When To File An Application (Time Limits)?
Within 60 days of the receipt of the administrative decision that you wish to contest, you must submit your request for management evaluation. If any person on behalf of an incapacitated or deceased staff member of the United Nations makes an application, he or she has one calendar year to submit it.
After receiving your request, the official or office responsible for conducting the management evaluation must send you a response within 30 calendar days if your duty station is in New York and within 45 calendar days if your duty station is elsewhere. Note that not all administrative decisions are subject to management evaluation (see more under Preliminary step prior to filing an application before the UNDT).
If you are not satisfied with the outcome of the management evaluation and you wish to appeal the administrative decision to the UNDT, you must submit an application to the UNDT within 90 calendar days after you received the outcome of the management evaluation.
If you do not receive a response to your request for management evaluation within the 30/45 days deadline, you must submit your application to the UNDT within 90 calendar days after the expiry of the relevant response period for the management evaluation.
In cases where a management evaluation is not required, namely when the decision you wish to contest imposes a disciplinary measure or was taken pursuant to the advice of a technical body such as the ABCC (Advisory Board on Compensation Claims), your application must be submitted to the UNDT within 90 calendar days after your receipt of the administrative decision.
Where you have sought formal mediation of the dispute, but no agreement was reached and you wish to file an application with the UNDT, your application must be filed within 90 calendar days after the mediation has broken down in accordance with procedures laid down in the terms of reference of the UN Mediation Division.
If you file an application to enforce the implementation of a mediation agreement, your application must be filed within 90 calendar days after the last day of the implementation specified in the mediation agreement. If the mediation agreement is silent on the matter, your application must be filed within 90 calendar days after the thirtieth day from the date of the signing of the agreement.
In exceptional cases, you may seek a suspension, waiver or extension of the abovementioned time limits. You must do so in writing and your request must mention the exceptional circumstances that, in your view, justify it. Your written request should not exceed two pages in length (excluding the cover page).
