014-2018 clearly indicates plans for promoting film industries in Cambodia through making Cambodia a welcoming destination of the foreign film shooting, developing human resource in film sector; increasing facilitation for film production through “One Stop Service” and preserving urban heritage as important assets of Cambodia’s cultural landscape inspiring tourism, cinema, art creation and investments.

The Royal Government has also promoted high quality local film productions by yielding 2 hours prime time for local film screening in the national television networks. Such stimulation will promote Cambodian film quality and its film regional and international levels.

Through the Department of Cinema and Cultural Diffusion of MCFA along with other Filming organizations such as Bophana Center and Cambodian Film Commission, film industries in Cambodia have surged both for local film production and foreign film production in Cambodia. There are significant establishments and policies have set forth:

-Establishment the Khmer Arts Foundation

-Supporting for the creation of film and promote

-Amendment the Sub Decree on the Management of Film Industry

-Establishment the Sub Decree on the Cambodia Film Development Center (CAMFIC) as a public administration (in process)

-Implementation of copyrights and related rights for film products: pirated cds and dvds are confiscated and destroyed. 

-Encouraging the official film co-production

-Cambodia-French Film Co-Production Treaty (2013)

-Build the Cambodia Cinema Studio

-Human Resource development in film industry: about 500 people were trained in capacity building for film management and technical trainings including camera, lighting, grip and artistic.

 -Film Festivals:  Cambodia National film festival, Cambodia International film festival, Chatomuk Short Film Festival and Cambodia National Short Film Festival.

Local production of movies and music will remarkably surface in order to complete with the regional and international film industries. Up to date, there are 75 film productions registered. In 2015, 29 films produced in Cambodia. In 2014, there were 64 film projects shooting in Cambodia:

12 projects from France, 6 from USA, 15 from Japan, 4 from Australia, 5 from Thailand, 5 from Canada, 5 from Asia, and 12 from Europe.  

The number of the standard movie theatres are also boosting: in Phnom Penh, there are 8 movie theatres and 9 theatres in the provincial towns featuring both local films and imported films.

This measure is to help boosting and encouraging artists and art organizations to smoothly run their businesses with the support from Governement i.e. MCFA. It also  promotes their work nationally and internationally by endorsing or helping to facilitate for free imports or exports of equipment inside and outside of Cambodia as well as support for processing legal documents, which is in line with Government’s policy “Government provides necessary support and private sectors execute their businesses.”

Protection of Creativities, Copyright and Related Rights

In 2003, the Law on Copyright and Related Right were promulgated in order to support and protect creativities. It also allows creators to legally protect their works and get compensatory remuneration for their work. The law and its implementation also encourage new creativities in Arts and Culture as well. To implement the laws, MCFA set up a Department of Copyright and Related Rights which is fully in function todate.

The Law on Copyright and Related Rights ensures proper protection of copyright and related rights by raising respects of the society towards intellectual property and taking tough measures towards illegal uses. Proper implementation would lead to increase creativity and rightful dissemination of results of creative work, respect for intellectual property, and  enable more favourable conditions for the development and visibility of the Cambodian creative industries taking into account new digital technologies and their impacts on methods of creative expression and the dissemination, as well as social needs related to the development of the rightful digital accessibility of creations. Creators and producers would be significantly benefited from their creation and production.

Up-to-date, quite a remarkable number of producers and authors started to register their work with ministry’s Department of Copyrights and Related Rights.

The measure is to encourage the co-production between Cambodian Film Production companies and other foreign film production companies. In 2013 Cambodia has signed a Cambodia-French Film Co-Production Treaty. Oscar winning director Regis Wargnier shot the GATES in Cambodia which marks the first official French-Cambodian co-production after setting up of a bilateral treaty in 2013.

Seasons of Cambodia Festival: a unique initiative by Cambodian Living Arts, brought over 125 artists from Cambodia to New York City for a major celebration of Cambodian arts, culture and humanities. Distinctive works from over 125 masters and emerging artists and scholars – in ritual, music, visual art, performance, dance, and show puppetry, film, and academic forums – were presented by more than 30 of New York’s most renowned arts and educational institutions, marking an unprecedented city-wide initiative to celebrate one of the world’s most vibrant and evocative cultures. The festival celebrated Cambodia’s artistic renaissance just one generation after the Khmer Rouge regime (1975 – 1979) and reflected on how important the arts have been in the country’s transformation. Season of Cambodia serves as an international platform that not only highlights the extraordinary resilience of the Cambodian nation and its artists, but also help pave the way for other post-conflict nations seeking renewal through artistic expression.

The Season of Cambodia in New York was a very successful one. This success will inspire more of such festival and also help more artists and showcase of Cambodia arts and creative work as well.

It is an overall Cambodian policy to encourage foreign filming companies to come and shoot in Cambodia. Cambodian government will help endorsing or providing administrative supports for the filming such free import of filming equipment to Cambodia. We noted that in 2015,  67 foreign film projects were shot in Cambodia: 2 Feature Film, 15 TV Series, 43 Documentaries, 1 Music Video, 6 TV Program.

More foreign film will come to film in Cambodia and thus creates more jobs for both local film companies and local people. Moreover, Cambodia is more known to the world.

Raising competences of film workers (cameraman & sound professionals, etc.) and other related craftsmen engaged in film industry (from catering to driving and other services)

With the generous support from SIDA, Sweden, a 3 day workshop on Quadrennial Periodic Reporting led by two UNESCO Experts, was designed for capacity building for representatives from relevant ministries and art organizations was held from March 28-31, 2016 at Sunway Hotel, Phnom Penh. Subsequently, consultative meetings among members of the national team have been organized at the MCFA to discuss the outcomes of the findings.

Capacities in understanding the Convention 2005, and its measures are raised among officers of MOCFA, other related ministries, but also among art practitioners and civil society.

Now Cambodian Ministry will be able to do quadrennial reporting for the next cycle on its own, engaging resources and collaborators from other ministries and civil society. There will also be reporting mechanism set up for the next cycle.

The Royal Government of Cambodia recognized that the Rectangular Strategy for Growth, Employment, Equity and Efficiency is still crucial and suitable for Cambodia to pursue its implementation by keeping the four angles, expanding the coverage, and prioritizing the policies and mechanisms to be more concrete as the Rectangular Strategy Phase III, which ensures development, sustainability and poverty reduction in response to the aspirations of the people and both national and international new contexts. In its National Strategic Development Plan 2014-2018 a development framework and a road map for the implementation of Rectangular Strategy Phase III that lays out the political commitment to a socioeconomic development process. It outlines visible and realistic actions, programmes and projects that strive to make its people educated and healthy, living in harmony within the family and society. Its puts forth the principal of aim of maintaining peace, political stability, security and social order to promote rule of law and protect human rights and dignity, sustainable long-term equitable economic growth and increased outreach, effectiveness, quality and credibility of public services. Cultural sector also plays very important role in this context. Aims of National Strategic plan related to culture are to Increase education particularly the education amongst youth and children so that they understand very clearly the superb value of Cambodian culture, tradition, and customs which are the identity symbols of Cambodian nation and so they participate to preserve, promote, develop this national culture and to reduce the negative impact from the foreign cultures. The MOCFA will continue ensuring preservation and sustainable development of built living heritage, including archaeological urban and underwater heritage, traditional performing arts, minority traditions and arts, museums as well as the fight against illicit trafficking of cultural artefacts and will actively promote creativity in the domain of arts, cultural industries and cultural entrepreneurship.

The important contribution the cultural sector can make to achieve the national objectives and the increasing number of actors in the Cambodian cultural sector makes it necessary to implement mechanisms to improve work in partnerships and coordination of efforts. Often initiatives could have a higher impact if they would receive additional support from public institutions at national and local level and often best practices experiences learnt in one area of the country could be relevant in many others. In addition, the implementation of the Cultural Policy requires partnership working models that in time of scarce resources aid to avoid duplication of efforts, reaching efficiency.

During the September Arts Forum, MCFA received important recommendations: 

  1. A focal point be nominated by the MCFA in order to coordinate with the cultural CSOs, civil society and private sector in line with the one-window service policy in the field of culture.
  1. A flexible Cultural Task Force, coordinated by the MCFA and UNESCO, be informally established in order to regularly discuss various specific topics related to cultural sector that would include representatives of the public sector, CSOs and private sector.

During the development of the National Policy for Culture (NPC), a special attention has been paid to UNESCO 2005 Convention and its principles of inclusiveness of cultural diversity and development of cultural industries during the development processes.

The main objectives of the NPC, which was approved by the Royal Government of Cambodia in 2014, are to promote cultural values and to strengthen the role of the cultural sectors in the country’s development objectives and the contribution of creative industries to its economy. This NPC is considered as a national vision along with strategic priorities, which serve as guidelines for short, medium, and long term development of measures and actions that lead to promote the role of culture within the framework of overall government policy. It was developed with emphasis on culture in the spirit of the 2005 Convention aiming to provide stronger legal bases and to open wider cultural horizon for enabling environment for development of higher quality cultural good and services in Cambodia by dialoguing with relevant partners to ensure a diversity of cultural services and their accessibility.

Given the strategic importance of the Cultural Policy for Cambodia in the achievement of its development goals and the national objectives, other relevant ministries were invited for their inputs and active participations in the process, namely the Ministry of Education, the Ministry of Tourism, the Ministry of Commerce, the Ministry of Industry, Mines and Energy, Ministry of Rural Development and the Ministry of Agriculture, Forestry and Fishery.

The NPC was developed in accordance with the UNESCO framework particularly the 2005 Convention to address the links between culture and development by integrating aspects such as education, environment, science, media and health, supporting the improvement of quality of life by involving an inclusive approach, the promotion of public private and public civil partnerships. This important document has served as key guidelines for development of measures and mechanism to promote arts and culture nationally and internationally while the periodic reporting is an opportunity for re-evaluating and re-thinking policy and measures – taking into consideration their feasibility and acceptability for the society. 

It also opens for wider dialogues between government’s institutions and civil societies through Arts Forum. The recent Arts Forum organization was directly a result from the implementation of the 2014 Cambodian National Policy for Culture as agreed during the Road Map discussions by all cultural partners involved. The first Arts Forum was taken place in September dedicated to “Creative Industries in Cambodia”, meaning those industries that have their origin in individual creativity, skill and talent with a potential for wealth and job creation through the generation and exploitation of intellectual property in different disciplines (visual arts, film, design and crafts, music, dance, theatre, literature,  publishing, television and broadcasting services:..). These are linked to a growing creative economy, highly transformative and creating new social and cultural links.

The document and its implementation enable for more of Cambodia’s creative sectors such as cinema, music, fashion, design, etc. to increase, and also encourage the Government’s agencies and full participations of artists, art organizations and civil society to start dialoguing. This situation represents an opportunity to capitalize on the potential of the culture sector by sustaining it with the appropriate means, and to link culture to Cambodia’s development strategies. It is also an opportunity to provide a framework for development of action plans for the cultural sector, to recognise culture as a key sector for Cambodia due to its strategic importance for: economic and social development, strength the national identity of Cambodia in its diversity, maintain traditional knowledge and forms of work as forms of sustainable development as part of recognition of creative industries, and identification of means and objectives. It also contributes to the Government’s Rectangular Strategy and the national objectives by:

-          increasing the role of culture in public activities moving up culture in the Government’s agenda,

-          facilitating a global view of the cultural sector in Cambodia that will allow to develop unified strategies and action plans for the government at a central and provincial level,

-          engaging with other Ministries, providing a unified vision of culture for the nation by setting the bases for discussion and agreement with other Ministries about the key issues affecting the economic and social development of the country,

-          involving all in an inclusive and welcoming way, taking into special consideration the needs and diversity of indigenous peoples and the provision of opportunities for the younger generations,

-          providing planning for sustainable setting of priorities, and

-          recognising stakeholders, engaging agents in public-private partnerships, and creating alliances among the main actors.

MCFA also has finaincial challenges. However it has tried to allocate as much as its can through the involved departments of Ministries. The MCFA in collaboration with Ministry of Finance has developped a mechanism to support the artists and art organization through assistance of free tax for imports and exports of art equipment.

Promotion of Film Industries

In the Royal Government’s National Strategic Development Plan 2014-2018 clearly indicates plans for promoting film industries in Cambodia through making Cambodia a welcoming destination of the foreign film shooting, developing human resource in film sector; increasing facilitation for film production through “One Stop Service” and preserving urban heritage as important assets of Cambodia’s cultural landscape inspiring tourism, cinema, art creation and investments.

The Royal Government has also promoted high quality local film productions by yielding 2 hours prime time for local film screening in the national television networks. Such stimulation will promote Cambodian film quality and its film regional and international levels.

12 projects from France, 6 from USA, 15 from Japan, 4 from Australia, 5 from Thailand, 5 from Canada, 5 from Asia, and 12 from Europe.  

The number of the standard movie theatres are also boosting: in Phnom Penh, there are 8 movie theatres and 9 theatres in the provincial towns featuring both local films and imported films.

Distinctive works from over 125 masters and emerging artists and scholars – in ritual, music, visual art, performance, dance, and show puppetry, film, and academic forums – were presented by more than 30 of New York’s most renowned arts and educational institutions, marking an unprecedented city-wide initiative to celebrate one of the world’s most vibrant and evocative cultures. The festival celebrated Cambodia’s artistic renaissance just one generation after the Khmer Rouge regime (1975 – 1979) and reflected on how important the arts have been in the country’s transformation. Season of Cambodia serves as an international platform that not only highlights the extraordinary resilience of the Cambodian nation and its artists, but also help pave the way for other post-conflict nations seeking renewal through artistic expression.

With the generous support from SIDA, Sweden, a 3 day workshop on Quadrennial Periodic Reporting led by two UNESCO Experts, was designed for capacity building for representatives from relevant ministries and art organizations was held from March 28-31, 2016 at Sunway Hotel, Phnom Penh. Subsequently, consultative meetings among members of the national team have been organized at the MCFA to discuss the outcomes of the findings.

Capacities in understanding the Convention 2005, and its measures are raised among officers of MOCFA, other related ministries, but also among art practitioners and civil society.

Now Cambodian Ministry will be able to do quadrennial reporting for the next cycle on its own, engaging resources and collaborators from other ministries and civil society. There will also be reporting mechanism set up for the next cycle.

The Royal Government of Cambodia recognized that the Rectangular Strategy for Growth, Employment, Equity and Efficiency is still crucial and suitable for Cambodia to pursue its implementation by keeping the four angles, expanding the coverage, and prioritizing the policies and mechanisms to be more concrete as the Rectangular Strategy Phase III, which ensures development, sustainability and poverty reduction in response to the aspirations of the people and both national and international new contexts. In its National Strategic Development Plan 2014-2018 a development framework and a road map for the implementation of Rectangular Strategy Phase III that lays out the political commitment to a socioeconomic development process. It outlines visible and realistic actions, programmes and projects that strive to make its people educated and healthy, living in harmony within the family and society. Its puts forth the principal of aim of maintaining peace, political stability, security and social order to promote rule of law and protect human rights and dignity, sustainable long-term equitable economic growth and increased outreach, effectiveness, quality and credibility of public services. Cultural sector also plays very important role in this context. Aims of National Strategic plan related to culture are to Increase education particularly the education amongst youth and children so that they understand very clearly the superb value of Cambodian culture, tradition, and customs which are the identity symbols of Cambodian nation and so they participate to preserve, promote, develop this national culture and to reduce the negative impact from the foreign cultures. The MOCFA will continue ensuring preservation and sustainable development of built living heritage, including archaeological urban and underwater heritage, traditional performing arts, minority traditions and arts, museums as well as the fight against illicit trafficking of cultural artefacts and will actively promote creativity in the domain of arts, cultural industries and cultural entrepreneurship.

e. What are the results expected through the implementation of the measure?: 

Improving the performing arts promotion and dissemination to strengthen the positioning of Cambodia as a Cultural destination: Maintain traditional knowledge and forms of work as forms of sustainable development as part of the recognition of creative industries. Safeguard of traditional performing arts and promote of creativity, contemporary works and innovation through the arts and creative industries. In order to create market for art and cultural products, there needs to be access and awareness. Promotion and dissemination of performing arts and creativity in order to connect products and customers that the government will address in this regard.

Arts Forum

Context of the measure: 
INTEGRATION OF CULTURE IN SUSTAINABLE DEVELOPMENT - AT INTERNATIONAL LEVEL

Arts Forum is to promote the required dialogue and coordination of actions and strategies regarding the Cultural Policy for Cambodia and the future of the sector. The MCFA will lead the Arts Forum on regular basis wishing to invite participants from public institutions at national and provincial level including representatives from the MCFA and other Ministries, private companies and cultural entrepreneurs, arts associations, NGOs and international initiatives.

MCFA with generous support from SIDA, Sweden and UNESCO had organized its first Arts Forum in September 2016 by inviting various private art organizations to speak and debate on theme, “Creative industries in Cambodia.”

The MCFA will lead the Arts Forum on regular basis wishing to invite participants from public institutions at national and provincial level including representatives from the MCFA and other Ministries, private companies and cultural entrepreneurs, arts associations, NGOs and international initiatives to share their best practices and concerns in order to develop a future cultural policy and strategies for all.

The important contribution the cultural sector can make to achieve the national objectives and the increasing number of actors in the Cambodian cultural sector makes it necessary to implement mechanisms to improve work in partnerships and coordination of efforts. Often initiatives could have a higher impact if they would receive additional support from public institutions at national and local level and often best practices experiences learnt in one area of the country could be relevant in many others. In addition, the implementation of the Cultural Policy requires partnership working models that in time of scarce resources aid to avoid duplication of efforts, reaching efficiency.

During the September Arts Forum, MCFA received important recommendations: 

  1. A focal point be nominated by the MCFA in order to coordinate with the cultural CSOs, civil society and private sector in line with the one-window service policy in the field of culture.
  1. A flexible Cultural Task Force, coordinated by the MCFA and UNESCO, be informally established in order to regularly discuss various specific topics related to cultural sector that would include representatives of the public sector, CSOs and private sector.
  2. An Arts Forum be organized annually with all relevant stakeholders

Ministry of Information (MOIn) will pursue 3 prioritized policies:
- Expanding the delivery of quality information, educational and entertaining programs to 85-95% population in the country.
- Encouraging use of press freedom and freedom of expression such that it is in line with the principles of a pluralistic democracy, the rule of law, and protection of human rights and dignity.
- Contributing to preserving and upholding the culture and tradition to enhance national identity and the prestige of the country in the international arena.

Notably, within Film Department there is a procedure for film-makers to obtain licence to shoot, and later licence to broadcast and project their movies.

Quality information, educational and entertaining programs are delivered to the people.
