Abstract:

Ce livre réunit les actes du séminaire international sur "Le Patrimoine Culturel Immatériel. Définitions et systèmes de catalogation", réalisé à Murcia le 15 et 16 février 2007. Le but du séminaire était celui de diffuser les résultats des études réalisées par les membres du projet MEDINS autour du patrimoine culturel immatériel. Le projet MEDINS, duquel fait partie la région de Murcia, est un projet qui associe plusieurs pays de la Méditerannée et dont le but est celui de mettre en place des actions concernant la connaissance, la valorisation et la sauvegarde du Patrimoine Culturel Immatériel concernant la région de Murcia ainsi que l'espace culturel méditérannéen. Le projet MEDINS cherche également à établir des modèles de bonnes pratiques au niveau local et transnational qui puissent être mis en oeuvre en Europe et qui puissent soutenir les initiatives actuelles de l'UNESCO. La région de Murcia est reconue par son éxpérience en termes de catalogation et de registre d'éléments faisant partie du patrimoine immatériel.

Abstract:

In the United States, the policy of localism – the legislative goal of fostering local community expression and competence to deliver local content – finds its home in the Telecommunications Act rather than either the Copyright Act or Trademark Act. Other nations have introduced values of localism into trade policy, content distribution rules, and international efforts to protect intangible cultural heritage and expressions of folklore. Jurisdictions in every continent are struggling to address the pressures of globalism through efforts to protect indigenous peoples’ and minority communities’ languages and culture. These efforts take many forms. Nations have introduced efforts to protect these interests into trade policy, content distribution rules, and the legal regimes of copyright and trademark. Some jurisdictions, for example, emphasize the need for historical preservation of particular culture and content. Other jurisdictions emphasize localism to promote domestic employment and economic growth. At the same time, however, other regulators are cloaking governmental censorship under the guise of protectionism. These efforts assume, arguendo, that some model of protectionism is necessary to assist these communities. Because there are many different types of intangible cultural heritage – local languages, tribal customs, religious traditions, folklore, styles of artworks, etc. – this assumption may be counterproductive. Particularly in our increasingly networked, global information community, assumptions of territorial protections must be reconsidered. This article reviews the underlying societal imperatives reflected in a policy of intangible cultural heritage and the intellectual property-like regimes being developed to protect these interests. It contrasts UNESCO efforts with more narrowly tailored efforts of WIPO and juxtaposes those approaches with the localism model developed under the FCC. While aspects of the WIPO protection efforts focusing on trademark-like and trade secret-like protections benefit the people and cultures these policies hope to serve, additional copyright-like protections will likely do more harm than good. Instead, global public policy will be far better served through emphasis on localism’s attributes of developing human capital to improve the quality of content being produced and encouraging local communities to focus on the content of their own choosing.

Abstract:

Cette étude s’inscrit dans la foulée du rapport intitulé État des lieux du patrimoine immatériel : les traditions culturelles du Québec en chiffres (CQPV, 2014), qui contient notamment une section sur les organismes en patrimoine vivant, ainsi que du rapport portant sur La danse traditionnelle québécoise (2016). Plusieurs définitions de l’art populaire ont été proposées dans la littérature dans les dernières décennies. Nous avons laissé le soin aux principaux acteurs de ce sous-secteur de définir eux-mêmes leur pratique dans la mesure du possible. Les résultats du présent rapport représentent mutatis mutandis des indications utiles pour une compréhension améliorée de l’art populaire et de sa (ou ses) définition(s). Les activités des organismes ou des sculpteurs qui ne se définissent pas comme sculpteur d’art populaire ou qui ne correspondent pas à la définition de ce sous-secteur prise dans sa plus large acception n’ont pas fait l’objet de l’enquête. Le travail d’individus qui oeuvrent dans le domaine de l’art populaire sans s’adonner à la sculpture (ex : tapis crocheté, gossage de « cup », peinture naïve, etc.) n’a pas non plus été considéré, hormis dans le chapitre dédié aux boutiques et aux musées. Cela ne préjuge en rien de la qualité de ces activités, qui pourront éventuellement faire l’objet d’une autre étude. Le présent document ne statue pas sur la question de savoir si l’art populaire observé au Québec est différent ou non de l’art populaire originaire de l’extérieur de ses frontières. Ses résultats pourraient néanmoins servir à une éventuelle étude comparative sur cette question, en particulier les graphiques sur les thèmes privilégiés ou sur les matériaux employés par les artistes. Les titres des figures et tableaux ont volontairement été laissés à leur plus simple expression afin de permettre une plus grande lisibilité. Ils devraient être retouchés dans le cas où lesdits tableaux et figures seraient utilisés hors du contexte de la présente étude. Le terme « patrimoine vivant » est compris comme synonyme de « patrimoine immatériel ».

Abstract:

Plusieurs expériences sont actuellement conduites à travers le mondepour favoriser la perpétuation d’éléments du patrimoine immatériel,aussi appelé patrimoine vivant. Grâce entre autres à du soutien d’ordrepublic, ces initiatives ont pour objectif d’accroître la mise en valeur, la transmission et la connaissance de pratiques traditionnelles reconnues par ceux qui les vivent. De l’Unesco au Québec, des communautés aux États parties à la Convention pour la sauvegarde du patrimoine culturel immatériel en passant par les associations ou les écoles, les systèmes mis en place sont mus tant par un désir d’identité et de continuité que par un impératif de diversité culturelle. Ce livre expose le contenu des conférences présentées durant le colloque sur Les mesures de soutien au patrimoine immatériel : gouvernements,institutions et municipalités, tenu en avril 2011 dans la ville de Québec(Canada). Il témoigne de la réflexion internationale autour de l’héritage laissé par les générations précédentes tout en documentant la teneur des moyens employés pour stimuler les différents champs concernés,dont les arts, les savoirs, les fêtes et l’artisanat fondés sur la tradition.

Abstract:

Les expressions traditionnelles et le patrimoine culturel immatériel (PCI) sont au cœur des expressions de la diversité culturelle du monde, tel que le soulignent notamment les conventions de l’UNESCO de 2005 et de 2003. Pourtant, relativement peu de statistiques directes sur le PCI ont été publiées à ce jour. Cet article se propose de faire état des efforts entrepris au Québec (Canada) en matière de données sur le PCI. Il tente d’analyser l’objet à mesurer, les approches possibles ainsi que l’objectif derrière cet exercice. Il suggère des pistes de réflexion pour l’élaboration d’enquêtes futures, en invitant à la prudence quant à la formalisation d’un appareil méthodologique qui se voudrait extensif. Le Cadre de l’UNESCO pour les statistiques culturelles de 2009, qui s’est penché sommairement sur la question du PCI, est en outre examiné. Les réflexions exposées dans cet article pourront servir d’amorce pour des indications statistiques spécifiques à l’intention des États et des ONG.

Abstract:

The notion of cultural heritage is in constant evolution. However, rather than competing against popular culture, the imaginative capability of designers should be directed at actualizing previously unimaginable cultural objects and producing meaning for them. By operating at the convergence of art and science, designers should develop ways of empowering the creative relationship among the physical tangibility of cultural objects, their current understanding, and their potential interpretations. This paper presents the design hypothesis of a virtual museum of natural quiet that brings together artists, musicians, interaction designers, software developers, and community experts. By addressing some of the social problems in the definition of policies for the protection and enjoyment of natural heritage, the project "The Silence of the Lands" promotes a model for preservation, experience, and renewal that empowers the active and constructive role of local communities in the process of interpretation of the cultural object. To do so, "The Silence of the Lands" enables people with different, sometimes competing visions to communicate and coordinate their different knowledge and perspectives by using sounds as "conversation pieces", while collaboratively creating and exploring the soundscape of a natural park or protected area. This paper describes the conceptual framework and the technologies supporting the present project.

Les théories anthropologiques sur la culture circulent dans les organisations et les institutions publiques comme privées. La récente convention de l’UNESCO pour la sauvegarde du patrimoine culturel immatériel en constitue un exemple et son rayonnement s’observe sur tous les continents. Plusieurs réflexions critiques confirment la pertinence d’un observatoire anthropologique sur cet engouement pour la patrimonialisation du vivant qui compose aussi avec une appropriation politique de manifestations culturelles. Nous préoccupe particulièrement le cas de groupes minoritaires dont les pratiques identitaires risquent d’être utilisées à d’autres fins que celle de la reconnaissance de leur contribution à la société. Notre démonstration porte sur les Gitans de la basse Andalousie et sur l’institutionnalisation du développement et de la mise en valeur d’un flamenco pluriel, indifférencié et associé aux inspirations musulmanes.

Abstract:

¡ Viva Jerez ! trace le portrait social des univers de la bodega (lieu d’élevage du vin Jerez-Xérès-Sherry) et du flamenco dans la ville de Jerez de la Frontera, berceau du chant gitan et de ce vin « généreux ». L’analyse comparative de ces deux pratiques historiquement ancrées en basse Andalousie provoque une réflexion sur les stratégies de « marchandisation » et de politisation de la culture en considérant tous les niveaux administratifs, du local à l’international. Les récents programmes de l’Unesco sur le patrimoine culturel immatériel constituent le point de départ de cette réflexion sur le processus de patrimonialisation et ses enjeux identitaires, esthétiques et politiques. Le processus de patrimonialisation de la culture suscite intérêts et critiques. Dans un véritable dialogue entre les niveaux décisionnels et les praticiens de la culture, ce livre évoque ces espaces urbains, distincts et communicants, marqués par des clivages socioculturels historiques influencés par le latifundisme : señorito, gitan et gachó. Malgré les bouleversements subis dans les deux secteurs étudiés, les pratiques et les savoirs associés au flamenco et au vin se transmettent toujours par la famille et valorisent l’intime, le rituel et le sensoriel ; ils sont aussi capitalisés, particulièrement à des fins touristiques. La spectacularisation de la culture, le pouvoir de l’image et le simulacre se confrontent alors au sens donné à l’informel, à l’instant, à l’expérience, à la personnalité, à ce « vivre ensemble », cette convivencia. La tendance à l’homogénéisation de ces pratiques et savoirs culturels renforce des positions radicales défendant une pureté du sang et de la Terre, légitimant un pouvoir d’action, une autorité, à travers le protagonismo. Ainsi, la conception du patrimoine culturel immatériel et les tentatives de « mise en valeur » de la culture vivante gagneraient à reproduire ce qui est au cœur de la culture, des identités et des processus créatifs : le sens et la relation humaine.

Abstract:

Vimbuza, one of two Malawian dance forms inscribed on the UNESCO Representative List of the Intangible Cultural Heritage of Humanity in 2008, is a healing ritual practiced by Tumbuka people in Malawi’s northern region. Vimbuza refers both to the ailments caused by Vimbuza spirits and the rituals used to heal people with these spirit-induced illnesses. Vimbuza healers diagnose and treat spirit-related illnesses in rituals that combine dress, drumming, singing, and movement. It is sometimes called a “traditional dance” and performed for entertainment rather than healing. Drawing from interviews with practitioners, the general public, and cultural sector professionals, this essay explores the implications of UNESCO recognition for Tumbuka people. Though the impact of Vimbuza’s inscription on those most associated with the practice is debatable, it still has local, regional, national, and international value.

Abstract:

Purpose – This paper aims to focus on evaluating the rich cultural intangible heritage of Sardinia Island, and how such a heritage can contribute to the implementation of tourism during the low season. The purpose is also to verify whether the enhancement of intangible heritage attractors, could be a driver for the sustainability of the island’s tourism. Design/methodology/approach – A qualitative approach is used in order to explore a multiple case study: the multifaceted expressions of the Holy Week. This is a cultural event that constitutes a part of the Christian festivity of Easter, which is characterized by traditional processions and ancient rituals widespread in various towns and cities around the island. Findings – Intangible cultural heritage provides an additional opportunity to increase the level of tourism in Sardinia Island. Research limitations/implications – This study has its limitations: it focuses only on a specific typology of event. Further studies should be taken into consideration in order to explore whether even other kinds of events are able to increase tourism in the low season, and to promote it on a sustainable perspective. Originality/value – This study about heritage tourism in islands provides information about which little has been written. Moreover, it could offer a framework for other island destinations in the Mediterranean and elsewhere. Abstract:

The subject matter of the present thesis is the research of the safeguarding mechanisms for the Intangible Cultural Heritage (ICH) in the light of international law. While placing the attempt to deal with this specific subject area in the broader framework of the contemporary international cultural heritage law, the purpose of this analysis is to chart the development itself, the existing international tendency and the emerging challenges in this field for international law, which constitutes the advantageous field for the research of the topic according to the writer, since the intangible heritage in and of itself inherently poses the issue of borders of every kind – national and legal. Thus, in the first part, the understanding of the notion of ICH in relation to the more specialized existing legal protection regime, established by UNESCO’s International Convention for the Safeguarding of the Intangible Cultural Heritage of 2003, will lead us to the analysis of the conventional safeguarding mechanism, while the possibility of establishing the existence of International Custom in this context will be explored, both prior to the 2003 Convention and following its application, probably ascertaining whether the States’ and the Organization’s subsequent practice sets some new terms for its interpretation and application. In the second part, the connection of the ICH with two other systems of protection will be examined, on the one hand, with the international human rights law, in the context of which the possibility of establishing a right to the ICH will also be analyzed, and on the other hand, with the international intellectual property law, in the framework of which the question of considering the ICH as a common heritage and a common concern of mankind will be approached as well.

Abstract:

The paper explores the relation between State sovereignty and the safeguarding of the Intangible Cultural Heritage (hereafter ICH) pointing out the tension between a State-centered and a community-oriented approach within the existent protection mechanism. In the first part, the writer outlines the legal framework established by the 2003 UNESCO Convention, examining some of its “sovereignty guarantees”. In the second part, she touches upon the particular issue of dealing with “shared ICH” within the UNESCO framework, examining possible responses to the apparent deficiencies towards its more effective safeguarding. Questioning whether ICH is an appropriate field for States to “reaffirm” their sovereignty or it intrinsically challenges the traditional concept of the sovereign State, she discusses the recognition of ICH’s cross-border character and the common concern for its safeguarding, as well as the progressive establishment of a right to ICH and the demand for a more active role of its communities in the international safeguarding system, as crucial parameters. How could international law adapt to those challenges and with what cost for sovereignty? The paper was presented in the Agora “Culture As or Against Sovereignty” convened by the Interest Group on International Law of Culture as a contribution to the 2019 ESIL Conference.

Abstract:

The objective of this paper is the presentation of a model conceived to value and promote intangible heritage, specially conceived for contexts in which there is a high degree of mistrust and, relatively little regular communication among the main stakeholders.. The problematic of heritage valuation is closely linked with tourism, and intangible heritage has been acquiring increasing relevance in processes of cultural and creative tourism development. For its part, the local harnessing of the benefits of tourism, namely in rural contexts, is very much dependent on the stakeholders’ capacity to organize themselves and to cooperate in order to create valuable tourist experiences. The valuation model presented is built on a combination of former propositions (Lopes, 2012; Lupo, 2007; Saxena and Ilbery, 2008) and the preliminary results from a research project on the area of intangible (partially invisible) heritage.

Abstract:

Sustainable development is today a well- populated field of academic inquiry fed by a vast reservoir of praxis. Just as is the case with the formal sciences, sustainable development thrives within networks of practitioners, the- oreticians, a very active and diverse corps of field workers, and a rich stream of experien- tial knowledge. Without the accumulation of and organization of those seams of knowl- edge, sustainable development would risk becoming a philosophical abstraction. One of the reasons it has not, is the field’s con- structive dependence on intangible cultural heritage—from which it draws in many ways—as expressed through the customs and practices used to transmit traditional knowledge. That is why there have been a variety of terms used in the field of sustain- able development to convey this concept: indigenous technical knowledge, traditional environmental knowledge, rural knowledge, local knowledge and farmer’s or pastoralist’s knowledge.

This paper describes our current work in the area of Museum Information Systems, namely for crafts and industry museums, where the main concern is to preserve and document not only material artifacts but also oral traditions, know-how, processes, cultural and social contexts, local history, sounds, tactile experiences and smells. Our case study is a Hat Industry Museum, which is being created in the North of Portugal, at the heart of what was, in the last century, the biggest hat- manufacturing center. As such, the Museum will be also a tribute to the social and economic life of a whole region. We propose a conceptual approach for describing non-material heritage, its application to our case study, and we review current efforts that can be used and integrated in the museum community.

Abstract:

In the face of increasing globalisation, and a collision between global communication systems and local traditions, this book offers innovative trans-disciplinary analyses of the value of traditional cultural expressions (TCE) and suggests appropriate protection mechanisms for them. It combines approaches from history, philosophy, anthropology, sociology and law, and charts previously untravelled paths for developing new policy tools and legal designs that go beyond conventional copyright models. Its authors extend their reflections to a consideration of the specific features of the digital environment, which, despite enhancing the risks of misappropriation of traditional knowledge and creativity, may equally offer new opportunities for revitalising indigenous peoples’ values and provide for the sustainability of TCE.

Abstract:

Abstract Up to the second half of the twentieth century, Slovenian ethnologists and folklorists were concerned almost exclusively with the phenomena of folk culture in the “traditional” sense generally used in European ethnology—that is, as the rural, low, simple culture typical of an ethnic community and, later on, a nation. Due to historical, economic, and social changes, the concept's semantic alterations (as reflected in academic definitions and public reception) were followed by more and broader ways of transmitting it. From the perspective of knowledge formats and other genres, the Slovenian case may offer some comparative insights into the establishment, development, and popularization of scholarship. These processes are the outcome of the scholarly reconceptualization of culture research as well as the commodification of culture.

Abstract:

This article begins with the celebration of George Town’s enrolment (along with Melaka, both in the Strait of Malacca) on the UNESCO World Heritage List. It then sketches the process by which the Chinese clan jetties, built on stilts over the sea and, until now, at the margins of urban development, have been integrated into the core zone of the preserved perimeter of George Town, in Penang, Malaysia. The article assesses this change in relation to issues of the recent heritage policy enshrined in a multicultural context and examines the various actors’ strategies to achieve their aims in a competitive context.

Abstract:

The article examines the role of the former Long Kesh/Maze prison as one of the key heritage sites of the Northern Ireland conflict. It is grounded within the context of the political processes which have followed the implementation of the Belfast Peace Agreement in 1998. A brief history of the site and the salient points in its timeline precedes a discussion of the recommendations of the Maze Consultation Panel which reported in 2005. Among its principal proposals was the reconstruction of part of the Maze site as an International Centre for Conflict Transformation. The article examines the responses of various stakeholders to this idea but uses Sinn Féin's favoured analogies of Robben Island and, particularly, Auschwitz-Birkenau to conclude that only republicanism has a clearly defined sense of the heritage value of the Maze and an understanding as to how the site might be appropriated and exploited as an iconic place for remembering, contestation and resistance.

Abstract:

Like other forms of intangible heritage, traditional music cultures have been adversely affected by the major economic, social, and technological shifts of recent decades. The resultant changes in musical contexts, function, prestige, and modes of transmission have jeopardised the vitality and viability of many musical genres. Efforts to actively support the sustainability of endangered music heritage are developing, often in the context of the emerging field of ‘applied ethno-musicology’. The more established field of language maintenance has conceptual, theoretical, and pragmatic parallels with safeguarding music, and these synergies are arguably of great importance to the swift development of effective mechanisms for supporting viable and vibrant music cultures. This paper identifies areas where the maintenance of a language holds the potential to inform pathways towards sustaining endangered musical heritage, and explores one of them in depth – the tension between documenting endangered languages and attempting to revitalise them.

Abstract:

The challenges posed by a fast-changing global environment to the vitality and viability of musical traditions continue to be a topical issue on the ethnomusicological agenda. Investigations into ways to help keep musical traditions strong are still incipient, however, relative to parallel strategies to protect and promote endangered languages. This article identifies key synergies and disconnects between language and music specifically in relation to factors that impact on their vitality and viability. In this way, it pinpoints areas where theory and practice from the field of language maintenance hold greatest potential to inform the development of ways to keep ‘small’ music genres strong.

Abstract:

This paper reviews the current state of knowledge about the links – metaphorical and real - between cultural and biological diversity. By way of approach, it focuses on language and music cultures, two areas of intangible cultural heritage whose diversity has come under threat in recent decades. The paper suggests some ways in which recent advances in the fields of ecolinguistics, biolinguistic diversity, and music sustainability further our knowledge of the links between cultural diversity and biodiversity. Metaphorical parallels between biodiversity and cultural diversity (such as the interconnectedness of the various forms of intangible cultural heritage, as in a biological ecosystem) can, to some extent, inform the development of models for supporting intangible cultural heritage such as language and music. Moreover, the very real interconnections between these two kinds of ‘diversities’ hold implications for cultural heritage management, since efforts to safeguard cultural diversity will be impacted by the successes and failures of efforts to protect biodiversity, and vice versa. For this reason, the issues explored in this review hold implications for policy-makers, governments, non-governmental organisations, culture-bearers themselves, and other stakeholders in the viability and diversity of cultural heritage.

Abstract:

High-profile agencies such as UNESCO continue to underscore the urgent need to support the sustainability of intangible cultural heritage across the world, in all its forms: from languages to music, theatre to dance. That task is enormous, and within any specific region or nation, even within a community, decisions often need to be made about where to best direct the limited funding, time, and resources for sustainability efforts. Drawing on precedent from the environmental sciences, this paper suggests a ‘triage system’ to help set priorities for implementing sustainability initiatives. The tripartite model assesses (1) the nature and severity of the threat to the cultural expression in question, (2) its perceived value in the community, and (3) the solvability of the problem. The system holds potential to assist stakeholders – communities themselves, as well as bodies that allocate funding and resources for cultural maintenance and revitalisation – to determine priorities for support, in turn leading to better deployment of resources and optimal outcomes for effort.

Abstract:

Previous studies have explored the historical and social context for the endangerment and subsequent revitalisation of Cambodian performing arts, but little work has focused on music, or the views of culture-bearers themselves on these issues. By thematically analysing qualitative data from semi-structured interviews conducted in early 2013, this research explores the perspectives and motivations of a group of master-musicians, teachers and performers who are making efforts to sustain and revive their music traditions. Participants emphasised five factors that they believed significantly interplayed with the vitality of traditional Khmer music genres. Four of these were generally perceived to have an overall adverse effect on vitality: ‘outside’ influence; loss of interest and knowledge among younger people; low market demand for performances and teaching; and perpetuation of limiting constructs and belief systems. Only one factor identified was perceived to have a beneficial effect on vitality: the strength of infrastructure for learning and teaching. Somewhat surprisingly, then, opinions about the viability of traditional genres were on aggregate highly optimistic, though with some concern expressed about the impact of government action (and inaction) on this issue. Justifications given for sustaining and revitalising traditional Khmer genres included the role of these traditions in education and ritual, Cambodian national identity and musicians’ livelihoods. The study confirms the perceived value, among one group of culture-bearers, of revitalising Khmer music traditions.

Abstract:

The widespread threat to certain kinds of music genres (particularly those of indigenous and minority peoples) resulting from major socio-economic and political shifts in recent decades has stimulated a call for applied ethnomusicological engagement with safeguarding. Discourse from the field of language maintenance, however, underscores a number of significant ethical, ideological and pragmatic concerns generated by efforts to safeguard intangible cultural heritage. For ethnomusicologists, these concerns warrant careful consideration. In this paper, I position four primary charges against safeguarding from the language maintenance literature in relation to safeguarding music cultures, thereby hoping to invite new reflections on the challenges we face and the stances we might adopt when helping communities that are trying to protect and promote their endangered musical heritage.

Abstract:

The ongoing debate over indigenous claims to intellectual and cultural property reveals a series of indigenous strategies of mobilization that both appropriate from and work against the logic of the market. Of particular significance in this regard are the various indigenous strategies used in contemporary pharmaceutical bioprospecting activities to address claims to traditional medical knowledge as cultural property. This article presents field data on a controversial ethnopharmaceutical project among the Aguaruna of Perus high forest and offers a comparative analysis of the outcomes with attention to several other cases in and beyond South America. In particular, questions are raised about the forms of legitimating authority in the burgeoning international indigenous movement, the role of NGOs, researchers, bureaucracies, and corporations in this process, and the dilemmas that emerge from the politicization and privatization of indigenous culture and identity.

Abstract:

L’objet de cette communication est de rendre compte des problématiques qui ont traversé les différentes directions du Ministère de la culture lorsqu’elles ont travaillé sur les formes dites « populaire »s de la musique, de la danse, des contes, des pratiques langagières et des savoir-faire, alors même que la notion de patrimoine culturel immatériel n’était pas encore établie par l’UNESCO. Elle décrit brièvement les très grandes lignes des actions menées dans les différents domaines par les directions concernées. Sont ainsi abordées les politiques des arts du spectacle ou de la performance, pour la direction de la musique, de la danse, du théâtre et du spectacle (DMDTS) ; de la conservation et de la valorisation des objets et pratiques par la direction des musées de France (DMF) ; du travail sur les pratiques des langues de France à la délégation générale à la langue française et aux langues de France (DGLFF) ; et enfin, de l’étude et de la promotion du patrimoine matériel et ethnologique à la direction de l’architecture et du patrimoine (DAPA).

Abstract:

Heritage implies inheritance, a community‐negotiated concept defying easy historical determinism. Utilising Ronström's distinction between tradition and heritage, this paper uses case studies from the islands of Shetland, Åland, and Svalbard to analyse how the uninherited nature of some heritage can influence its reception by the local community. These receptions vary and influence attempts to develop heritage under the world heritage ideal or for tourism, which is so vital to many island communities. Local governments and tourism professionals often interpret heritage objects differently than do local communities. Although heritage can be created without community consent, local support cannot be taken for granted. This paper argues that heritage‐promotion initiatives should take into account the special issues surrounding uninherited heritage.

Abstract:

Depuis l'adoption de la Convention pour la sauvegarde du patrimoine culturel immatériel par l'UNESCO en 2003, le PCI est devenu un objet qui suscite de plus en plus l'intérêt de l'anthropologie, du droit et des sciences sociales, en général. La création d'une nouvelle catégorie patrimoniale au sein de l'organisation internationale a permis non seulement l'élargissement de la notion de patrimoine, restreinte jusqu'alors à une vision monumentale des biens culturels, mais surtout la reconnaissance de la valeur patrimoniale des expressions culturelles issues de la tradition et de la culture populaire. Cependant, le changement de perspective, vécu au sein de l'UNESCO, n'aurait pas été possible sans la référence d'une série d'instruments normatifs antérieurs visant la protection des droits de l'Homme, des peuples autochtones et des minorités ainsi que des droits culturels. Ce livre propose aux lecteurs et lectrices d'analyser la législation internationale autour des sujets culturels afin de les inscrire dans une histoire commune pour la reconnaissance des droits des peuples, des nations et, plus spécifiquement des communautés soumises à une condition de domination de l'Occident.

Voici un ouvrage sur la diversité culturelle qui constitue l’une des composantes du patrimoine commun de l'humanité. La Convention pour la sauvegarde du patrimoine culturel Immatériel de 2003 et la Convention sur la protection et la promotion de la diversité des expressions culturelles de 2005 sont les deux plus récents traités culturels internationaux conclus sous l’égide de l’Organisation des Nations Unies pour l’éducation, la science et la culture (UNESCO). Puisant leur source dans la Déclaration universelle sur la diversité culturelle adoptée à l’unanimité des membres de l’UNESCO en 2001, les Conventions de 2003 et de 2005 constituent toutes deux une réponse de la communauté internationale aux phénomènes de mondialisation des économies et d’homogénéisation des cultures, notamment générés par l’intégration des marchés. Ces instruments demeurent néanmoins distincts et poursuivent des objectifs qui leurs sont propres, bien que des interactions entre les deux conventions puissent être identifiées. Cet ouvrage a pour vocation de mettre les deux textes en parallèles, de manière à clarifier leur champ d’application respectif, tout en valorisant leur complémentarité et leur contribution au développement durable des sociétés.

Abstract:

Le développement durable a traditionnellement été appréhendé comme une notion exprimant l'interdépendance des préoccupations environnementales, économiques et sociales. L'article 13 de la Convention sur la protection et la promotion de la diversité des expressions culturelles témoigne cependant d'une prise de conscience des États relative à la nécessité d'inclure formellement la culture dans le champ de la réflexion entourant cette notion. Or, bien que cette prise de conscience soit relativement récente, les liens qui unissent la culture au développement durable remontent aux origines même du droit international de la culture et du droit international de l'environnement. Un examen historique permet en effet de déceler des constructions et des mouvements communs de ces deux branches du droit international, si bien que plusieurs principes de développement durable généralement associés à la protection de l'environnement, imprègnent aussi de manière indélébile la substance des normes de droit international de la culture.

S’il est fréquent d’associer la protection de la « culture » au « développement durable » – l’idée de préservation d’un patrimoine au bénéfice des générations présentes et à venir est en effet inhérente aux deux concepts – la définition classique du développement durable et le contenu de cette notion tel que précisé par certains textes fondateurs passent généralement sous silence l’importance de la culture pour le développement des sociétés. Pourtant, des liens juridiques intimes unissent désormais les deux notions, comme en témoignent les récents développements du droit international en ce domaine. Ces évolutions normatives, qui se fondent en grande partie sur une prise de conscience de l’inestimable contribution de la culture au développement durable des sociétés, tendent cependant à passer sous silence l’autre dimension de la relation, soit le potentiel que représente la notion de développement durable pour la protection des cultures. En utilisant l’exemple de la sauvegarde du patrimoine culturel immatériel, cette contribution vise à explorer ce potentiel en trois temps : en identifiant d’abord les instruments juridiques internationaux qui ont contribué à la reconnaissance explicite d’un lien entre la culture et le développement durable (I) ; en précisant, ensuite, le contenu conceptuel et juridique de cette notion de développement durable à laquelle sont attachés certains « principes de développement durable » (II) ; en procédant, enfin, à une analyse critique de la Convention pour la sauvegarde du patrimoine culturel immatériel à la lumière de ces principes de développement durable (III).

Se defenderá la utilidad de esta apuesta teórica a causa de los diversos réditos políticos y culturales que podría producir cierto empleo o instrumentalización del patrimonio inmaterial para salvaguardar o ponderar flujos de capital social y modos de identidad. Estas reflexiones se enmarcan en el ámbito general del debate sobre el desarrollo, proverbial en la antropología desde la teoría de la dependencia de los años sesenta. Se cuestionará la condición, la naturaleza y los deberes del desarrollo en el contexto actual y sus implicaciones en materia de derechos humanos, así como su relación con los puntos anteriormente mencionados (sobre identidad cultural y capital social), considerándose la íntima imbricación entre las propuestas desarrollistas y las políticas de patrimonio inmaterial.

Abstract:

The traditional protection of the copyright of folk literature is based on the notion of collective authorship.The upsurge of folk literature protection is pushed by the emotion of cultural nationalism.Influenced by it,the literary scholars painstakingly make differences between folk literature and artist literature,and construct the so called collectivity of folk literature,upon which the legal scholars further invent the collective inditement mechanism and collective authorship notion.Some scholars pave the way for the collective property right on folk literature by borrowing the structuralist literature theory and criticizing the individualist authorship notion.However the collective authorship notion in the folk literature field distorts the developing direction of copyright law.The notion of collective authorship should be abandoned.It is taking the folk literature as ordinary productions that can ultimately resolve the problem of protecting the copyright of folk literature.

Abstract:

Perhaps the most controversial issues in the negotiation of the Convention for the Safeguarding of the Intangible Cultural Heritage concerned the creation, designation, and purpose of its lists. The ﬁnal text provides for three types of lists: a Representative List of the Intangible Cultural Heritage of Humanity, a List of Intangible Cultural Heritage in Need of Urgent Safeguarding, and national inventories of intangible heritage. The ﬁrst of these, in particular, is a compromise solution reached after intense confrontations between those national delegates who wanted to create a merit-based ‘List of Treasures’ or ‘List of Masterpieces’ similar to the World Heritage List, those who would rather have seen an inclusive universal inventory of traditional practices, and those who wanted no list at all. In the ﬁnal text of the Convention, the provisions for the Representative List are vague enough to postpone this debate until the present time when state parties are revisiting it. In what follows, I analyse the arguments put forward by delegates in the debate on listing – from incentive and promotion value to divisiveness and hierarchisation – and I argue that in fact these go to the heart of heritage practices, which are always and inevitably selective. The system of heritage, in other words, is structured on exclusion: it gives value to certain things rather than others with reference to an assortment of criteria that can only ever be indeterminate. In this respect, heritage and lists are not unlike one another: both depend on selection, both decontextualise their objects from their immediate surroundings and recontextualise them with reference to other things designated or listed. It is hardly surprising, then, that listing seems constantly to accompany heritage making. Heritage lists fuse aesthetic, ethical, and administrative concerns in a rather unique fashion. They celebrate the virtues of particular populations while fuelling a cultural contest among them. Making a people visible to itself and their practices to the world at large, such lists are ultimately designed to channel funds and attention to the task of safeguarding. Once they have been made and are available for circulation, however, lists tend to take on a life of their own; they can be put to uses quite unlike – even diametrically opposed to – those their creators had in mind. The World Heritage List is a case in point, with tourism gradually taking precedence over preservation as its driving concern and principal context of use. It remains to be seen to what uses the Representative List will be put.

Abstract:

Reading across the six essays in this special issue on “UNESCO on the ground,” this commentary argues for an understanding of intangible heritage as a diagnosis for a cultural condition that is increasingly common in industrial and postindustrial societies under circumstances of economic, political, technological, and demographic change—for which the shorthand is globalization. Safeguarding emerges, then, as a form of treatment, administered by experts, combining new social institutions (councils, committees, commissions, networks, foundations, etc.) with certain expressive genres (lists, festivals, workshops, competitions, prizes, documentaries, promotional materials, etc.). The former administer the latter in practices that are jointly termed safeguarding. If intangible heritage is a diagnosis and safeguarding is the treatment, however, it is not without side effects.

Abstract:

Folklore research in the United States typically is completed either through academic departments or in organisations designed to create public presentations of traditional expressive culture. These two approaches are termed ‘academic folklore’ and ‘public folklore’. The intellectual history of both approaches has recently been critiqued. One result of this deconstruction is an ambivalence over the historical legacy of key concepts in the study of folklore. Assessing elements of the critical study of folklore’s history – in both academe and the public sector – suggests opportunities for reconstituting the study of traditional culture to establish a more socially responsive approach that is relevant to ways that heritage professionals assess folklore as intangible culture heritage.

Abstract:

This thesis looks at the way cultural heritage can be more broadly considered to include intangible aspects of our lives. Such intangible heritage encompasses the general values and worldviews of a community and enshrines a community’s character and identity. Through meanings, associations, values and ways of life, people individually and collectively create a meaningful relationship with place. Place and community are mutually constituted through social action and practice and the attribution of meaning in a process of ‘place making’ and of reasserting belonging. It is recognised that communities are fluid categories that can be ‘re-sited’ in relation to new questions or different places and times. Both individual and community identity are a form of production, and consist as a process that is never complete. That is, identity is not only a matter of ‘being’ but also a process of ‘becoming’. By addressing case studies in three World Heritage listed locations – Magnetic Island (Australia), Avebury (England) and Ayutthaya (Thailand) – the thesis considers the dissonance between heritage as defined and practised through hegemonic instruments and discourses (including international organisations, bureaucratic structures and the Academy), and heritage as conceived by contemporary communities as being the aspects of their lived existence that they desire to retain for future generations. Through discussion of emplaced communities and a series of case studies, consideration is given to the hegemonic dominance of sanctioned determinations of heritage that attribute significance and in the process can mute local values and narratives. The thesis challenges the ongoing emphasis on tangible aspects of heritage and reviews the natural/cultural heritage dichotomy, demonstrating that attachments to nature are predicated on experiences, practices and engagements with the environment that are grounded in social and cultural processes. I further explore the way in which the voicing of opinions in a struggle over place can be regulated by prevailing scientific discourses and discursive fields, placing a reliance on arguments about conservation that are ancillary to more specific but less articulatable concerns to do with place and identity. Finally, I illustrate the significance of the lived traditions, rituals, ceremonies, skills and practices of the contemporary communities to a holistic understanding of heritage at both the local and broader levels. I conclude that it is by understanding what it is that communities find important, and how such attachments and values are formed, transmitted and retained to create a ‘sense of place’, that community participation in heritage can be meaningfully achieved. Community assertions of the aspects of their lives that can be considered important to pass on to their children are not enshrined in the monuments, structures and archaeology that heritage professionals are more likely to identify, but in the sense of belonging that arises through the mutual construction of community and place, reinforced through social practices, memories and local narratives.

Historic sites, memorials, national parks, museums…we live in an age in which heritage is ever-present. But what does it mean to live amongst the spectral traces of the past, the heterogeneous piling up of historic materials in the present? How did heritage grow from the concern of a handful of enthusiasts and specialists in one part of the world to something which is considered to be universally cherished? And what concepts and approaches are necessary to understanding this global obsession? Over the decades, since the adoption of the World Heritage Convention, various ‘crises’ of definition have significantly influenced the ways in which heritage is classified, perceived and managed in contemporary global societies. Taking an interdisciplinary approach to the many tangible and intangible ‘things’ now defined as heritage, this book attempts simultaneously to account for this global phenomenon and the industry which has grown up around it, as well as to develop a ‘toolkit of concepts’ with which it might be studied. In doing so, it provides a critical account of the emergence of heritage studies as an interdisciplinary field of academic study. This is presented as part of a broader examination of the function of heritage in late modern societies, with a particular focus on the changes which have resulted from the globalisation of heritage during the late twentieth and early twenty-first centuries. Developing new theoretical approaches and innovative models for more dialogically democratic heritage decision making processes, Heritage: Critical Approaches unravels the relationship between heritage and the experience of late modernity, whilst reorienting heritage so that it might be more productively connected with other pressing social, economic, political and environmental issues of our time.

Abstract:

This chapter introduces the concept of heritage and examines its various uses in contemporary society. It then provides a background to the development of critical heritage studies as an area of academic interest, and in particular the way in which heritage studies has developed in response to various critiques of contemporary politics and culture in the context of deindustrialisation, globalisation and transnationalism. Drawing on a case study in the ofﬁcial documentation surrounding the Harry S. Truman Historic Site in Missouri, USA, it describes the concept of authorised heritage discourses (AHD) in so far as they are seen to operate in ofﬁcial, state-sanctioned heritage initiatives. Where the other chapters in the book contain substantial case studies as part of the discussion of the different aspects of the politics of heritage, this chapter focuses instead on key concepts, deﬁnitions and ideas central to understanding what heritage is, and on heritage studies as a ﬁeld of inquiry. The chapter suggests that critical heritage studies should be concerned with these ofﬁcially sanctioned heritage discourses and the relationships of power they facilitate on the one hand, and the ways in which heritage operates at the local level in community and identity building on the other. It provides a number of explicit ideas and reference points to which the authors of the other chapters will return through the course of the book.

Abstract:

This Chapter addresses particular aspects concerning how to define a “holder” of intangible cultural heritage. The author argues that the concept of “belonging” can hardly justify any one-size-fits-all solution based upon conventional views that assume community’s entitlements to their cultural traditions are identical for all types of communities. This Chapter advocates that the efficient scrutiny of the conundrum regarding “holdership” of intangible cultural heritage requires viewing the web of relationships amongst various stakeholders (such as humankind, communities, their members and non-members) with regard to individual components of cultural traditions as a social product. This facilitates recognizing diversity and vibrancy emerging amongst Indigenous, traditional, local and other cultural communities. Ensuring adequate and sufficient importance placed on networks of social relationships, which occur within and outside communities relative to their intangible cultural heritage, lies central to designing an efficient legal framework for the protection, preservation and safeguarding of cultural traditions. This is especially indispensable when we take into account the fact that each regime aiming at the protection, preservation or safeguarding of cultural traditions works well only with regard to certain types of communities and their organizational structures, but not with the others. The ways of defining a “community” as a holder of intangible cultural heritage and the community’s role in the entire process of its preservation, safeguarding and survival then considerably depend upon specific features and mechanisms of particular regimes. Each regime constructs different conditions and requirements for an entitled person. The configuration, or say definition, of entitled entity thus differs between individual regimes which can range from those based upon granting communal property rights, through imposing liability for expropriation of intangible cultural heritage by non-members of affected communities, to those aiming at the safeguarding of intangible cultural heritage through the implementation of measures financed from private or public funds. Some of them are currently in preliminary stages of their proposal; others in final stages of adoption or implementation such as the system under the Convention for the Safeguarding of the Intangible Cultural Heritage (ICH Convention). As the efficiency of particular regime depends upon its fitting to particular types of communities and their intangible cultural heritage, the preservation of myriad cultural traditions in living incarnation requires to design efficient networks of regulatory regimes tightly nested to understanding the web of relationships concerning cultural traditions within and outside the concerned communities as a social product.
