Context of the measure: 
CULTURAL POLICIES AND MEASURES
b. Objetivos clave de la medida: 

The improvement of legal framework, by passing new laws and by-laws has as its goal to create good basis for institutional and organizational reform in the cultural sector, that is, in the sector of cultural and artistic creativity. This is to ensure the development of culture at national and local level in the long term. By this measure, legal basis aimed at encouraging inclusive cultural development as well as at structuring of dynamic cultural sectors and diversity promotion, is being improved. Generally, the aim is to innovate legal framework in accordance with European legal framework and contemporary standards. The measure was specifically aimed at creating a new legal basis in the field of publishing and cinematography. The intention of legislator is to revitalize the activities listed, full valorization of their creative and economic potentials as well as incentive to the cultural expressions of Montenegrin artists.

After the adoption of the Law on Culture (2008) and the set of laws from the cultural heritage (2010), as thorough acts which established the model of organization of cultural sector, in the previous reporting period several laws were made which completed legal framework in the sphere of cultural and artistic creativity, by which development goals defined by The National program regarding strengthening legal infrastructure have been fully realized.

The Law on Publishing Activity (2012) - The new law has the intention to incite the development of that activity by means of determined conditions and priorities and through statutory rights and obligations of the publisher, pressman, distributor and the roles of the state to incite appropriate activities in publishing.

The Law on Amendments of the Culture Law (2012) - was adopted due to need for compliance with the new Law on NGOs and due to regulation of certain rights of independent artists.

Law on Cinematography (2015) - new law has as its aim to provide long-term development of this domain and the solution of those questions that proved to be the weakest links. Among other things, the law defines the establishment of Film center, film fund, as well as the opportunity of rebate to the foreign producer for recording in Montenegro, as a stimulating measure.

Provisions of Laws mentioned in their basic provisions point out the encouragement of creativity of certain groups: members of minority peoples and minority national community, children and the young, the disabled persons and of gender equality. In addition to the above mentioned, for the purpose of complete implementation of existing and newly adopted laws, a certain number of by-laws has been adopted.

e. What are the results expected through the implementation of the measure?: 

Putting this measure into effect by which legal bases in publishing and cinematographic activity are innovated, their quantitative and qualitative improvement is to be expected, as well as more intensive distribution of creative work of Montenegrin artists within and beyond the borders of Montenegro.

Within the publishing activities pursuant to the established priorities, the following thins are  expected: greater copyright protection, the respect of professional standards,  the improvement of the quality of publishing projects, the increase in translation into Montenegrin language as well as in translating in foreign languages, significant involvement of publishing companies and the authors in regional and European networks and international funds, greater artists’ mobility, publishing  of capital editions of Montenegrin literature and their translations, the improvement of book market as well as the improvement of the work of the professional associations.

Within the cinematographic activity pursuant to recognized tasks of public interest the following is expected: bigger production and co-production of cinematographic and television works, diversity of movie content as well as representation of national and coproduction works on television and in the cinemas, the continuity of film production, bigger participation of young Montenegrin personnel, involvement of production companies and authors in the international programs which is supposed to be more important (Creative Europe, the MEDIA sub-programme), involvement in associations (European Film Promotion) and in funds, bigger aritists’ mobility, useful work of new institution – Film Center of Montenegro, establishment of a film fund, increased presence of foreign producers and foreign filming in Montenegro by implementing defined incentive measures, stronger promotion and utilization tourist and cultural  resources of the country.

Means that are needed to realize these measures, concerning the obligations of Ministry of Culture (co-financing, incentive measures, the establishment of new institutions, etc.) are allocated within statutory rate of total 2,5 per cent which are allocated from the budget of Montenegro for the culture.

The evaluation of measure has been conducted at national level through the preparation of Program of Cultural Development of Montenegro 2016-2020. and through analysis of existing condition and achievements in the fields in which the new laws have been enacted, namely, where this measure has been implemented.

The evaluation of the measure has been conducted also at international level, through the  accession process of negotiation for joining European Union (EU) , as well as through the project of UNESCO “Culture for Development Indicators - CDIS’’, conducted in 2015 in Montenegro. It was noted that legislative reforms in the cultural sector have been brought to an end, which provided the normative regulation of the cultural sector in accordance with European legal framework and which was confirmed by the opening and provisional closure of Chapter 26 – Education and culture, in Montenegro's accession process to the European Union. CDIS analysis has indicated that ‘’there is already a significant standard-setting framework for culture in place and that the national authorities have made many efforts to ratify key international legal instruments affecting cultural development, cultural rights and cultural diversity, as well as to establish a national framework to recognize and implement these obligations”.

CDIS has been used for the influence of measure on entire legal framework. In the indicator defined ‘’Standard-setting framework for culture’’ adequate sub-indicator  for national level had the result of 0,87 out of maximum 1.

Reorganization of institutional framework in the field of cultural and artistic creativity and the establishment of new institutions

Context of the measure:

b. Objetivos clave de la medida: 

Objectives of this measure were focused on two key aspects: the reorganization and development of existing national and municipal cultural institutions and creating new institutions. Regarding reorganization, the objectives are concentrated on obviation of shortcomings of the previous organizational models of institutions, improvement of managerial and governing as well as personnel structure, modernization and reconstruction of spatial and technical capacities. Regarding the creation of new institutions, the objective was to raise the qualitative and organizational level of functioning of certain cultural activities in accordance with the recognized needs and comparative international examples of institutional organizing.

Reorganization of existing national cultural institutions, implied chiefly the implementation of new models of  management and governing defined by Law on culture from 2008, which, for the beginning, implied the adoption of founding acts and statutes of the institutions by the founder (state or municipalities). In order to carry out further steps in the contexts of the objective of this measure, Ministry of Culture issued Development strategy of public institutions from the sphere cultural and artistic creativity 2013-2018 which defined the courses of reorganization of national institutions through: their program specialization on the principles of sustainable development, strengthening of personnel, spatial and technical and technological capacities and providing the financing of the work of institutions, as  well as other questions in order to improve overall potential of national institutions in the medium-term period. At the local level, this measure implied the obligation of municipalities to issue new founding acts and to name new management and governing bodies in accordance with Law on culture, and after that to reorganize the institutions in the sense that existing municipal institutions of culture with complex activities become separated into special institutions for cultural and artistic creativity and for cultural heritage (museums and libraries).

The establishment of new institutions meant two activities: the formation of new local institution Public institution ‘’Ratkovic ‘s Evenings of Poetry’’ in order to institutionalize the same manifestation of the national importance and to create preconditions for establishment of Film Center of Montenegro.

The expected result of this measure, regarding reorganization of existing public institutions is the establishment of efficient, rational, top-quality and highly professional model of internal organization and the functioning of institutions, so that in accordance with it redefinition of existing program profiling and bigger quantitative and qualitative contribution to contemporary Montenegrin artistic production. Also, the employment of new  skilled personnel of specializing profile, the improvement of infrastructural conditions and technological and technical organization, stronger integration of creative endeavor of institutions into regional and European cultural networks, the continuity of existing sources of financing with tendency to increase their own income and use international funds, the increase in the number of consumers of cultural products, wider circle of artists and other actors who express and exchange creative potentials through institutional framework.

Finances designed for implementation of this  measure at national level are provided within statutory rate of 2,5 % overall, which are allocated for the culture from the budget of Montenegro and at local level from the budgets of the municipalities in accordance with their financial possibilities. When it comes to cinematography the film fund is predicted as additional source, beside the rate mentioned.

Report on implementation National Program for Development of Cultur) 2011-2015, for 2015 noted that implantation of Law on Culture at national level was complete. On the other hand, by last report on implementation of Law on Culture at local level certain shifts was detected in relation to previous years, but tardiness of the municipalities regarding implementation of Law and reorganization of public institutions in accordance with standards established by that act is still obvious, and proper preconditions for continuous and consistent development of culture are not created.

UNESCO CDIS, conducted in 2015 in Montenegro, within “Policy and institutional framework for culture” gave a general review of the institutional framework. In that context, Montenegro accomplished the result 1/1 for sub-indicator of the institutional framework, which, as it was stated, points to the fact that coherent administrative and institutional framework exists, as well as high level of cultural decentralization and the mechanisms for creating favorable environments for emergence of dynamic cultural sectors and promotion of cultural vitality. Besides, certain number of jurisdictions in cultural sphere was decentralized and transferred to municipal bodies. However, the improvement of the framework can still be done, which refers to the implementation of Law on Culture at municipal level.

For determination of the impact about mentioned measure implementation, key indicators are related to: number of reorganized and newly established institutions at national and local level; number of institutions in which management bodies are harmonized with Law on Culture; the number of employees and qualification structure; the successfulness of realization of annual programs of national institutions; the realization of projects of public interest in municipal centres for culture.

Public financial assistance measure - Public call for co-financing of cultural and artistic creativity

Context of the measure:

b. Objetivos clave de la medida: 

Primary objectives of this measure are the improvement of the artistic production level and enabling equal treatment of all the active participants of Montenegrin cultural scene. The goal of measure is realization of continuity of support to development of culture in a transparent way, by means of public open competition along with distinctly defined and announced conditions and qualitative criteria. This is to ensure continuity of public financial support on an annual basis to the projects of independent authors, the institutions of culture and private companies performing the activities of culture, in many fields of cultural and artistic creativity.

Public call for co-financing of cultural and artistic creativity projects of importance to realization of public interest in culture, Ministry of Culture announces at the end of the current year for the next year. This open competition enables support in eight fields: fine arts, musical and music-scene activity, literature, literary translation, journals from the field of culture and art, theatrical production, events and festivals, and film production. Projects are evaluated and selected by the expert committees, which members are referential experts and authors from the subject fields.

The decision about the chosen projects is announced publicly by the end of the first quarter. Summing up the open competition in terms of the overall production of culture, as well as the size of the population of Montenegro, it represents a form of public financial support of importance for a significant number of cultural projects. The project approved can be co-financed up to 50% of amount of total funds needed for its realization. If it is about project of extraordinary importance for culture of Montenegro, it may be co-financed even in a greater amount.

The measure does not refer to directly to the individuals or groups from Article 7 of Convention, but according to public call criteria, the contribution to the creative work of specific groups (the disabled persons, national minorities) or to the gender equality, is significantly valued.

e. What are the results expected through the implementation of the measure?: 

Higher level of production in quantitative and qualitative sense, balanced territorial development of culture, a wide range of diverse cultural expressions and their adequate presentation, innovative projects, mobility of artists and ideas, professional  development of  artists, complementarity of certain cultural projects to touristic offerings of Montenegro and the needs of visitors and thus the economic contribution to the development of cultural and social life,  growing number of consumers of cultural content and audience development.

In the period from the previous report, finances for implementation of this measure of public financial assistance, are provided continually in state budget according to the following amounts and open competition fields:

Public call 2012 – total of 377.850 € for 84 projects and programs,as follows: 17 projects from the field of fine arts; 38 projects from the field of literature and translations of literary works; 2 journals from the field of arts and culture; 8 music projects; 5 theatrical productions; 11 projects in the field of events and festivals and 3 film projects of coproduction with a minority Montenegrin share.

Public call 2013 – total of 474.650 € for 110 projects: 26 projects from the field of fine arts; 12 music projects; 44 projects from the field of literature and translations of literary works;2 journals from the field of arts and culture; 4 theatrical productions; 15 projects in the field of events and festivals; 8 movie projects.

Public call  2014 – total of 475.950 € for 85 projects: 11 projects from the field of fine arts; 10 music projects; 35 projects from the field of literature and translations of literary works; 1 journal from the field of arts and culture; 2 theatrical projects; 18 festivals; 8 movie projects.

Public call  2015 –total of 923.495 € for 94 projects such as : 22 projects in fine arts; 4 music projects; 34 projects from the field of literature and translations of literary works; one journal from the field of arts and culture; 4 theatrical projects; 22 events and festivals, 7 movie projects.

Public call  2016 –total of 868.807 € for 164 projects such as : 32 projects in fine arts; 10 music and musical stage projects; 44literary projects ; 13 projects of translations of literary works;  4 journal from the field of arts and culture; 5 theatrical projects; 28 festivals; 9 movie projects.

In order to contribute to balanced development of culture on the territory of Montenegro, Ministry of Culture has continued in this reporting period the realization of special program - The development of culture in the north, the implemetation of which started in 2009. The intention of the program is to provide qualitative lifting of general level of cultural life and its continuous  improvement through different forms of cultural activity in less developed northern region.

Public call from Program for Development of culture in the north, Ministry of Culture announces at the end of the current year for the next year. This open competition provides support to the projects in all fields of cultural and artistic creativity, through two segments: Co-financing of the projects in thirteen municipalities in the north and co-financing of projects of cooperation and exchange from other regions of Montenegro and which will be realized in the north. The projects, according to legal criteria, are evaluated and chosen by expert committee which members are referential experts and authors from the subject fields. The decision about the chosen projects is announced publicly by the end of the first quarter. Summing up the open competition in terms of the overall production of culture it represents a form of public financial aid for significant part of cultural projects in the north.

Co-financing of manifestations of national importance for culture

Context of the measure: 
CULTURAL POLICIES AND MEASURES
b. Objetivos clave de la medida: 

In an effort to improve all the segments of culture, Ministry of Culture encourages organization of manifestations and festivals of special importance with special care, as multidisciplinary program content. This is a complex way to present the complete national creative potential and to promote creative resource of the communities and their cultural and historical heritage, as well as renowned projects and artists from the region and the world. The objective of this measure is to provide conditions for fulfillment of established criteria for quality of artistic production, referentiality of domestic and foreign participants, the continuity of realization and contribution to promotion of Montenegrin culture and contemporary world trends in culture, literature, media and film, as well as the use of experience and regional cultural practice.

By this measure the continuity of the support is provided for four Montenegrin international festivals which during 2009 and 2010 got the status of special importance for national culture: Montenegro Film Festival in Herceg Novi, Television festival in Bar, International festival Kotor Art in Kotor and Ratkovic‘s Evenings of Poetry in Bijelo Polje. The measure implies partner cooperation between Ministry of Culture and municipalities and making decisions about festival concepts and budgeting, as well as engagement of qualified and highly-professional skilled personnel in creating program contents and executive production.

The measure does not apply directly to individuals or groups from Article 7 of Convention, but in some editions of festivals the segments intended for certain vulnerable groups appear (Kotor Art-Children's theater festival, workshops for children with disabilities etc).

Continuity of realization of manifestations and festivals of special importance; improved program concepts; quality of artistic productions; provided participation of referential and renowned national and foreign artists and performers; following world cultural trends and exchanging ideas; Montenegrin young creative potential animated for active operation; opening new possibilities of Montenegro resources validation.

Financing is arranged by a contract between the ministry and the municipality. In the reporting period, the implementation of this Incentive measure with municipalities was financed in the following amounts:

  • Kotor Art, Kotor – 2013: 513.000 €; 2014: 502.000 €; 2015: 438.000 €;
  • International TV festival, Bar – 2013: 80.000 €; 2014: 80.000 €; 2015: 80.000 €;
  • Montenegro film festival, Herceg Novi – 2013: 107.892 €; 2014: 165.000 €; 2015: 145.000 €;
  • Ratkovic ‘s Evenings of Poetry, Bijelo Polje – 2013: 55.000 €; 2014: 53.100 €; 2015: 54.515 €;

Key conclusions of annual reports of the Ministry are that the support model and model of functioning of manifestations and festivals in several previous years yielded positive results which were to be expected and that it contributed to their better regional positioning but numerous problems have been recognized caused by, first of all, undefined formal legal status (except for newly established institution Ratkovic ‘s Evenings of Poetry). That is the reason why it has been concluded that it is necessary to access reorganization of such manifestations and festivals to proved them with legal subjectivity. This would enable functionality of this financial and institutional measure wholly, and create the conditions for securing other sources of financing.

The objectives of this measure are: the development of media pluralism, support to realization of right of citizen to information, promotion and strengthening of media literacy, development of media scientific thought, then incentive to informing at local level, support to production of contents of public interests. Also, the activities within this measure has as its goal to contribute to informing on key questions of the process of inclusion of Roma and Egyptians into Montenegrin society. This measure implementation has also as a goal the respect of European directives concerning public financial aid to the media and international recommendations for social inclusion of Roma and Egyptians.

This measure refers to two areas of activity: the media programs of public interest and topic about Roma and Egyptian population.

As for the first field, Ministry of Culture, according to media laws and European standards (the recommendations of EU and international conventions) on financial support for the media and according to settled  several-years practice, co-finances the contents of public importance (education, programs on minority languages, etc). The support to the development of media pluralism in the context of realization of freedom of speech is achieved through open competitions for co-financing of program contents in local print media and scientific journals for culture and media theory.

The second segment of this measure, media representation of key questions of integration of Roma population into Montenegrin society, is realized according to obligations from the project “The decade of Romas 2005-2015” and ‘’The strategy for social inclusion of Romas and Egyptians 2016-2020’’. It is conducted through annual Public call for the best research article on the topic ‘’Social integration of Romas in Montenegro’’ and recording audio and visual videos that demonstrate the improvement in key questions of inclusion.

In the period 2012-2016, 47 projects were co-financed in local print media and scientific journals for media culture and theory. Four awards were co-financed per Public call on the topic ‘’Social integration of Romas in Montenegro’’ and for audio-visual videos through which key questions of Roma-Egyptian population integration are represented.

Key objectives of this measure are the creation of diplomatic and formal-legal preconditions for interstate cultural cooperation and dialogue strengthening, and facilitating the exchange of projects, artists and ideas. Furthermore, this create predisposition for intercultural dialogue development,  connection of close and distant cultures and openness for interaction of new cultural expressions, traditions and creativity. In addition, this measure is important for the valorisation of economic potential through opening up for new cultural processes and markets. Having in mind the tourism potential of Montenegro, this measure, in this context, aims at enriching the cultural and tourist offer.

In the reporting period , the following bilateral agreements and programs were signed:

  • In 2012: Agreement between Government of Montenegro and Poland on cooperation in the field of culture, education and science; Program for cultural cooperation between Ministry of Culture of Montenegro and People's Republic of China for the period 2012-2015.
  • In 2014: Cooperation agreement in the fields of culture and education between Government of Montenegro and Government of the Republic of Italy and Program for cultural cooperation between Ministry of Culture of Romania and Ministry of Culture of Montenegro.
  • In 2015: Agreement between Government of Montenegro and Government of the Republic of Bulgaria on cooperation in the field of culture; Agrement on cooperation in the field of culture with the Ministry of Culture of Cuba.
  • In 2016 are made, adjusted and signed: Executive program of cooperation in the field of culture 2017-2020 with Ministry of Culture of People's Republic of China; Memorandum on  understanding and mutual cooperation between Institute of Technologies of cultural hereditary ITABC the National Research Council of Italy, the University of Montenegro, Historical Institute of Montenegro and Ministry of Culture; and Agreement on cooperation in the fields of culture and education with Slovenia.

Developed inter-cultural dialogue between signatory countries of the agreements and bigger openness of Montenegrin cultural scene and society as a whole, for new trends in culture and new aspects of co-operation, are also on of the results wanted.

b. Objetivos clave de la medida: 

Participation in international programs, generally, has as its objective in approach European cultural standards and to strengthen Montenegrin cultural scene and its artistic production. The activities in this measure refer to numerous programs, especially in EU, among which the following programs are the most important:

- Creative Europe as a program of EU Commission for cultural and audio and visual sector, has as key objectives: aid for cultural and creative sector for usage of the possibilities of digital era and globalization; enabling the sector to reach economic potential along with contribution to sustainable development, employment and social cohesion; support for access to new international possibilities, markets and audience.

- Europe for Citizens - the objectives of participation in this program are: contribution to civic understanding of EU, its history and diversity; the promotion of European citizenship and improvement civic and democratic participation at European level; to raise awareness of memories, common past and values; stimulus of democratic participation of citizens at European level through development of understanding of EU process of policy creation through promotion of opportunities for social and intercultural involvement and volunteering.

- IPA EU program, ArtVision project - IPA is new framework for pre-accession help for candidate countries among which is Montenegro. Key objectives of participation in this program, through project ArtVision, refer to: networking of cultural scenes of countries  participating in this project, stimulus and support for new productions in the field of visual arts, increased mobility of artists, networking of cultural institutions and Arts Faculties, the exchange of experiences, positive practices and common research activity. 

- Anna Lindh Foundation – the development of intercultural dialogue in the area of Europe and the Mediterranean; improvement of tolerance and mutual respect among cultures, as well as support to civil society, international networking of NGOs, institutions, individuals.

Within this measure, Ministry of Culture, based on signed documents, implements the programs as institution coordinator in charge of promotion and implementation of the above mentioned programs in Montenegro. Therefore, the activities of this measure are: dissemination of information and education about available programs, propositions and criteria for applying, announcing of program public calls, conducting websites, organization of Info Days and seminars, direct consultations, logistic and professional help, monitoring and evaluation, workshops for intercultural dialogue (through projects of Anna Lindh Foundation). By such activities and by participation of Montenegrin institutions of culture and civil society organizations, cultural sector strengthening is stimulated and preconditions for its more dynamic and more open development are created, in terms of contemporary trends and trans-border networking and exchange of ideas and expressions.

The expected results of this measure implementation, among other things, are: Enhanced capacities of programs users for realization of new projects; Strengthening of the base for creation of new sector policies; Improvement of cultural and artistic production; Internationalization of creativity and increased mobility of artists.

By participating in such EU programs new partnerships are created continuously, deals are made about co-production and common activities at international level are implemented (project in which participated: Royal Theater, Cetinje; National library, Cetinje, NGO Expeditio, Kotor, etc). Also, participating in international programs has aim to improve dialogue and co-operation of public institutions, civil sector and creative industries and their involvement in the domain of research and public policies. Besides, results expected refer to exchange between cultural workers and institutions. Creative industries are also important segment, where the results in the domain of improvement of creative and production capacities are expected,considering underdevelopment and unused potentials in that field.

One of the key challenges in Montenegrin culture is the fact that the sector relies chiefly on national funds and certain means allocated by municipalities for culture. It is through this measure that participation in other sources of financing and donorship from international programs intended for culture are promoted.

Finances allocated for implementation of this measure refer to annual contribution for membership in such programs or individual projects (IPA ArtVision).

- Annual contribution paid by Ministry for participating in Creative Europe program for 2014 was 25.000 euros, and for 2015 and 2016, 60.000euros each.

- Europe for Citizens, form the budget has been allocated total of 45.000 euros for annual contributions for 2014, 2015 and 2016.

- Anna Lindh Foundation, for the realization of the programs and projects in the network of this foundation in Montenegro, the financial contribution of Ministry was around 2.000 euros, while the Foundation itself donated around 20.000 euros.

- IPA, ArtVision – total budget for Montenegro, in this IPA Adriatic trans-border regional program which was realized in the period 2013.-2015., was 377.350,00 euros, of which the participation of the budget was 15 %.

As some of the reasons, human and professional capacities are mentioned as well as the challenges facing the civil sector when applying for this programs and funds.

The Strategy of Government of Montenegro for improvement of life quality of LGBT persons in Montenegro 2013-2018 (LGBT Strategy) in part that refers to cultural changes has as a goal to improve cultural values of importance for acceptance and social inclusion of LGBT population. Cultural changes as the key objective are stimulated by a series of strategic measures, among which are the support for cultural activities of LGBT community, involvement in contemporary cultural trends, positioning of cultural contents from the domain of LGBT expression in annual programs of public institutions for culture, cooperation with LGBT community in questions of importance for identity and development of creativity. Therefore, key objectives of this measure are the contribution to development of cultural tolerance and openness for LGBT persons, through becoming recognized in the field of culture and creation of cultural space for development and presentation of LGBT scene as a part of new social and cultural platform.

In domain of culture, this measure primarily refers to realization of concrete cultural-artistic programs and projects of authors from LGBTIQ population, and theme or questions from the life of that community. In particular, in the reporting period, in the domain of activity of Ministry of Culture, artistic programs and expert meetings have been realized, that is:

- Realization of photo exhibition entitled ‘’Here we are - Five years of visibility of LGBT activism in Montenegro’’ as common activity of Ministry of Culture and Public Institution ‘’Center of Contemporary Art’’ in partnership with NGOs Queer Montenegro and Juventas (October 2014);

- In municipal institution Cultural and Information Center ‘’Budo Tomović’’ Podgorica, the photo exhibition,’’Find the difference’’ of artist Maja Kovijanić was opened, as partner activity between Ministry of Culture and NGO ‘’Queer Montenegro’’ (December 2015);

- A panel discussion was held at the Ministry of Culture entitled ‘’Cultural expressions of minority identities’’. The panel was relized in cooperation with Montenegrin Network of Anna Lindh Foundation and NGO ‘’Queer Montenegro’’ (December 2015);

- Panel discussion ‘’Queer and other identities in contemporary theoretical and cultural practices’’ in cooperation with NGO ‘’Queer Montenegro’’,  with the presence of national institutions of culture and civil sector.

d. Does it specifically target individuals and/or social groups as defined in Article 7 of the Convention?:

e. What are the results expected through the implementation of the measure?: 

This  measure implementation was focused on the following results: stimulating of new cultural platforms development that affirm LGBT creativity and art; providing the space for promotion and presentation of expressions of LGBT population, queer culture and related forms of author creativity. In this sense, the expected results are the creation and affirmation of the LGBT cultural scene in Montenegro, along with obligation to include the cultural content of LGBT creativity in the regular programs of public institutions of culture, which is part of the process of developing tolerance and openness for the LGBT community, and contributing to the greater visibility of this community towards the promotion of inclusive social context.

The results of Panel discussions which were organized within this measure are acquaintance of cultural institutions representatives with the theme and socio-cultural contexts of queer expressions and LGBT identity. The focus of the panel, along with education, was put on the emancipation of phenomena mentioned in wider social framework, with intention to lower the animosities towards LGBT population.

The Government of Montenegro has at the end of 2007 adopted the Strategy for integration of disabled persons in Montenegro for the period 2008-2016. It is the first strategic document by which the actual state in which are the disabled persons analyzed, along with a series of measures and recommendations that should be undertaken in order to improve their status. The document comprised, among others, the field: culture, sport and recreation, as well as the field referring to the status of the disabled persons in civil society. Through document mid-term projection of the state and status of the disabled persons in this field has been created, having as goal to strengthen creative potential, paticipation in cultural events and improvement of accessibility of cultural contents.

The level of involvement of persons with disabilities in cultural events, in one part, is determined by legal restrictions regarding intervention of accessibility on objects that are protected by cultural heritage, then by lack of finances of national and municipal institutions as well as other organizations to organize to the full extent and support the development of artistic potential  of persons with disabilities. Therefore, this process requires continuity and intensive stimulating of policy of development of programs from the field of culture intended for this population.

The project ‘’Culture for Development Indicators-CDIS  has as a goal to show the role which the culture has as supporter and initiator of sustainable development.  With the help of innovative methodology, by this means of public advocacy and policies through the facts and data multidimensional relationship between culture and development is analyzed. Realization of this UNESCO project has as a goal the creation of 22 indicators in 7 social dimensions, which measure the impact of culture on development of the country, giving the analysis and data for cultural and development policies improvement as well as promotion of stronger integration of culture in national developing strategies.

Conducting of CDIS in Montenegro has started at the beginning of 2015, and data gathering process and analysis drafting was finished in April the same year, after which it was worked on further analysis in accordance with UNESCO CDIS Methodology. By research od 22 CDIS Indicators through this project policies of  seven key fields were analyzed: Economics; Education; Governing; Social Participation; Gender equality; Communication and Cultural heritage. After the preparatory phase during which Montenegrin CDIS team made acquaintance with CDIS Methodology and had identified data sources, the implementation process was initiated officially at the workshop on February the 23rd 2015. The workshop gathered participants from state institutions, Universities, civil society and media which discussed about potential of the project in the context of Montenegro, and identified additional data sources and established working partnerships. The participants expressed great interest in innovative methods of CDIS and have recognized the potential of it as the means for providing information for institutional dialogue and public advocacy of involvement of culture in developing strategies. Implementation has been completed on April the 15th 2015 when the beginning results of Montenegro for CDIS indicators were presented at closing workshop in Podgorica.

In accordance with the vision of CDIS project and experiences of countries in which it was realized, the CDIS implementation in Montenegro has concrete expected results. At national level, new facts and data were obtained, as well as their analysis and contextualization, should help in rising awareness on importance of culture, strengthening cultural and developing agenda, providing information for creation policies of  development and strategies, strengthening national statistics and monitoring system, taking steps toward EU integrations and achievement European standards in statistics, as well as improvement of inter-institutional dialogue and cooperation.

Evaluation of this measure was initiated at second workshop. In the key document that resulted from the project, Analytical brief, certain impacts were stated as well as additional values which this project possesses in Montenegro: raising awareness on developing potential of culture among active participants in the cultural sector and beyond it; the involvement of culture in national development agenda is being strengthened; shortcomings in statistics and monitoring system were discovered, pointing to the way for improvement and strengthening of such systems; CDIS has helped also in discovering the possibility of cooperation in the field of culture and development among involved parties. CDIS indicators for Montenegro contribute to the outcomes of CDIS at international level; Unique data are obtained along with indicators of other countries, in international database; by these data and their analysis, public advocacy and promotion of culture in developing agenda is strengthened by using facts and data, and comparative understanding of impact of culture on development is alleviated and the help is given in stimulating of involvement of cultural indicators in developing instruments and measures which are widely used.

            Besides, the impact and application of the results of this measure, that is, the project, they were presented at regional conference of Countries of South East Europe in which CDIS project has been initiated or is in the preparation, in April of 2016 in Belgrade, Serbia. It was noted that, among other things, the results and suggestions from CDIS were used during creation of Program for Development of Culture of Montenegro 2016-2020.

i.3 Which indicators were used to determine impact?: 

Realization of CDIS project implied the making of 22 key indicators in 7 dimensions of culture and development. Of 22 indicators, 16 could be made and interpreted using available Montenegrin and international sources (rate of implementation 73%). Besides, one alternative indicator was created for the dimension of gender equality and 1 additional indicator for dimension of communication.

Beside projects, the indicators for determination of impact of this measure realization are: incorporation of the results and conclusions from CDIS during creation of cultural policies and sector strategies, the improvement of representation of culture  and developing documents, the participation of interested parties during implementation of measure, innovated statistical data.

In January of 2013 Action Plan for Achieving Gender Equality in Montenegro 2013-2017 was adopted – developing document for policy of gender equality implementation, based on international and domestic legal sources which treat the issues of gender equality. The mission is to ensure gender equality in creating and conducting of all national and local policies, as well as in work of all legal subjects at state level.

In the field 6 of APAGE 2013-2017: Media and Culture the following measures are defined: the promotion of APAGE; To conduct the analysis of media reporting in terms of gender equality; To perform monitoring of media reporting continuously; To organize educational workshops for the ones employed in media on the topic of gender equality; To initiate conducting of statistics by sex of the ones employed in media; To print, present and distribute brochure on the role of media in promoting  gender equality; To organize educational workshops for the ones employed in local self-government and institutions of culture; To organize the Week of female cultural creativity (ŽENES); To prompt introduction of continuous programs which promote successful women in electronic and printed media, then women who deal with old crafts and skills; To participate in book fair with literature on gender equality. Within implementation of APAGE, the two-years Programs of implementation are defined, with activities and indicators.

Ministry for Human and Minority Rights has engaged an expert from abroad who has conducted external evaluation of overall APAGE 2013-2017 which will be soon available at link: http://www.minmanj.gov.me/ministarstvo. Preliminary evaluation has shown that improvement of legislative and institutional framework for achievement of Gender Equality  has occurred, and that visible results in all filed of life both at national and local level exist, but that space for further activity in order to create equal conditions for all the citizens (of both sexes) of Montenegro is present still.

In preparing APAGE  for  2017-2021, the analysis was given of actual state after implantation of APAGE for 2013-2017, in the fields of media and culture. Among other things, it is mentioned that during previous years numerous activities were conducted, so as to media to be active participants in implementation of Gender equality policy. Unfortunately, the role of media is not still strong enough in the part of promotion of Gender Equality, but is subject to corporative objectives and sexist advertising programmes. In the domain of culture and art, the presence of women is greater and their success is more visible. However,  in the works of culture themselves, stereotyped presentation of woman which affects the upbringing of girls and boys both is still present, as well as creation of new stereotypes and patterns of behavior.

i.3 Which indicators were used to determine impact?: 

By two-years programs of conducting APAGE (for 2013-2014 and for 2015-2016) the indicators of realization were defined, which, among other things, implied: Number of media performances and reports connected with APAGE; The conducted analysis of media reporting which is in terms of Gender Equality; The number of organized workshops and trained representatives of media, institutions of culture and municipalities on Gender Equality; Gathered and published data of employees in media and sorted by sex; Brochures published; The number of co-financed quality cultural-artistic programs and projects that make Gender Equality recognized; organizing of Women's Creation Week and number of events, number of actresses that participated; Number of media programs that make successful women recognized and that promote creativity of women dealing with old crafts and skills; the participation in the book fair with literature on Gender Equality.

One of the key goals of this measure is the creation of quality Youth Strategy in which the field of culture will be represented in a satisfactory way. In the context of such segment, the making and adoption of above-mentioned Strategy has as a goal to support young creators of culture and of media contents and providing equal access to cultural contents for all the young people.

In the reporting period, along with participation of representatives of public bodies and civil sector in culture, the state analyses were conducted and the Proposal for Youth Strategy 2017-2021 was created. Government adopted the Strategy in 2016 along with Action plan for the first year of its implementation.

Youth Strategy as key national document envisages the priorities and positions the system of support for young people in developing process of their growing up. This document with regulatory and financial aspect, has multilayer structure: Youth Strategy, the Plan of Strategy Implementation and Strategy monitoring and evaluation. Strategy is based on legislative foundation (Law on Youth, 2016) and strategic instruments for conducting youth policy, in institutional framework at national, local and international level. With clearly presented vision, young people in Montenegro are comprised through six fields in the form of key outcomes from the domains of: economic and social security, quality education, participation in decision-making process, the development of community and policies conducting, through health care system, access to quality cultural contents as well as establishment of normative and institutional framework for conducting youth policy, and their needs being in compliance with valid standards of international youth policy.

The process of making national Youth Strategy is conducted by Directorate for Youth and Sports and Ministry of Education. The process was supported by The UN system in Montenegro, within the common program of UN for strengthening youth especially.

  • More significant promotion of talented young creators;
  • Greater contribution of cultural contents to young people affected by poverty:
  • Stronger networking of young creators and amateurish cultural societies through innovative models conducting and usage of resources in the county, but also of young renowned creators from diaspora;
  • Greater number of travelling cultural contents (mobile cinemas, libraries, theatre etc);
  • Availability of information on cultural contents intended for young people in one place through unique internet portal;
  • Greater consumption of cultural contents by young people with visual and hearing impairments or with  other disorders and difficulties in development, through providing greater availability.

The improvement of legal framework, by passing new laws and by-laws has as its goal to create good basis for institutional and organizational reform in the cultural sector, that is, in the sector of cultural and artistic creativity. This is to ensure the development of culture at national and local level in the long term. By this measure, legal basis aimed at encouraging inclusive cultural development as well as at structuring of dynamic cultural sectors and diversity promotion, is being improved. Generally, the aim is to innovate legal framework in accordance with European legal framework and contemporary standards. The measure was specifically aimed at creating a new legal basis in the field of publishing and cinematography. The intention of legislator is to revitalize the activities listed, full valorization of their creative and economic potentials as well as incentive to the cultural expressions of Montenegrin artists.

After the adoption of the Law on Culture (2008) and the set of laws from the cultural heritage (2010), as thorough acts which established the model of organization of cultural sector, in the previous reporting period several laws were made which completed legal framework in the sphere of cultural and artistic creativity, by which development goals defined by The National program regarding strengthening legal infrastructure have been fully realized.

The Law on Publishing Activity (2012) - The new law has the intention to incite the development of that activity by means of determined conditions and priorities and through statutory rights and obligations of the publisher, pressman, distributor and the roles of the state to incite appropriate activities in publishing.

The Law on Amendments of the Culture Law (2012) - was adopted due to need for compliance with the new Law on NGOs and due to regulation of certain rights of independent artists.

Law on Cinematography (2015) - new law has as its aim to provide long-term development of this domain and the solution of those questions that proved to be the weakest links. Among other things, the law defines the establishment of Film center, film fund, as well as the opportunity of rebate to the foreign producer for recording in Montenegro, as a stimulating measure.

Provisions of Laws mentioned in their basic provisions point out the encouragement of creativity of certain groups: members of minority peoples and minority national community, children and the young, the disabled persons and of gender equality. In addition to the above mentioned, for the purpose of complete implementation of existing and newly adopted laws, a certain number of by-laws has been adopted.

Putting this measure into effect by which legal bases in publishing and cinematographic activity are innovated, their quantitative and qualitative improvement is to be expected, as well as more intensive distribution of creative work of Montenegrin artists within and beyond the borders of Montenegro.

Within the publishing activities pursuant to the established priorities, the following thins are  expected: greater copyright protection, the respect of professional standards,  the improvement of the quality of publishing projects, the increase in translation into Montenegrin language as well as in translating in foreign languages, significant involvement of publishing companies and the authors in regional and European networks and international funds, greater artists’ mobility, publishing  of capital editions of Montenegrin literature and their translations, the improvement of book market as well as the improvement of the work of the professional associations.

Within the cinematographic activity pursuant to recognized tasks of public interest the following is expected: bigger production and co-production of cinematographic and television works, diversity of movie content as well as representation of national and coproduction works on television and in the cinemas, the continuity of film production, bigger participation of young Montenegrin personnel, involvement of production companies and authors in the international programs which is supposed to be more important (Creative Europe, the MEDIA sub-programme), involvement in associations (European Film Promotion) and in funds, bigger aritists’ mobility, useful work of new institution – Film Center of Montenegro, establishment of a film fund, increased presence of foreign producers and foreign filming in Montenegro by implementing defined incentive measures, stronger promotion and utilization tourist and cultural  resources of the country.

The evaluation of measure has been conducted at national level through the preparation of Program of Cultural Development of Montenegro 2016-2020. and through analysis of existing condition and achievements in the fields in which the new laws have been enacted, namely, where this measure has been implemented.

The evaluation of the measure has been conducted also at international level, through the  accession process of negotiation for joining European Union (EU) , as well as through the project of UNESCO “Culture for Development Indicators - CDIS’’, conducted in 2015 in Montenegro. It was noted that legislative reforms in the cultural sector have been brought to an end, which provided the normative regulation of the cultural sector in accordance with European legal framework and which was confirmed by the opening and provisional closure of Chapter 26 – Education and culture, in Montenegro's accession process to the European Union. CDIS analysis has indicated that ‘’there is already a significant standard-setting framework for culture in place and that the national authorities have made many efforts to ratify key international legal instruments affecting cultural development, cultural rights and cultural diversity, as well as to establish a national framework to recognize and implement these obligations”.

CDIS has been used for the influence of measure on entire legal framework. In the indicator defined ‘’Standard-setting framework for culture’’ adequate sub-indicator  for national level had the result of 0,87 out of maximum 1.

Objectives of this measure were focused on two key aspects: the reorganization and development of existing national and municipal cultural institutions and creating new institutions. Regarding reorganization, the objectives are concentrated on obviation of shortcomings of the previous organizational models of institutions, improvement of managerial and governing as well as personnel structure, modernization and reconstruction of spatial and technical capacities. Regarding the creation of new institutions, the objective was to raise the qualitative and organizational level of functioning of certain cultural activities in accordance with the recognized needs and comparative international examples of institutional organizing.

Reorganization of existing national cultural institutions, implied chiefly the implementation of new models of  management and governing defined by Law on culture from 2008, which, for the beginning, implied the adoption of founding acts and statutes of the institutions by the founder (state or municipalities). In order to carry out further steps in the contexts of the objective of this measure, Ministry of Culture issued Development strategy of public institutions from the sphere cultural and artistic creativity 2013-2018 which defined the courses of reorganization of national institutions through: their program specialization on the principles of sustainable development, strengthening of personnel, spatial and technical and technological capacities and providing the financing of the work of institutions, as  well as other questions in order to improve overall potential of national institutions in the medium-term period. At the local level, this measure implied the obligation of municipalities to issue new founding acts and to name new management and governing bodies in accordance with Law on culture, and after that to reorganize the institutions in the sense that existing municipal institutions of culture with complex activities become separated into special institutions for cultural and artistic creativity and for cultural heritage (museums and libraries).

The establishment of new institutions meant two activities: the formation of new local institution Public institution ‘’Ratkovic ‘s Evenings of Poetry’’ in order to institutionalize the same manifestation of the national importance and to create preconditions for establishment of Film Center of Montenegro.

The expected result of this measure, regarding reorganization of existing public institutions is the establishment of efficient, rational, top-quality and highly professional model of internal organization and the functioning of institutions, so that in accordance with it redefinition of existing program profiling and bigger quantitative and qualitative contribution to contemporary Montenegrin artistic production. Also, the employment of new  skilled personnel of specializing profile, the improvement of infrastructural conditions and technological and technical organization, stronger integration of creative endeavor of institutions into regional and European cultural networks, the continuity of existing sources of financing with tendency to increase their own income and use international funds, the increase in the number of consumers of cultural products, wider circle of artists and other actors who express and exchange creative potentials through institutional framework.

Report on implementation National Program for Development of Cultur) 2011-2015, for 2015 noted that implantation of Law on Culture at national level was complete. On the other hand, by last report on implementation of Law on Culture at local level certain shifts was detected in relation to previous years, but tardiness of the municipalities regarding implementation of Law and reorganization of public institutions in accordance with standards established by that act is still obvious, and proper preconditions for continuous and consistent development of culture are not created.

UNESCO CDIS, conducted in 2015 in Montenegro, within “Policy and institutional framework for culture” gave a general review of the institutional framework. In that context, Montenegro accomplished the result 1/1 for sub-indicator of the institutional framework, which, as it was stated, points to the fact that coherent administrative and institutional framework exists, as well as high level of cultural decentralization and the mechanisms for creating favorable environments for emergence of dynamic cultural sectors and promotion of cultural vitality. Besides, certain number of jurisdictions in cultural sphere was decentralized and transferred to municipal bodies. However, the improvement of the framework can still be done, which refers to the implementation of Law on Culture at municipal level.

For determination of the impact about mentioned measure implementation, key indicators are related to: number of reorganized and newly established institutions at national and local level; number of institutions in which management bodies are harmonized with Law on Culture; the number of employees and qualification structure; the successfulness of realization of annual programs of national institutions; the realization of projects of public interest in municipal centres for culture.

Public financial assistance measure - Public call for co-financing of cultural and artistic creativity

Primary objectives of this measure are the improvement of the artistic production level and enabling equal treatment of all the active participants of Montenegrin cultural scene. The goal of measure is realization of continuity of support to development of culture in a transparent way, by means of public open competition along with distinctly defined and announced conditions and qualitative criteria. This is to ensure continuity of public financial support on an annual basis to the projects of independent authors, the institutions of culture and private companies performing the activities of culture, in many fields of cultural and artistic creativity.

Public call for co-financing of cultural and artistic creativity projects of importance to realization of public interest in culture, Ministry of Culture announces at the end of the current year for the next year. This open competition enables support in eight fields: fine arts, musical and music-scene activity, literature, literary translation, journals from the field of culture and art, theatrical production, events and festivals, and film production. Projects are evaluated and selected by the expert committees, which members are referential experts and authors from the subject fields.

The decision about the chosen projects is announced publicly by the end of the first quarter. Summing up the open competition in terms of the overall production of culture, as well as the size of the population of Montenegro, it represents a form of public financial support of importance for a significant number of cultural projects. The project approved can be co-financed up to 50% of amount of total funds needed for its realization. If it is about project of extraordinary importance for culture of Montenegro, it may be co-financed even in a greater amount.

The measure does not refer to directly to the individuals or groups from Article 7 of Convention, but according to public call criteria, the contribution to the creative work of specific groups (the disabled persons, national minorities) or to the gender equality, is significantly valued.

Higher level of production in quantitative and qualitative sense, balanced territorial development of culture, a wide range of diverse cultural expressions and their adequate presentation, innovative projects, mobility of artists and ideas, professional  development of  artists, complementarity of certain cultural projects to touristic offerings of Montenegro and the needs of visitors and thus the economic contribution to the development of cultural and social life,  growing number of consumers of cultural content and audience development.

In the period from the previous report, finances for implementation of this measure of public financial assistance, are provided continually in state budget according to the following amounts and open competition fields:

Public call 2012 – total of 377.850 € for 84 projects and programs,as follows: 17 projects from the field of fine arts; 38 projects from the field of literature and translations of literary works; 2 journals from the field of arts and culture; 8 music projects; 5 theatrical productions; 11 projects in the field of events and festivals and 3 film projects of coproduction with a minority Montenegrin share.

Public call 2013 – total of 474.650 € for 110 projects: 26 projects from the field of fine arts; 12 music projects; 44 projects from the field of literature and translations of literary works;2 journals from the field of arts and culture; 4 theatrical productions; 15 projects in the field of events and festivals; 8 movie projects.

Public call  2014 – total of 475.950 € for 85 projects: 11 projects from the field of fine arts; 10 music projects; 35 projects from the field of literature and translations of literary works; 1 journal from the field of arts and culture; 2 theatrical projects; 18 festivals; 8 movie projects.

Public call  2015 –total of 923.495 € for 94 projects such as : 22 projects in fine arts; 4 music projects; 34 projects from the field of literature and translations of literary works; one journal from the field of arts and culture; 4 theatrical projects; 22 events and festivals, 7 movie projects.

Public call  2016 –total of 868.807 € for 164 projects such as : 32 projects in fine arts; 10 music and musical stage projects; 44literary projects ; 13 projects of translations of literary works;  4 journal from the field of arts and culture; 5 theatrical projects; 28 festivals; 9 movie projects.

In order to contribute to balanced development of culture on the territory of Montenegro, Ministry of Culture has continued in this reporting period the realization of special program - The development of culture in the north, the implemetation of which started in 2009. The intention of the program is to provide qualitative lifting of general level of cultural life and its continuous  improvement through different forms of cultural activity in less developed northern region.

Public call from Program for Development of culture in the north, Ministry of Culture announces at the end of the current year for the next year. This open competition provides support to the projects in all fields of cultural and artistic creativity, through two segments: Co-financing of the projects in thirteen municipalities in the north and co-financing of projects of cooperation and exchange from other regions of Montenegro and which will be realized in the north. The projects, according to legal criteria, are evaluated and chosen by expert committee which members are referential experts and authors from the subject fields. The decision about the chosen projects is announced publicly by the end of the first quarter. Summing up the open competition in terms of the overall production of culture it represents a form of public financial aid for significant part of cultural projects in the north.

In an effort to improve all the segments of culture, Ministry of Culture encourages organization of manifestations and festivals of special importance with special care, as multidisciplinary program content. This is a complex way to present the complete national creative potential and to promote creative resource of the communities and their cultural and historical heritage, as well as renowned projects and artists from the region and the world. The objective of this measure is to provide conditions for fulfillment of established criteria for quality of artistic production, referentiality of domestic and foreign participants, the continuity of realization and contribution to promotion of Montenegrin culture and contemporary world trends in culture, literature, media and film, as well as the use of experience and regional cultural practice.

By this measure the continuity of the support is provided for four Montenegrin international festivals which during 2009 and 2010 got the status of special importance for national culture: Montenegro Film Festival in Herceg Novi, Television festival in Bar, International festival Kotor Art in Kotor and Ratkovic‘s Evenings of Poetry in Bijelo Polje. The measure implies partner cooperation between Ministry of Culture and municipalities and making decisions about festival concepts and budgeting, as well as engagement of qualified and highly-professional skilled personnel in creating program contents and executive production.

The measure does not apply directly to individuals or groups from Article 7 of Convention, but in some editions of festivals the segments intended for certain vulnerable groups appear (Kotor Art-Children's theater festival, workshops for children with disabilities etc).

Key conclusions of annual reports of the Ministry are that the support model and model of functioning of manifestations and festivals in several previous years yielded positive results which were to be expected and that it contributed to their better regional positioning but numerous problems have been recognized caused by, first of all, undefined formal legal status (except for newly established institution Ratkovic ‘s Evenings of Poetry). That is the reason why it has been concluded that it is necessary to access reorganization of such manifestations and festivals to proved them with legal subjectivity. This would enable functionality of this financial and institutional measure wholly, and create the conditions for securing other sources of financing.

b. Objetivos clave de la medida: 

The objectives of this measure are: the development of media pluralism, support to realization of right of citizen to information, promotion and strengthening of media literacy, development of media scientific thought, then incentive to informing at local level, support to production of contents of public interests. Also, the activities within this measure has as its goal to contribute to informing on key questions of the process of inclusion of Roma and Egyptians into Montenegrin society. This measure implementation has also as a goal the respect of European directives concerning public financial aid to the media and international recommendations for social inclusion of Roma and Egyptians.

This measure refers to two areas of activity: the media programs of public interest and topic about Roma and Egyptian population.

As for the first field, Ministry of Culture, according to media laws and European standards (the recommendations of EU and international conventions) on financial support for the media and according to settled  several-years practice, co-finances the contents of public importance (education, programs on minority languages, etc). The support to the development of media pluralism in the context of realization of freedom of speech is achieved through open competitions for co-financing of program contents in local print media and scientific journals for culture and media theory.

The second segment of this measure, media representation of key questions of integration of Roma population into Montenegrin society, is realized according to obligations from the project “The decade of Romas 2005-2015” and ‘’The strategy for social inclusion of Romas and Egyptians 2016-2020’’. It is conducted through annual Public call for the best research article on the topic ‘’Social integration of Romas in Montenegro’’ and recording audio and visual videos that demonstrate the improvement in key questions of inclusion.

The results of this measure are the contributions to the improvement of freedom of speech and quality and  the diversity of program contents. What is also important for the development of the media pluralism is expected increase in number of local print media.

In the reporting period, from 75.000 to 120.000 euros were allocated annually for project co-financing in local print media and scientific journals for media theory and culture, as well as 10.000 euros for the realizations of obligations from “The strategy for social inclusion of Romas and Egyptians’’. In the period 2012-2016, 47 projects were co-financed in local print media and scientific journals for media culture and theory. Four awards were co-financed per Public call on the topic ‘’Social integration of Romas in Montenegro’’ and for audio-visual videos through which key questions of Roma-Egyptian population integration are represented.

INTERNATIONAL CULTURAL COOPERATION
b. Objetivos clave de la medida: 

Key objectives of this measure are the creation of diplomatic and formal-legal preconditions for interstate cultural cooperation and dialogue strengthening, and facilitating the exchange of projects, artists and ideas. Furthermore, this create predisposition for intercultural dialogue development,  connection of close and distant cultures and openness for interaction of new cultural expressions, traditions and creativity. In addition, this measure is important for the valorisation of economic potential through opening up for new cultural processes and markets. Having in mind the tourism potential of Montenegro, this measure, in this context, aims at enriching the cultural and tourist offer.

Basic activities refer to preparation, negotiation, adjustment, conclusion and implementation of bilateral and multilateral agreements with geostrategic partners and countries with which traditional relations are treasured. In the reporting period , the following bilateral agreements and programs were signed:

  • In 2012: Agreement between Government of Montenegro and Poland on cooperation in the field of culture, education and science; Program for cultural cooperation between Ministry of Culture of Montenegro and People's Republic of China for the period 2012-2015.
  • In 2014: Cooperation agreement in the fields of culture and education between Government of Montenegro and Government of the Republic of Italy and Program for cultural cooperation between Ministry of Culture of Romania and Ministry of Culture of Montenegro.
  • In 2015: Agreement between Government of Montenegro and Government of the Republic of Bulgaria on cooperation in the field of culture; Agrement on cooperation in the field of culture with the Ministry of Culture of Cuba.
  • In 2016 are made, adjusted and signed: Executive program of cooperation in the field of culture 2017-2020 with Ministry of Culture of People's Republic of China; Memorandum on  understanding and mutual cooperation between Institute of Technologies of cultural hereditary ITABC the National Research Council of Italy, the University of Montenegro, Historical Institute of Montenegro and Ministry of Culture; and Agreement on cooperation in the fields of culture and education with Slovenia.

Expected results of this measure reflect in greater realization of particular cooperation  projects and programs with other countries, greater mobility of artists and ideas in all field of cultural and artistic creativity, and creation of preconditions also for new film co-productions. Also, closer expert support is expected and the exchange of the experiences in the fields for which the agreements have been signed. Developed inter-cultural dialogue between signatory countries of the agreements and bigger openness of Montenegrin cultural scene and society as a whole, for new trends in culture and new aspects of co-operation, are also on of the results wanted.

Context of the measure: 
INTERNATIONAL CULTURAL COOPERATION
b. Objetivos clave de la medida: 

Participation in international programs, generally, has as its objective in approach European cultural standards and to strengthen Montenegrin cultural scene and its artistic production. The activities in this measure refer to numerous programs, especially in EU, among which the following programs are the most important:

- Creative Europe as a program of EU Commission for cultural and audio and visual sector, has as key objectives: aid for cultural and creative sector for usage of the possibilities of digital era and globalization; enabling the sector to reach economic potential along with contribution to sustainable development, employment and social cohesion; support for access to new international possibilities, markets and audience.

- Europe for Citizens - the objectives of participation in this program are: contribution to civic understanding of EU, its history and diversity; the promotion of European citizenship and improvement civic and democratic participation at European level; to raise awareness of memories, common past and values; stimulus of democratic participation of citizens at European level through development of understanding of EU process of policy creation through promotion of opportunities for social and intercultural involvement and volunteering.

- IPA EU program, ArtVision project - IPA is new framework for pre-accession help for candidate countries among which is Montenegro. Key objectives of participation in this program, through project ArtVision, refer to: networking of cultural scenes of countries  participating in this project, stimulus and support for new productions in the field of visual arts, increased mobility of artists, networking of cultural institutions and Arts Faculties, the exchange of experiences, positive practices and common research activity. 

- Anna Lindh Foundation – the development of intercultural dialogue in the area of Europe and the Mediterranean; improvement of tolerance and mutual respect among cultures, as well as support to civil society, international networking of NGOs, institutions, individuals.

Within this measure, Ministry of Culture, based on signed documents, implements the programs as institution coordinator in charge of promotion and implementation of the above mentioned programs in Montenegro. Therefore, the activities of this measure are: dissemination of information and education about available programs, propositions and criteria for applying, announcing of program public calls, conducting websites, organization of Info Days and seminars, direct consultations, logistic and professional help, monitoring and evaluation, workshops for intercultural dialogue (through projects of Anna Lindh Foundation). By such activities and by participation of Montenegrin institutions of culture and civil society organizations, cultural sector strengthening is stimulated and preconditions for its more dynamic and more open development are created, in terms of contemporary trends and trans-border networking and exchange of ideas and expressions.

The expected results of this measure implementation, among other things, are: Enhanced capacities of programs users for realization of new projects; Strengthening of the base for creation of new sector policies; Improvement of cultural and artistic production; Internationalization of creativity and increased mobility of artists.

By participating in such EU programs new partnerships are created continuously, deals are made about co-production and common activities at international level are implemented (project in which participated: Royal Theater, Cetinje; National library, Cetinje, NGO Expeditio, Kotor, etc). Also, participating in international programs has aim to improve dialogue and co-operation of public institutions, civil sector and creative industries and their involvement in the domain of research and public policies. Besides, results expected refer to exchange between cultural workers and institutions. Creative industries are also important segment, where the results in the domain of improvement of creative and production capacities are expected,considering underdevelopment and unused potentials in that field.

One of the key challenges in Montenegrin culture is the fact that the sector relies chiefly on national funds and certain means allocated by municipalities for culture. It is through this measure that participation in other sources of financing and donorship from international programs intended for culture are promoted.

Finances allocated for implementation of this measure refer to annual contribution for membership in such programs or individual projects (IPA ArtVision).

- Annual contribution paid by Ministry for participating in Creative Europe program for 2014 was 25.000 euros, and for 2015 and 2016, 60.000euros each.

- Europe for Citizens, form the budget has been allocated total of 45.000 euros for annual contributions for 2014, 2015 and 2016.

- Anna Lindh Foundation, for the realization of the programs and projects in the network of this foundation in Montenegro, the financial contribution of Ministry was around 2.000 euros, while the Foundation itself donated around 20.000 euros.

- IPA, ArtVision – total budget for Montenegro, in this IPA Adriatic trans-border regional program which was realized in the period 2013.-2015., was 377.350,00 euros, of which the participation of the budget was 15 %.

Evaluation of the measure was conducted at national level through annual work report of the Ministry. One of the conclusions, and which is mentioned also in the Program of Cultural Development of Montenegro, is inadequate utilization of potentials of international programs and funds. As some of the reasons, human and professional capacities are mentioned as well as the challenges facing the civil sector when applying for this programs and funds.

For determination of the impact the indicators about numbers of projects realized are used, as well as number of organized Info Days and seminars, number of participants in meetings, number of applicants in open competitions for above-mentioned programs, number of  signed partnerships, coordination among artists that has been realized.

The Ministry of Culture has introduced special Public call since 2013 - for preparation and organization of joint presentation of Montenegrin culture at referential international book fairs and film festivals, as the form of stimulus for earning international recognition and promotion of Montenegrin creative work. Projects are, according to legal criteria, valued and chosen by an expert commission which members are referential cultural experts and authors.

Among expected results are also: greater mobility of artists and experts in culture, their more intensive networking with cultural actors at international level, improved quality of domestic production, the exchange of experiences and greater transparency and promotion of Montenegrin creativity and creative potential, increased number of common international projects.

The Strategy of Government of Montenegro for improvement of life quality of LGBT persons in Montenegro 2013-2018 (LGBT Strategy) in part that refers to cultural changes has as a goal to improve cultural values of importance for acceptance and social inclusion of LGBT population. Cultural changes as the key objective are stimulated by a series of strategic measures, among which are the support for cultural activities of LGBT community, involvement in contemporary cultural trends, positioning of cultural contents from the domain of LGBT expression in annual programs of public institutions for culture, cooperation with LGBT community in questions of importance for identity and development of creativity. Therefore, key objectives of this measure are the contribution to development of cultural tolerance and openness for LGBT persons, through becoming recognized in the field of culture and creation of cultural space for development and presentation of LGBT scene as a part of new social and cultural platform.

In domain of culture, this measure primarily refers to realization of concrete cultural-artistic programs and projects of authors from LGBTIQ population, and theme or questions from the life of that community. In particular, in the reporting period, in the domain of activity of Ministry of Culture, artistic programs and expert meetings have been realized, that is:

- Realization of photo exhibition entitled ‘’Here we are - Five years of visibility of LGBT activism in Montenegro’’ as common activity of Ministry of Culture and Public Institution ‘’Center of Contemporary Art’’ in partnership with NGOs Queer Montenegro and Juventas (October 2014);

- In municipal institution Cultural and Information Center ‘’Budo Tomović’’ Podgorica, the photo exhibition,’’Find the difference’’ of artist Maja Kovijanić was opened, as partner activity between Ministry of Culture and NGO ‘’Queer Montenegro’’ (December 2015);

- A panel discussion was held at the Ministry of Culture entitled ‘’Cultural expressions of minority identities’’. The panel was relized in cooperation with Montenegrin Network of Anna Lindh Foundation and NGO ‘’Queer Montenegro’’ (December 2015);

- Panel discussion ‘’Queer and other identities in contemporary theoretical and cultural practices’’ in cooperation with NGO ‘’Queer Montenegro’’,  with the presence of national institutions of culture and civil sector.

This  measure implementation was focused on the following results: stimulating of new cultural platforms development that affirm LGBT creativity and art; providing the space for promotion and presentation of expressions of LGBT population, queer culture and related forms of author creativity. In this sense, the expected results are the creation and affirmation of the LGBT cultural scene in Montenegro, along with obligation to include the cultural content of LGBT creativity in the regular programs of public institutions of culture, which is part of the process of developing tolerance and openness for the LGBT community, and contributing to the greater visibility of this community towards the promotion of inclusive social context.

The results of Panel discussions which were organized within this measure are acquaintance of cultural institutions representatives with the theme and socio-cultural contexts of queer expressions and LGBT identity. The focus of the panel, along with education, was put on the emancipation of phenomena mentioned in wider social framework, with intention to lower the animosities towards LGBT population.

Besides, it was concluded that it is necessary, even beside  strategic framework, to provide support for LGBT  cultural activities and development of the scene.

The Government of Montenegro has at the end of 2007 adopted the Strategy for integration of disabled persons in Montenegro for the period 2008-2016. It is the first strategic document by which the actual state in which are the disabled persons analyzed, along with a series of measures and recommendations that should be undertaken in order to improve their status. The document comprised, among others, the field: culture, sport and recreation, as well as the field referring to the status of the disabled persons in civil society. Through document mid-term projection of the state and status of the disabled persons in this field has been created, having as goal to strengthen creative potential, paticipation in cultural events and improvement of accessibility of cultural contents.

The process of evaluation of measure has been conducted at national level through annual reports of Ministry of Human and Minority Rights on realization of Action plans for carrying out the Strategy. The level of involvement of persons with disabilities in cultural events, in one part, is determined by legal restrictions regarding intervention of accessibility on objects that are protected by cultural heritage, then by lack of finances of national and municipal institutions as well as other organizations to organize to the full extent and support the development of artistic potential  of persons with disabilities. Therefore, this process requires continuity and intensive stimulating of policy of development of programs from the field of culture intended for this population.

The project ‘’Culture for Development Indicators-CDIS  has as a goal to show the role which the culture has as supporter and initiator of sustainable development.  With the help of innovative methodology, by this means of public advocacy and policies through the facts and data multidimensional relationship between culture and development is analyzed. Realization of this UNESCO project has as a goal the creation of 22 indicators in 7 social dimensions, which measure the impact of culture on development of the country, giving the analysis and data for cultural and development policies improvement as well as promotion of stronger integration of culture in national developing strategies.

Ministry of Culture and National commission for UNESCO in Montenegro, during 2015 have conducted UNESCO international project CDIS under the patronage of that international organization. Conducting of CDIS in Montenegro has started at the beginning of 2015, and data gathering process and analysis drafting was finished in April the same year, after which it was worked on further analysis in accordance with UNESCO CDIS Methodology. By research od 22 CDIS Indicators through this project policies of  seven key fields were analyzed: Economics; Education; Governing; Social Participation; Gender equality; Communication and Cultural heritage. After the preparatory phase during which Montenegrin CDIS team made acquaintance with CDIS Methodology and had identified data sources, the implementation process was initiated officially at the workshop on February the 23rd 2015. The workshop gathered participants from state institutions, Universities, civil society and media which discussed about potential of the project in the context of Montenegro, and identified additional data sources and established working partnerships. The participants expressed great interest in innovative methods of CDIS and have recognized the potential of it as the means for providing information for institutional dialogue and public advocacy of involvement of culture in developing strategies. Implementation has been completed on April the 15th 2015 when the beginning results of Montenegro for CDIS indicators were presented at closing workshop in Podgorica.

In accordance with the vision of CDIS project and experiences of countries in which it was realized, the CDIS implementation in Montenegro has concrete expected results. At national level, new facts and data were obtained, as well as their analysis and contextualization, should help in rising awareness on importance of culture, strengthening cultural and developing agenda, providing information for creation policies of  development and strategies, strengthening national statistics and monitoring system, taking steps toward EU integrations and achievement European standards in statistics, as well as improvement of inter-institutional dialogue and cooperation.

Evaluation of this measure was initiated at second workshop. In the key document that resulted from the project, Analytical brief, certain impacts were stated as well as additional values which this project possesses in Montenegro: raising awareness on developing potential of culture among active participants in the cultural sector and beyond it; the involvement of culture in national development agenda is being strengthened; shortcomings in statistics and monitoring system were discovered, pointing to the way for improvement and strengthening of such systems; CDIS has helped also in discovering the possibility of cooperation in the field of culture and development among involved parties. CDIS indicators for Montenegro contribute to the outcomes of CDIS at international level; Unique data are obtained along with indicators of other countries, in international database; by these data and their analysis, public advocacy and promotion of culture in developing agenda is strengthened by using facts and data, and comparative understanding of impact of culture on development is alleviated and the help is given in stimulating of involvement of cultural indicators in developing instruments and measures which are widely used.

            Besides, the impact and application of the results of this measure, that is, the project, they were presented at regional conference of Countries of South East Europe in which CDIS project has been initiated or is in the preparation, in April of 2016 in Belgrade, Serbia. It was noted that, among other things, the results and suggestions from CDIS were used during creation of Program for Development of Culture of Montenegro 2016-2020.

i.3 Which indicators were used to determine impact?: 

Realization of CDIS project implied the making of 22 key indicators in 7 dimensions of culture and development. Of 22 indicators, 16 could be made and interpreted using available Montenegrin and international sources (rate of implementation 73%). Besides, one alternative indicator was created for the dimension of gender equality and 1 additional indicator for dimension of communication.

Beside projects, the indicators for determination of impact of this measure realization are: incorporation of the results and conclusions from CDIS during creation of cultural policies and sector strategies, the improvement of representation of culture  and developing documents, the participation of interested parties during implementation of measure, innovated statistical data.

In January of 2013 Action Plan for Achieving Gender Equality in Montenegro 2013-2017 was adopted – developing document for policy of gender equality implementation, based on international and domestic legal sources which treat the issues of gender equality. The mission is to ensure gender equality in creating and conducting of all national and local policies, as well as in work of all legal subjects at state level.

In the field 6 of APAGE 2013-2017: Media and Culture the following measures are defined: the promotion of APAGE; To conduct the analysis of media reporting in terms of gender equality; To perform monitoring of media reporting continuously; To organize educational workshops for the ones employed in media on the topic of gender equality; To initiate conducting of statistics by sex of the ones employed in media; To print, present and distribute brochure on the role of media in promoting  gender equality; To organize educational workshops for the ones employed in local self-government and institutions of culture; To organize the Week of female cultural creativity (ŽENES); To prompt introduction of continuous programs which promote successful women in electronic and printed media, then women who deal with old crafts and skills; To participate in book fair with literature on gender equality. Within implementation of APAGE, the two-years Programs of implementation are defined, with activities and indicators.

Ministry for Human and Minority Rights has engaged an expert from abroad who has conducted external evaluation of overall APAGE 2013-2017 which will be soon available at link: http://www.minmanj.gov.me/ministarstvo. Preliminary evaluation has shown that improvement of legislative and institutional framework for achievement of Gender Equality  has occurred, and that visible results in all filed of life both at national and local level exist, but that space for further activity in order to create equal conditions for all the citizens (of both sexes) of Montenegro is present still.

In preparing APAGE  for  2017-2021, the analysis was given of actual state after implantation of APAGE for 2013-2017, in the fields of media and culture. Among other things, it is mentioned that during previous years numerous activities were conducted, so as to media to be active participants in implementation of Gender equality policy. Unfortunately, the role of media is not still strong enough in the part of promotion of Gender Equality, but is subject to corporative objectives and sexist advertising programmes. In the domain of culture and art, the presence of women is greater and their success is more visible. However,  in the works of culture themselves, stereotyped presentation of woman which affects the upbringing of girls and boys both is still present, as well as creation of new stereotypes and patterns of behavior.

By two-years programs of conducting APAGE (for 2013-2014 and for 2015-2016) the indicators of realization were defined, which, among other things, implied: Number of media performances and reports connected with APAGE; The conducted analysis of media reporting which is in terms of Gender Equality; The number of organized workshops and trained representatives of media, institutions of culture and municipalities on Gender Equality; Gathered and published data of employees in media and sorted by sex; Brochures published; The number of co-financed quality cultural-artistic programs and projects that make Gender Equality recognized; organizing of Women's Creation Week and number of events, number of actresses that participated; Number of media programs that make successful women recognized and that promote creativity of women dealing with old crafts and skills; the participation in the book fair with literature on Gender Equality.

One of the key goals of this measure is the creation of quality Youth Strategy in which the field of culture will be represented in a satisfactory way. In the context of such segment, the making and adoption of above-mentioned Strategy has as a goal to support young creators of culture and of media contents and providing equal access to cultural contents for all the young people.

In the reporting period, along with participation of representatives of public bodies and civil sector in culture, the state analyses were conducted and the Proposal for Youth Strategy 2017-2021 was created. Government adopted the Strategy in 2016 along with Action plan for the first year of its implementation.

Youth Strategy as key national document envisages the priorities and positions the system of support for young people in developing process of their growing up. This document with regulatory and financial aspect, has multilayer structure: Youth Strategy, the Plan of Strategy Implementation and Strategy monitoring and evaluation. Strategy is based on legislative foundation (Law on Youth, 2016) and strategic instruments for conducting youth policy, in institutional framework at national, local and international level. With clearly presented vision, young people in Montenegro are comprised through six fields in the form of key outcomes from the domains of: economic and social security, quality education, participation in decision-making process, the development of community and policies conducting, through health care system, access to quality cultural contents as well as establishment of normative and institutional framework for conducting youth policy, and their needs being in compliance with valid standards of international youth policy.

The process of making national Youth Strategy is conducted by Directorate for Youth and Sports and Ministry of Education. The process was supported by The UN system in Montenegro, within the common program of UN for strengthening youth especially.

  • More significant promotion of talented young creators;
  • Greater contribution of cultural contents to young people affected by poverty:
  • Stronger networking of young creators and amateurish cultural societies through innovative models conducting and usage of resources in the county, but also of young renowned creators from diaspora;
  • Greater number of travelling cultural contents (mobile cinemas, libraries, theatre etc);
  • Availability of information on cultural contents intended for young people in one place through unique internet portal;
  • Greater consumption of cultural contents by young people with visual and hearing impairments or with  other disorders and difficulties in development, through providing greater availability.
